87% of Fees are proposed to either decrease, remain unchanged, or reflect only minor adjustments (i.e., up to 10% or $10 change) 11% of fees are proposed to increase by more than 10%.

Primary drivers of increase are:
• Increases in the costs of equipment and materials recovered via fees Changes in personnel costs and services/supplies costs
• Changes in service requirements
A multi-year phase-in pattern is recommended for more than half of the fees proposed to increase by more than 10%. Immediate adjustment is primarily targeted only for new, discretionary activities.

100%+indicates minor exceptions where premiums above cost may be justified, such as market-based rentr.

Most program fees are managed dynamically by departments as offerings, demand, and other market conditions change seasonally It is impractical for governing bodies to revise and adopt program fees as frequently as programs change through the year
Cost recovery policy for the agency's parks and recreation programs is defined by its governing body (council)
Adopted cost recovery policy creates the boundaries for program fees set and managed by the department on a continual basis Staff will provide periodic reports to City Council on the efFect of cost recovery levels on participation and revenues and refine the policy over time

PROGRAM COST RECOVERY

BENEFICIARY TARGETED
Changes to Policy Based on Feedback
Three categories of users: residents, non-profits, all others Changes to cost-recovery tiers for certain programs; examples:

Competitions, meets, and tournaments: moved from cost
recovery target of 71-90% to the lower level of 41-70%
Non-profits and community groups: moved from 41-70% cost recovery to 1-20% cost recovery for facility (meeting rooms or social gatherings) use and the non-profit event fee
Programs providing considerable individual benefit (e.g., dance class, pottery, keyboard) are now placed into the 71-90% cost recovery target due to their considerable individual benefit 12 100°k+indicates minor exceptions where premiums above cost may be justif ed, such as market-based rents.

Programs with the highest level of community benefit will have the lowest level of cost recovery
Programs that have the greatest level of individual or
group benefit will target the highest level of cost recovery Pricing of programs and services takes into account
market rates and the impact on demand which may
override cost-recovery target considerations
• Non-resident fees are priced higher than resident fees • Fees will be periodically reviewed to keep pace with
changes in the cost of living, market demands, and/or to promote identified Recreation Programs
• Staff will adjust fees to meet minimum cost-recovery rates and to be consistent with market demand for services
• The City will continue to offer a grant program to offset the cost of programs for eligible low-income participants identified through its established procedures
13 • Proposed fee schedule provides uniform rate for rental of parks and recreation facilities by non-profit organizations for meeting use
• $20 per meeting
• Staff will meet with Board of Library Trustees and return with proposed library room rental fees in June 2022.
• Proposed recommendations to be presented to Board
include uniform rate of $20 per meeting (i.e., reduced rental rate)
• Elimination of Technology Fee for library room rental • Proposed fee schedule includes $14 per hour reserved
field use charge for non-profit organizations
• Charge is consistent with charges imposed by other regional agencies
• City of Campbell: $20 - $30 per hour with discount
. based on percentage of resident participation
• City of Mountain View: $8 per hour
• City of Novato: $9 - $15 per hour
• City of Palo Alto: $9 - $30 per hour
• City of San Rafael: $20 - $25 per hour
• City of Sunnyvale: $25 per hour or $175 per day
14 Estimated revenue impact of proposed changes is
$1.4M
Recovers increasing costs in the General Fund as well
as other funds.
~~ Estimated revenue change for Parks &Recreation is
approximately $0.6 million.

Re: Proposed Park Fee Increase -Master Fee Schedule 2022-2023 Patrick Henry Specific Plan
Dear Mayor and City Councilmembers:

W e very much appreciate your support and recent approval of the Patrick Henry Drive Specific Plan ("PHD SP"). We are extremely excited that the City is providing an opportunity to create the much needed market rate and affordable housing as well as new public parks and other community amenities in Santa Clara.

Following the City Council's adoption of the Plan, we received notice of the 2022-2023 Proposed Master Fee Schedule, including a 15% Parl< Impact Fee increase. This increase will male housing infeasible in the PHD SP, already burdened by extraordinary parkland, infrastructure and long-term maintenance costs.

As of the August 2019 City Council meeting, the PHD SP was scheduled for adoption in "Late Summer 2020". This would have allowed our project application to fall under the 2020-2021 Master Fee Schedule if deemed complete by June 2021, a feasible and practical assumption.

Unfortunately, the Plan was not adopted until March 2022, placing an application to be deemed complete under the Proposed 2022-2023 Master Fee Schedule. The PHD SP funding stakeholders have collaborated throughout this process despite schedule delays, increased PHD SP and implementation costs, and increased public parkland dedication acreage requirements.

The proposed 2022-2023 MFA Parl< Fee for the PHD SP area of $43,472 per unit represents a 12 554 increase per unit, or 40.6% increase in Parl< Fees from the time when stakeholders expected they would be deemed complete. We respectfully request that the City Council provide a pipeline status to the Patrick Henry Plan Specific Plan under the 2021-2022 Master Fee Schedule Parl< Impact Fee rate for at least one year or longer from PHD SP adoption to allow stakeholders to process applications and preserve the feasibility of the plan.

Thank you in advance for your consideration of and we sincerely appreciate your support.

Sincerely,
~ ~~

Re: Proposed Parl< Fee Increase -Master Fee Schedule 2022-2023 Patrick Henry Specific Plan
Dear Mayor and City Councilmembers:

Thank you very much for your support and recent approval of the Patrick Henry Drive Specific Plan ("PHD SP"). We are very excited that the City is providing an opportunity to create much needed market rate and affordable housing as well as new public parks and other community amenities in Santa Clara.

Following the City Council's adoption of the Plan, we received notice of the 2022-2023 Proposed Master Fee Schedule, including a 15% Pari< Impact Fee increase. This increase will male housing infeasible in the PHD SP, already burdened by extraordinary parkland, infrastructure, and long-term maintenance costs.

As of the August 2019 City Council meeting, the PHD SP was scheduled for adoption in "Late Summer 2020".This would have allowed a project application to fall under the 2020-2021 Master Fee Schedule if deemed complete by June 2021, a feasible and practical assumption.

The proposed 2022-2023 MFA Parl< Fee for the PHD SP area of $43,472 per unit represents a 12 554 increase per unit, or 40.6°o increase in Parl< Fees from the time when stakeholders expected they would be deemed complete.

Subject: Proposed Park Fee Increase -Master Fee Schedule 2022-2023 - PHDSP Greetings Mayor and Councilmembers,
BIA Bay Area is fully in support of enacting a "pipeline" exemption of Parkland Dedication In Lieu and other fee increases as requested by the Patrick Henry Drive Specific Plan builders. Through no fault of the Plan's builders, the timeline for approval of the PHDSP was delayed until just last month, extending the projected date of completed project applications until later this year. COVID 19 protocols, staffing shortages, and other extenuating circumstances have led to this frustrating predicament for the Plan's builders wherein fee increases, construction materials and labor cost increases, and other negative financial hits are pushing projects closer to infeasibility.

BIA respectfully requests that the City Council recognize this untenable situation and provide the PHDSP builders with a one year pipeline exemption to proceed under the current Parkland Dedication and In lieu and Municipal Fee schedule.

Very truly yours,
Dennis Martin
