A RESOLUTION OF THE CITY OF SANTA CLARA, CALIFORNIA, APPROVING A PURCHASE OF AN OVERHEAD ELECTRIC EASEMENT BE IT RESOLVED BY THE CITY OF SANTA CLARA AS FOLLOWS:
WHEREAS, the City of Santa Clara, a chartered city and municipal corporation, acting by and through its municipally owned utility, Silicon Valley Power ("City" or "SVP"), is engaged in a continuing effort to upgrade and enhance its overhead and underground distribution and transmission systems to meet new customer demand and to maintain the reliability of SVP's systems. The 60 kV facilities San Tomas Junction Substation Project ("Project") is one of the projects for this effort; WHEREAS, a portion of the proposed Project is an approximately 0.2 mile long, new double circuit 60 kilovolt (kV) overhead transmission line heading east of the San Tomas Aquino Creek along Highway 101, with the primary objective to provide 60 kV service to the proposed San Tomas Junction Substation; WHEREAS, the Project was analyzed in accordance with the requirements of the California Environmental Quality Act (CEQA). A Mitigated Negative Declaration (MND) was prepared for the Project by the California Energy Commission [File No. PLN2019-13742, CEQA2020-01072], and adopted by the Architectural Committee on April 15, 2020; and WHEREAS, City Council provided authority to negotiate Easements with owners of the parcel required to construct the Project and the City has reached an agreement with the property owner to purchase the easement necessary for the Project, upon the terms set forth below.
NOW THEREFORE, BE IT FURTHER RESOLVED BY THE CITY OF SANTA CLARA AS FOLLOWS:
1. That the purchase of the easement from the following property owner for the negotiated purchase price is approved.

2. That the City Manager, or duly authorized designee, is hereby authorized and directed to execute the Agreement for Purchase and Sale with the forgoing Grantor, which is attached to the Report to Council accompanying this Resolution and presented to the City Council on January 25, 2022, as incorporated by this reference.
3. Effective date. This resolution shall become effective immediately.
