CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: May 6, 2025
TO: Mayor and Councilmembers
FROM: Waterfront Department
SUBJECT: Amending Santa Barbara Municipal Code by Adding Section
17.12.200 Relating to Vessel Insurance Requirements; and Section
17.12.210 Relating to Process, Enforcement and Ability to Appeal [Ordinance Introduction]
RECOMMENDATION:
That Council introduce and subsequently adopt, by reading of title only, an Ordinance of the Council of the City of Santa Barbara Amending the Santa Barbara Municipal Code (“SBMC”) by Adding Section 17.12.200 Relating to Vessel Insurance Requirements; and Section 17.12.210 Relating to Process, Enforcement and Ability to Appeal.
BACKGROUND:
Uninsured boats present a liability risk to the City and to the greater boating community in general. The Santa Barbara Harbor District is one of the few remaining harbors in California that does not require vessel insurance. In fact, of the thirty marinas and harbors surveyed by staff, Santa Barbara is one of only four that does not have an insurance requirement. The Waterfront Department has been working with the Harbor Commission to create a policy for the past 18 to 24 months, with multiple public meetings ultimately leading to a draft policy. The Waterfront Department also engaged with the public by creating a survey to assess current insurance levels and potential support for starting a policy. The survey received roughly 400 responses from the Harbor Community indicating that over 80% of respondents already had a vessel insurance policy in place, and a majority favored requiring insurance to moor or anchor a boat in the Harbor District. Work began to draft an initial policy, staff integrated feedback from public comments and the Harbor Commission, and the City Attorney’s Office was enlisted to aid with language and other parameters. Additionally, staff worked with a vessel insurance broker to go over key elements of a draft policy to ensure it meets industry standards.

Council Agenda Report
Amending Santa Barbara Municipal Code by Adding Section 17.12.200 Relating to Vessel Insurance Requirements; and Section 17.12.210 Relating to Process, Enforcement and Ability to Appeal [Ordinance Introduction]
May 6, 2025
DISCUSSION:
Requiring vessel insurance is the industry standard for California harbors and marinas.
By not requiring insurance, Santa Barabra has become a destination of last resort for uninsured vessels anchoring in our waters. When those uninsured vessels go aground during storms, the City is left responsible for disposal and environmental costs. In backto-back storms in 2024, three uninsured vessels went aground on East Beach, costing the City close to $40,000 to dispose of and remove associated hazardous materials. One of these boats washed up near the mouth of Mission Creek, threatening sensitive wetlands and water quality.
These uninsured vessels present a serious financial risk to the City. An uninsured vessel that causes an electrical fire that spreads to nearby vessels, docks, or the Wharf would be a disaster, with millions of dollars in potential damage. Requiring insurance mitigates the financial risk associated with potential accidents, damage, or liabilities, ensuring a secure environment for both boaters and visitors. Implementing an insurance policy promotes accountability for all vessels in the Harbor District.
Working closely with involved stakeholders, the Waterfront Department incorporated concerns and feedback from both the public and the Harbor Commission when creating the proposed ordinance. The resulting insurance policy would require only general liability vessel insurance coverage, a minimum policy limit of $300,000, and a proposed implementation date of January 1, 2026. Staff worked hard to develop a policy that minimized the burden on boat owners while still providing basic liability coverage for the City. The policy would not apply to launched vessels, human-powered watercraft, skiffs less than 15 feet in length, or vessels anchoring in times of emergency. Any vessel required to have insurance will be given 60 calendar days to provide proof of compliance or be subject to impound, removal from the water, and/or termination of the slip permit.
The implementation date of January 1, 2026 gives any uninsured vessel owner roughly eight months to comply with the provisions of the policy.
BUDGET/FINANCIAL INFORMATION:
This ordinance does not have material financial or budget implications for the Waterfront Department.
HARBOR COMMISSION RECOMMENDATION:
This item was presented to the Harbor Commission at its meeting on March 20, 2025, and the Commission voted 6-0-1 in support of staff’s recommendations.

COUNCIL INTRODUCTION DRAFT 05/06/2025
1 ORDINANCE NO. _______
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
SANTA BARBARA AMENDING THE SANTA
BARBARA MUNICIPAL CODE (“SBMC”) BY ADDING
SECTION 17.12.200 RELATING TO VESSEL
INSURANCE REQUIREMENTS; AND SECTION
17.12.210 RELATING TO PROCESS,
ENFORCEMENT AND ABILITY TO APPEAL
THE CITY COUNCIL OF THE CITY OF SANTA BARBARA DOES ORDAIN AS FOLLOWS:
SECTION 1. Chapter 17.12 of Title 17 of the Santa Barbara Municipal Code is amended to read as follows:
17.12.200 Vessel Insurance Required.
Commencing January 1, 2026, all vessels in the Santa Barbara Harbor District must remain currently insured to retain a slip permit or to moor or to anchor. Vessel insurance must, at a minimum, meet the following criteria:
1. Commercial & Recreational Vessels.
a. Provide General Liability vessel insurance coverage, with a minimum policy limit of $300,000. Insurance policies for vessels held in partnership, trust, or a corporation must list the individual names of each vessel partner.
COUNCIL INTRODUCTION DRAFT 05/06/2025
2 b. Vessel insurance policies shall name the City of Santa Barbara as Additional Insured, if available from the underwriter, unless mooring or anchoring for less than 90 days.
c. This Subsection does not apply in cases where a vessel requests to anchor or moor in cases of emergency as determined by the Waterfront Director or their designee, however, such vessel must depart after the emergency. d. Vessel Owners must provide to the Waterfront Director a Notice of Cancellation of their insurance coverage or removal of the City as additionally insured within five business days of such event.
2. Excluded Vessels.
This vessel insurance policy is not applicable to launched vessels, humanpowered watercraft, or skiffs less than 15 feet in length.
17.12.210 Process, Enforcement and Ability to Appeal.
A. Effective January 1, 2026, and annually thereafter, those required to have vessel insurance pursuant to Section 17.12.200, are required to present their insurance declaration page demonstrating minimum policy requirements to the Waterfront Director or their designee upon request.
B. Any vessel required to have vessel insurance will be given 60 calendar days to provide proof of compliance. Failure to do so will result in the following:
1. Termination of the slip or live aboard permit. Slip permittees may request a waiver of the termination from the Waterfront Director under Section 17.20.005 (J) of COUNCIL INTRODUCTION DRAFT 05/06/2025

B. Authorize the Public Works Director to execute the fourth amendment to Contract No. 25,746-A with Bengal Engineering, Inc. in the amount of $150,000 for design support during construction and authorize $15,000 for potential extra services, for a total expenditure authority of $1,520,817; and
C. Adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Amending Resolution No. 24-066 Adopting the Budget for Fiscal Year 2025, to Appropriate Funds for the De La Vina Street Bridge Replacement Project.
EXECUTIVE SUMMARY:
Design of the De La Vina Street Bridge Replacement Project (Project) began in 2016.
The Project included a complicated design and lengthy right of way (ROW) acquisition and utility coordination phase. The Project was publicly advertised and received bids in March of 2025. Four bids were received, with the low bid being slightly under the Engineer’s Estimate. The Project was designed by Bengal Engineering, Inc. (Bengal).
Staff recommends that Council award a construction contract with Lash Construction, Inc. (Lash) and award the fourth amendment to the design contract with Bengal to provide design support during construction, which is required to address design questions that arise during construction.

Contract for Construction of the De La Vina Street Bridge Replacement Project [Resolution; Agreement]
May 6, 2025
DISCUSSION:
Project Description
The Project will replace the existing bridge located on the 2700 block of De La Vina Street between Vernon Road and Alamar Avenue over Mission Creek with a new bridge. The new bridge will meet current structural and geometric standards, while minimizing adverse impacts on Mission Creek (Creek) and the surrounding riparian area. The Project will also improve safety and accessibility for pedestrian and cyclists and improve safety for motorists.
The Project will also realign roadway approaches, abate hazardous building materials, relocate utilities, including domestic water and sanitary sewer facilities, construct channel walls, plant landscape materials, restore the Creek and habitat, and add stormwater treatment facilities.
Construction is anticipated to take approximately two years, during which De La Vina Street will be closed to northbound traffic between Arden Road and Alamar Avenue until the Project is complete. The Project will be constructed in two phases, starting with the downstream side of the Bridge in the first year and shifting to the upstream side in the second year.
The Project is primarily funded by Federal Highway Administration (FHWA) Highway Bridge Program (HBP) grant funds.
Contract Bids
A total of four bids were received for the subject work, ranging as follows:
BIDDER BID AMOUNT
1. Lash Construction, Inc.

May 6, 2025
The change order funding recommendation of $1,236,819, or 10 percent, is typical for this type of work and size of project.
Construction Phase Contract Services
Staff recommends that Council authorize the Public Works Director to execute the fourth amendment to contract 25,746-A with Bengal in the amount of $150,000 for design support during construction and authorize $15,000 for potential extra services for a total expenditure authority of $1,520,817. Bengal was originally selected as the Project’s designer through a competitive Request for Qualifications process that followed Caltrans Local Assistance Procedures Manual (LAPM) requirements.
On March 18, 2025, Council awarded additional construction support contracts with Filippin Engineering (FE) for construction management and inspection services and Catalyst Environmental Solutions Corporation (Catalyst) for environmental monitoring, restoration, and support services. All Project costs are noted the Estimated Total Project Cost Table below.
Community Outreach
Community outreach for the Project was initiated in the conceptual design phase and will continue throughout construction. The design was fully vetted through both an internal and public review process. The Project has been reviewed by the Architectural Board of Review and has been granted design approval. Hamner Jewel and Associates met with each impacted business owner and property owner, discussed the Project’s direct impacts on their property, and presented offers to each impacted property owner in accordance with the specific right-of-way needs. Business and property owner coordination follows the process outlined by the LAPM. Elements of community outreach will be included in the construction contract, and a robust outreach plan will be implemented prior to and during construction.
BUDGET/FINANCIAL INFORMATION:
This Project is primarily funded by the HBP, which is administered by the FWHA through Caltrans Local Assistance. HBP funds will be used to reimburse the City for 88.53 percent of design, right-of-way, and construction costs. The City’s grant fund match rate is 11.47 percent. With the recommended appropriation of additional HBP grant funds ($4,871,683) and allocation of Measure C Funds ($360,551), plus the previously appropriated HBP grant funds ($10,260,627) and Measure C Funds ($1,600,000), there will be sufficient expenditure appropriations in the Streets Grant Capital Fund budget in Fiscal Year 2025 to cover the Project’s construction costs ($17,092,861).

begin construction in spring 2025. Following a competitive Best Value selection process, Ohno Construction was identified as the contractor offering the best value to the City based on the evaluation criteria outlined in the request for proposals. This report includes staff recommendations to award the construction contract to Ohno Construction, execute a contract amendment with RRM Design Group to provide construction administration services, and to accept and appropriate a $6M donation from The GSF for the Project’s construction.
DISCUSSION:
Background
The City Council initiated the renewal of Dwight Murphy Field in May 2018 with the development of a community-based master plan (Master Plan). In January 2019, Council reviewed the Master Plan and in August 2019, authorized a Memorandum of Understanding with the Gwendolyn Strong Foundation (The GSF), a local non-profit 503(c)(3) organization, to collaborate with the City of Santa Barbara (City) for the fundraising, design, and construction of the Dwight Murphy Field Renewal Project (Project). In July 2021, the Parks and Recreation Commission made findings for the Project pursuant to Santa Barbara Municipal Code Section 28.37.025, and in August 2021, the Planning Commission approved the Coastal Development Permit. In December 2021, Council authorized the professional services contract with RRM Design Group (RRM) for final design and construction documents. The Project received all required approvals in fall 2024 and was advertised for best value construction proposals in November 2024.
Site History
Acquired in 1925, the park was first known as the Municipal Soccer Field and renamed to honor former Park Commissioner Dwight Murphy in 1933. During World War II, Army troops used it for recreation and training. Throughout the post war era, most of the park’s use went to community-based sports clubs and local sports enthusiasts. In 1969, new restrooms and locker facilities were constructed. In 1976, the Bicentennial Freedom Train was parked on a railroad siding abutting the field, with entertainment and exhibits in the nearby public areas. In 1987, the City re-designed the parking lots, and in 1991 added a new fitness area. The existing playground was installed in 2007.
Project Description
The Project will achieve a full-scale renewal of the 8.3-acre, 100-year-old City park, along with off-site improvements for Por La Mar and Ninos Drive. Project elements include: a multi-sport synthetic turf field; natural turf field and informal activity area; 32,000 square foot inclusive playground; outdoor fitness gym; family picnic area; trash enclosure; fully accessible restroom building; and the restoration of a portion of Sycamore Creek. Other amenities include landscaping, trees, accessible pathways throughout the park, a bus Council Agenda Report

loading zone, fencing, lighting, right-of-way and park access improvements for vehicular circulation, and the increase of on-site and perimeter parking from 196 to 242 spaces.
The Gwendolyn Strong Foundation
The City and the Gwendolyn Strong Foundation (The GSF) entered into a Memorandum of Understanding (MOU) in September 2019. The GSF, a local non-profit 501(c)(3) organization dedicated to fostering inclusion, kindness, and courage, and helping families with special needs, participated in the development of the Master Plan and committed to funding a portion of the design and construction costs to redevelop Dwight Murphy Field, with specific focus on the inclusive playground. The MOU established the protocol by which The GSF and the City collaborated and coordinated activities relating to fundraising, design, and construction of Project. Since that time, The GSF contributed $710,000 toward Project design and has successfully raised $6,000,000 in support of Project construction, with fundraising efforts continuing. Staff recommends that Council accept the donation in the amount of $6,000,000 in support of Project construction.
Construction Phase Contract Services
Staff recommends that Council authorize the Public Works Director to execute the Third Contract Amendment with RRM Design Group in the amount of $311,960 for construction administration support for the Project, for a total expenditure authority of $1,252,441.
RRM is the Project’s designer and will provide construction administration support throughout construction, including reviewing and approving contractor submittals, answering design questions, making design revisions, and supporting value engineering efforts.
City Procured Materials
To reduce contractor markup costs, the City chose to directly purchase materials for the modular restroom building and the synthetic turf field. These purchases were made through California Multiple Award Schedules (CMAS), a state-wide contract vehicle that allows commercial companies to sell products and services to state agencies at prenegotiated prices. These costs are shown in the Estimated Total Project Cost table below.
Community Outreach
At least 20 days before commencement of construction, the contractor will provide written notice to all property owners, businesses, and residents within 300 feet of the Project area. The notice will contain a description of the Project, the construction schedule, including days and hours of construction, the name and phone number of the Contractor(s), site rules and Conditions of Approval pertaining to construction activities, and any additional information that will assist Building Inspectors, Police Officers, and the Council Agenda Report

public in addressing problems that may arise during construction. Additionally, the Project has a webpage that updates interested parties and neighbors on a regular basis.
SELECTION PROCESS:
In November 2024, the City publicly advertised a Request For Proposals (RFP) seeking Best Value proposals from general contractors to construct the Project. On February 13, 2025, the City received two best value proposals: Granite Construction and Ohno Construction. The proposals were evaluated using a best value selection process that included price and predetermined selection criteria as factors in determining the successful contractor. The proposals were reviewed independently by a panel and scored relative to the selection criteria laid out in the RFP document. A review panel also conducted interviews with each general contractor. Both proposals exceeded the Engineer’s estimate of $22M.
The selection criteria outlined in the RFP were as follows:
Selection Criteria Maximum Points
Relevant Experience 250
Proposed Contract Schedule 150
Demonstrated Management Competency 200
Labor Compliance 100
Safety Record 200
Interview 100
Total Possible Qualification Points 1,000
The review panel scores were averaged for a Qualification Points total. The Best Value calculation was derived from dividing the proposed cost by the average of Qualification Points received. The lowest calculated number equals the Best Value.
Best Value Score = Proposed Cost / Average of Qualification Points Received Ohno Construction’s proposal produced the overall Best Value. Staff recommends that Council authorize the Public Works Director to enter into a contract with Ohno Construction.
The Project, as an improvement in an amount greater than $5,000,000, must include a project labor agreement. Therefore, the Community Workforce Agreement (CWA) between the City and the Tri Counties Building and Construction Trades Council is included as a requirement of the construction contract. The City is retaining the services of a CWA administrator to monitor compliance throughout construction.

COUNCIL AGENDA REPORT
AGENDA DATE: May 6, 2025
TO: Mayor and Councilmembers
FROM: Airport Department
SUBJECT: Santa Barbara Airport Environmental Review for the Terminal Improvement Project [Resolution; Agreement]
RECOMMENDATION: That Council:
A. Authorize the Airport Director to execute a City Professional Services contract with RS&H, Inc. in the amount of $573,969 for environmental review services related to the Terminal Improvement Project at the Santa Barbara Airport, and authorize the Airport Director to approve additional expenditures of up to $57,397 for potential extra services, for a total expenditure authority of $631,366; and B. Adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Amending Resolution No. 24-066, Adopting the Budget for Fiscal Year 2025, to Appropriate Funds for Environmental Review of the Terminal Improvement Project at Santa Barbara Airport.
EXECUTIVE SUMMARY:
The Santa Barbara Airport’s 2017 Airport Master Plan (AMP) recommended capital needs for the next 20 years to meet projected demand and maintain a high level of service. One of those capital needs identified was additional airline terminal space. The Santa Barbara Airport (SBA) has experienced significant growth in commercial passenger boardings over the past decade. Updated aviation forecasts indicate continued growth that will outpace projections from the 2017 Airport Master Plan and the 2025 Master Plan Update (MPU). In 2022, SBA contracted with Corgan Associates Inc. (Corgan) to develop a preliminary design for the Terminal Improvement Project (TIP) that will provide roughly 30,000 square feet of additional space to the existing airline passenger terminal. The project must now complete environmental review before additional funding can be received from the Federal Aviation Administration (FAA) to complete the design development and future construction.

Council Agenda Report
Santa Barbara Airport Environmental Review for the Terminal Improvement Project [Resolution; Agreement]
May 6, 2025
DISCUSSION:
Background
Since the John T. Rickard Airline Terminal (Terminal) opened in 2011, SBA has experienced approximately 162% increase in enplanements (i.e. commercial passenger boardings). Passenger enplanements were 270,233 in 2011 and 709,269 in 2024.
According to the 2025 SBA Master Plan Update (MPU), by 2031, SBA is estimated to experience 732,500 enplanements, a 171% increase since the last major landside capacity project was completed in 2011. Given record passenger growth in 2023 and 2024, it is expected that SBA will surpass the MPU 2031 estimated enplanements much sooner than 2031.
The 2017 AMP identified several major landside capacity projects necessary to meet the continued growth and development of SBA. One of those major projects is improvements to the Terminal to provide additional passenger hold room space, additional security screening areas, concessions, and more. The 2025 MPU included necessary forecasted future improvements beyond those included in the 2017 AMP.
On June 21, 2022, Council awarded a Professional Services contract to Corgan Associates, Inc. (Corgan) in the amount of $1,275,170 for conceptual design services to improve the airline passenger terminal and construct a parking structure as outlined in the 2017 AMP. Construction cost estimates for the terminal improvements were roughly $30 million and $60 million for a parking structure. Due to funding limitations, Airport staff decided to move forward with design development of the terminal improvements only, the Terminal Improvement Project (TIP). Design development of a parking structure is on hold and will not be developed currently. In the interim, the development of the Long Term Parking South project is moving forward with construction expected to begin in Fall 2025.
After the TIP conceptual design was completed by Corgan, City staff met with the FAA District Office to discuss the progression of the TIP and future funding. FAA staff determined that environmental review must be completed for the TIP to receive funding for the completion of design and construction of the improvements.
Consultant Selection and Contract Development
Staff published a Request for Qualifications (RFQ) for environmental review services for the TIP project on November 25, 2024. Six capable firms submitted qualifications, and after a thorough review and interview process, staff selected RS&H, Inc. as the most qualified firm to assist with environmental review. RS&H is based in Los Angeles and has extensive experience assisting airports with environmental review of terminal projects, specifically with similar projects in the state of California.
Once RS&H was selected, staff developed a scope for the necessary environmental review, which includes the required California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) review. RS&H developed a proposed fee Council Agenda Report
Santa Barbara Airport Environmental Review for the Terminal Improvement Project [Resolution; Agreement]
May 6, 2025
based on the scope and Airport staff hired an independent fee estimator (IFE) to validate the proposed fee, as required by the FAA grant process. The proposed fee and the independent fee estimate were within 2% of each other.
Community Outreach
The environmental review for the TIP will include all required community outreach as required by CEQA and NEPA. For this contract, City staff anticipates leading most, if not all, of the required outreach to save budget for the project.
BUDGET/FINANCIAL INFORMATION:
The total cost of the environmental review contract is $573,969. An additional $57,397 in extra services authorization is requested to cover any cost increases that may result from necessary changes to the scope of work. It should be noted that $301,450 of the contract is included as optional tasks, which would be authorized only if needed by SBA staff. This structure allows for reducing future contract amendments, while considering the uncertainty of the environmental review pathway with the Federal government. With the recommended appropriation of available Airport Operating Fund reserves, there are sufficient expenditure appropriations for the Project in the Airport Capital Fund to cover the cost of the contract, including extra services, with RS&H, Inc. The Airport Operating Fund will also continue to have adequate available reserves, according to policy, after this appropriation.
Funding for final design and construction is contingent partially on the completion of the environmental review. The total cost of the Project is currently estimated at approximately $40 million. The estimate will be refined as part of the design development phase services. Portions of the TIP will be eligible for FAA grant funding. Airport staff is looking at several funding opportunities, including the FAA’s Airport Improvement Program (AIP), and the Passenger Facility Charge (PFC) and the Transportation Infrastructure Finance and Innovation Act (TIFIA) programs.

SUSTAINABILITY IMPACT:
The Santa Barbara General Plan focuses on a stated mission statement of “Living within our Resources” and stresses sustainability for development (City of Santa Barbara 2011).
Also, a guiding principle of the 2017 Airport Master Plan (AMP) is to support sustainable 1 This amount assumes %50 of the improvement will be funded by the FAA.

design of airport facilities and the wise use of resources. The TIP will be consistent with the Santa Barbara General Plan and the 2017 AMP.
Further, City Charter Section 1507 is a policy of the City that states its land development shall not exceed its public services and physical and natural resources. Council Resolution 07-018 requires that new City building construction be designed and constructed to achieve a Leadership in Energy and Environmental Design (LEED) Silver classification or, where LEED is not applicable for the Project, at another green building program certification level that is contingent on the building type. Council Resolution 07- 018 also requires new building construction and major renovations for City owned and operated buildings be designed to exceed State Title 24 Energy Requirements by 20 percent. In addition, the City’s General Plan calls for the inclusion of solar energy to help meet the energy demand for these structures. Council Resolution 17-043 commits the City to 50 percent renewable electricity in municipal facilities by 2020 and 100 percent renewable electricity by 2030; therefore, pursuing a zero net energy building design would be in line with these goals.
The TIP will comply with each of these City policies and resolutions.
A copy of the contract is available from the project manager at [email protected].
ENVIRONMENTAL REVIEW:
The TIP elements were included in the 2017 AMP in the Initial Terminal Area Alternatives 1, 2, and 3. Each of these alternatives were analyzed in the Council-approved 2017 AMP Environmental Impact Report per CEQA. This contract will prepare an addendum to the 2017 AMP for the TIP. The Project also requires NEPA review, which is included in this contract; the FAA would be the lead agency. Also, the Project is in the City’s appealable jurisdiction of the Coastal Zone and would require a Coastal Development Permit.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: May 6, 2025
TO: Mayor and Councilmembers
FROM: Public Works Department
SUBJECT: Contract Amendment for Environmental Services for the Santa Barbara Police Station Project [Agreement]
RECOMMENDATION:
That Council authorize the Public Works Director to execute the First Contract Amendment with Rincon Consultants, Inc. for environmental soils excavation monitoring services for the Santa Barbara Police Station Project, Contract No. 22500070, in the amount of $223,081, for a new total contract amount of $307,747, and to authorize additional expenditures of up to $30,775 for potential extra services that may result from necessary changes in the scope of work, for a total expenditure authority of $338,522.
DISCUSSION:
Background:
The Santa Barbara Police Station Project (Project) is in the early construction phase. As part of the pre-construction work, additional soils testing was required by Santa Barbara County Environmental Health Services (EHS) to more thoroughly understand the fill material under the existing parking lot on Cota Street, including the potential for any contaminants. When the parking lot was constructed in the early 1970s, a large amount of unknown fill material was imported to level the site, and as a result the soil is not uniform. Since 2019, the site has undergone approximately 40 exploratory soil borings and tests to assess existing soil conditions.
The City of Santa Barbara (City) initially contracted with Rincon Consultants (Rincon) in September 2024 to develop and implement the dewatering program for the site. Rincon’s contract anticipated a far more complicated discharge-to-sewer permit than what was eventually needed and, therefore, carried with it a larger budget. The City asked Rincon to reallocate available budget under this contract to assist with the time-sensitive need to assess and test the impacted soil and groundwater, with the understanding that the original contract’s scope and budget would likely need to be increased to address the higher priority tasks. The recommended Amendment includes the anticipated remaining tasks required through Project completion.
Agenda Item No. 9

Council Agenda Report
Contract Amendment for Environmental Services for the Santa Barbara Police Station Project [Agreement]
May 6, 2025
Rincon has worked with the Project’s geotechnical expert, Earth Systems, Inc., to obtain an approved Corrective Action Plan (CAP) by EHS for how the impacted soils are to be removed. The Santa Barbara County Air Pollution Control District (APCD) has also approved the soil excavation process and disposal location. As the mass excavation begins, an environmental monitor is required to oversee the removal and disposal of the soils. The site’s groundwater has not been impacted.
Current Status
The Project’s initial stage of construction will include the installation of deep soil mixing columns for the new building’s foundation. Encountering the impacted soil or fill material requires monitoring. The recommended Amendment to Rincon’s scope of work for this environmental monitoring includes a monitoring and reporting program, visual inspections of the excavation of impacted soils, soil sampling and analysis, reporting to EHS and to APCD, and project management for this required process.
A copy of the Amendment may be requested from the Public Works Department for public review by contacting [email protected].
BUDGET/FINANCIAL INFORMATION:
With approval of the recommendation, the contract’s total encumbrance will be the new total contract amount of $307,775, plus the extra services allowance of $30,775, for a total expenditure authority of $338,522.
The cost for the recommended Amendment and potential extra services is covered by sufficient expenditure appropriations of bond proceeds in Fiscal Year 2025 in the Police Station Capital Project Fund.
SUSTAINABILITY IMPACT:
The proposed environmental monitoring plan will help ensure that any contaminated soil or pollutants found on site are safely removed and disposed of and generally improve the health of the site.
ENVIRONMENTAL REVIEW:
The Public Works Department prepared a Mitigated Negative Declaration (MND) that examined environmental impacts as required per the California Environmental Quality Act (CEQA) of the Project. The MND has been prepared in accordance with CEQA (Public Resources Code §21000 et seq.) and the State CEQA Guidelines (Title 14, California Code of Regulations, §15000 et seq.). Significant environmental effects identified in the MND that are anticipated as a result of the Project include impacts related to the following:
Air Quality, Biological Resources, Cultural and Tribal Resources, Geology and Soils, Hazards and Hazardous Materials, Land Use and Planning, Noise, and Water Quality and Hydrology. The MND includes mitigation measures to mitigate potentially significant Council Agenda Report

impacts to a less than significant level. Based on the mitigation measures identified in the MND, it has been determined that the Project will not have a significant effect on the environment after mitigation measures are incorporated. The MND was adopted by City Council on July 19, 2022.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: May 6, 2025
TO: Mayor and Councilmembers
FROM: Public Works Department
SUBJECT: Authorization of Waiver for Formal Bid Requirements for Pavement Maintenance Materials
RECOMMENDATION: That Council:
A. Waive formal competitive bid requirements for procurement of asphalt for pavement maintenance and repairs as authorized by Municipal Code Section 4.52.070 (L); and B. Authorize the General Services Manager to issue purchase orders to two asphalt vendors, Vulcan Materials and Granite Construction Company, in combined amounts not to exceed the amount set aside for this purpose in the budget adopted by Council for each fiscal year, for up to four fiscal years beginning in Fiscal Year 2026.
DISCUSSION:
Hot mix asphalt is used for year-round pavement maintenance by the City of Santa Barbara’s Streets Operations crews. It is only available from two suppliers within a 50- mile radius, Vulcan Materials and Granite Construction Company.
City crews rely on hot mix asphalt for various routine tasks, including pothole filling, patching, pavement point repairs, and production paving. Because both suppliers operate their plants intermittently, having access to both ensures that materials are available when needed. There are currently no comparable suppliers within a similar distance.
City crews perform repairs and production paving as part of the routine preventative maintenance strategy of the City's overall Pavement Maintenance Program. Materials are estimated to cost up to multiple millions of dollars per fiscal year. Separate purchase orders will be issued to each vendor each fiscal year. Just prior to the beginning of the Fiscal Year, City staff negotiate annual unit pricing with both suppliers. These unit prices are then used to make orders and ensure reasonable pricing throughout the year.
Because the annual amount of asphalt needed exceeds the $100,000 threshold of the General Services Manager's purchasing authority, and due to the need to have multiple asphalt sources, staff recommends that Council authorize the General Services Manager Agenda Item No. 11
File Code No. 530.04
Council Agenda Report
Authorization of Waiver for Formal Bid Requirements for Pavement Maintenance Materials May 6, 2025
to issue purchase orders to two asphalt vendors, Vulcan Materials and Granite Construction Company, in combined amounts not to exceed the amount set aside for this purpose in the budget adopted by Council for each fiscal year, for up to four fiscal years beginning in Fiscal Year 2026, contingent on no other comparable supplier entering the market within a 50 mile radius. In the event another supplier becomes available, staff will re-evaluate what is in the City's best interest for the following fiscal year. The actual amount spent with each vendor may be more or less than half of the combined amount each year, depending on quality, pricing, and availability. However, the combined total amount spent on asphalt will be within the approved budget amounts.
BUDGET/FINANCIAL INFORMATION:
The proposed purchase orders will not exceed the expenditure appropriations authorized in the annual adopted budget for pavement maintenance materials to ensure sufficient expenditure appropriations exist in the budget for the purchase orders. The purchases are anticipated from the Measure C Capital Fund so they are dependent on the annual Measure C allocation for pavement projects. Subsequent purchase orders will be budgeted for in future fiscal years.
ENVIRONMENTAL REVIEW:
The proposed procurement authorization falls outside of the definition of a “Project” under California Environmental Quality Act (CEQA) Guidelines section 15378 (b)(5) as administrative activities of governments that will not result in direct physical changes in the environment are not subject to CEQA environmental review. All future pavement maintenance projects will be subject to CEQA environmental review.
