Dear Sir/ Madam,
1 am Pables , homeowner of the property at • 1468 Pomeroy Avenue, Santa Clara, writing this letter to voice my disapproval of building proposed massive developments, addresses stated above.
The proposed developments will make neighborhood's problems worse: traffic, safety, parking, and noises. The following points are our concerns:
1- Traffic: is very heavy during business hours on this narrow section of Pomeroy - one lane each direction without safety lane between two opposite lanes - people traveling North to get to work during AM time and returning home PM time, DMV's student drivers practicing driving or taking tests, parents dropping off or picking up their kids at Pomeroy Efementary school, a Retirement community and a church adding more travelers to this section.
2- Safety: due to multiple sources of traffic above, school kids, pedestrians and neighborhood residents are not safe.
3- Speeding drivers and drivers fail to stop at the Stop-sign intersection of Pomeroy and Granada are constant dangers to the neighborhood residents 4- Parking: Lots of vehicles and RV to be repaired sitting along street and parking lots of business' nearby are the Professional Auto wrecking 3236 Pomeroy Avenue - occupying numerous parking spaces of the business nearby and along Pomeroy, which are inoperable for weeks and months, therefore new developments would make parking and traffic problems worse.
Therefore, new developments at this location would turn our neighborhood's bad situation into worst. We hope to see this project denied.

Regarding: 1530-1540 Pomeroy Avenue Residential Project File Numbers: PLN2019-13924 Formerly PLN2016-12053; PLN2016-12068 denied by the City Council 11/13/18 Public Comments: City Council Virtual Meeting 10 May 2022 Dear Santa Clara Mayor, City Council Members, and City Attorney, 1 ask that you respect and abide by the City of Santa Clara City Code and deny this application for objective non-conformance to the City Code. Specifically, 12.35.100 (a), (d_1) and 12.35.110 The application CEQA/MND (p34-36) recognizes the potentially significant adverse impact on protecied trees on my property (1501 Bergin Pl). "Construction of the foundation for the proposed townhomes could damage the roots of this tree and adversely affect its health and vitality." The Mitigation Measure BR-3 for the current development plan does not conform to the City Code(s) noted. Therefore, the risk is not mitigated and significant. Additionally, the MND is dependent on an arborist report (2/2017) based on the previously submitted development plan (11/2018). The information provided to the City is misleading, if not fraudulent. For example, the diagram on page four does not represent the current development plan; the text is an inaccurate estimate of the foundation distance from the tree and underestimates the actual tree drip line/canopy. All of the inaccuracies presented to the City are an attempt to hide the substantial risk to property and potentially life. Imagine the tree on page 3 of the Arborist report falling on your home because its roots were damaged a mere ten feet from its massive trunk.
Approval of this application will result in damage to this protected tree, which will have a significant adverse impact. However, suppose the Project Planners conducted proper due diligence. In that case, the City Code remedies this situation in Section 12.35.100 (b_2), e.g., Strike the statement "or as close to the proposed building foundation as possible" in Mitigation Measure BR-3.
As a Santa Clara citizen, I have done my civic duty, and you are now aware of the impact and repercussions of your decision. So, again, I ask that you respect and abide by the City of Santa Clara City Code and your residents. Deny this application again.
Thank you for your attention to this matter. Please don't let AB 3194 get abused.

12.35.100 Construction and development.
When site development is occurring and a discretionary permit and a public hearing are required excluding R1-6L single-family residential zoned properties, the developer or property owner shall meet the following requirements:
• Tree Survey. A tree survey conducted by an arborist who has been certified by ISA shall be submitted as part of the required application materials for all use, design or special development permits on developing or redeveloping property. The survey shall show the location, size, and species (both common and Latin names required) of all trees on the site. A written report by an ISA-certified arborist shall be included when any city tree or protected tree is proposed to be removed explaining why the tree(s) cannot be relocated. (d) Tree Protection Plan. The developer shall submit written plans prepared by an ISA-certified arborist that outline protection measures as a tree protection plan for city trees and protecied trees.
The plan shall include tree protection measures that will occur during and after construction, and specifically identify the tree protection zone. City trees and protected trees shall be protected by use of the following methods:
(1) Protective fencing shall be installed no closer to the trunk than the dripline, and far enough from the trunk to protect the integrity of the tree.
12.35.110 Prohibited acts.
(f) Make any excavation, place any fill, compact the soil, or construct any structure, walkway, driveway, pavement, or public utility within fifteen (15) feet of any city tree or protected tree that could damage the health of the tree. (Ord. 2036 § 2, 12-7-21).
18.16.140 Additional development standards
(a) Fencing. At the time of new construction of a building on property, a solid fence of masonry six feet high shall be installed, and thereafter maintained, by the owner of property in this zoning district on all common property lines:
Construction of the foundation for the proposed townhomes could damage the roots of this tree and adversely affect its health and vitality. Absent appropriate precautions, proposed construction 2 activities could potentially damage the neighboring avocado or Spanish dagger trees, which would be a potentially significant adverse impact.
Mitigation Measure BR-3: Prior to the initiation of demolition and construction activity, a tree protection zone (TPZ) shall be established with exclusionary fencing around the mature avocado tree located adjacent to the project site, and shall be maintained throughout project construction. The TPZ shall extend into the project site approximately 15 feet, or as close to the proposed building foundation as possible, and shall have a width of 35 feet, centered on the tree, as depicted in the arborist report prepared for the project by Kielty Arborist Services (February 2017). The TPZ fencing shall conform to the specifications stipulated in the Kielty arborist report. Within the TPZ, the piers for the pier and grade beam foundation shall be hand dug to a depth of 3 feet below the ground surface (bgs). The grade beams shall be hand dug and shall not exceed a depth of 6 inches bgs. All encountered roots of the avocado or Spanish dagger trees shall be protected from damage and shall be fully exposed by hand and be inspected by a certified arborist. If cutting of any roots is required, the construction contractor shall first receive authorization from the arborist. Any root cuts shall be cut cleanly by hand saw or loppers. Soaker hoses shall be placed within the TPZ for the avocado tree, as close as possible to the proposed foundation, and close to any cut roots of the Spanish dagger trees and shall be turned on every two weeks for five hours at a time throughout the dry season.
Throughout the construction period, the project construction contractor shall comply with all other provisions of the Tree Protection Plan set forth in the Kielty arborist report. Prior to the initiation of construction activity, all project construction contractors shall attend a pre-construction meeting with the project arborist to review the tree protection guidelines, which should identify access routes, storage areas, and work procedures. No activity shall encroach upon the TPZ and no materials, debris, or excess soil shall be placed within the TPZ. The TPZ fencing shall be periodically inspected and repaired as needed. A certified arborist shall conduct a final inspection of the TPZ prior to its removal at the end of construction. Any warranted remedial work on the trees identified by the arborist shall be performed prior to issuance of occupancy permits for the project. 3 Saved to thi

Subject: Resident's Opinion
I absolutely vote NO to add any more money to the 49ers for the Levi sign. I thought it the Levi Company was responsible?
Jed York knows he has five councilmen in his pocket and they would NEVER say no to Uncle Jed. When $8000 was given to the
49ers for two individuals to go to concerts. I knew the 49er Five were incapable of making a sound decision.
Why couldn't they have given eight outstanding teachers $1000? Why couldn't they have given $8000 to feed the hungry people in
Santa Clara? I would have been happy to see $8000 go to humanitarian needs in the Ukraine.
Now the request for General Fund money to repair or replace the Levi Sign, absolutely not.
I also know Councilman Hardy wants to do away with City Wide Cleanup. Why? Citizens are paying for it. Many citizens don't have
the vehices or funds to take throw aways to the dump. If we do away with City Wide Clean Up, there will be illegal dumping and
areas of Santa Clara will look like sections of Oakland and San Jose. Maybe Uncle Jed wants to do away with City Wide Clean Up.
Residents Get involved! the 49er Five have made our beloved Santa Clara an embarrassment. Email the council and let them know how you
feel. No Full Time Cith Attorney! No Full Time City Manager! No talented individual wants these jobs because as soon as they try to hold the 49ers accountable, the 49er Five will fire them.
I coud go on and on, but I won't. I vote for honesty and integrity. Will five good people stand up and run for City Council? We need to eplace
the 49er Five.

Vesting Tentative Subdivision Map for 1530-1540 Pomeroy Avenue, Santa Clara, (File No. PLN21-15320)
Dear Mayor Gillmor and Honorable Councilmembers:
We write on behalf of our client, Ridgecrest Group Inc., in connection with the above-referenced eight-unit condominium project at 1530 and 1540 Pomeroy Avenue in Santa Clara. The Planning Commission correctly approved a Vesting Tentative Subdivision Map for the project on March 9, 2022, in part because of the provisions of Assembly Bill 3194, which protects housing development projects such AB 3194 is a 2018 statute that amended the Housing Accountability Act (Gov. Code § 65589.5; "HAA"), a housing production statute that severely constrains the ability of local agencies to disapprove housing development projects that meet objective development standards and criteria. AB amended the HAA in several ways, one of which was to revise subsection (i)(4), which now reads as follows:
A proposed housing development project is not inconsistent with the applicable zoning standards and criteria, and shall not require a rezoning, if the housing development project is consistent with the objective general plan standards and criteria but the zoning for the project site is inconsistent with the general plan. The local agency may require the proposed housing development project to comply with the objective standards and criteria of the zoning that is consistent with the general plan, but the standards and criteria shall be applied to facilitate and accommodate development at the density allowed on the site by the general plan and proposed by the proposed housing development Offices: Walnut Creek / San Francisco / Newport Beach
Lisa M. Gillmor, Mayor
May 10, 2022
Subsection (i)(4) is part of subsection (i) of the HAA, the original heart of the statute that severely constrains the ability of a local agency to disapprove a housing development project except under the following specific circumstance:
(i) (1) When a proposed housing development project complies with applicable, objective general plan, zoning, and subdivision standards and criteria including design review standards, in effect at the time that the housing development project's application is determined to be complete, but the local agency proposes to disapprove the project or to impose a condition that the project be developed at a lower density, the local agency shall base its decision regarding the proposed housing development project upon written findings supported by a preponderance of the evidence on the record that both of the following conditions exist:
(A) The housing development project would have a specific, adverse impact upon the public health or safety unless the proiect is disapproved or approved upon the condition that the project be developed at a lower density. A "specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete.
(B) There is no feasible method to satisfactorily mitigate or avoid the adverse impact other than the disapproval of the housing development project or the approval of the project upon the condition that it be developed at a lower density.
The HAA also defines the term "objective" to mean involving no personal or subjective judgment by a public official and being uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official (Gov. Code § 65589.5(h)(8)) and to specify that a housing development project or emergency shelter shall be deemed consistent, compliant, and in conformity with an applicable plan, program, policy, ordinance, standard, requirement, or other similar provision if there is substantial evidence that would allow a reasonable person to conclude that the housing development project or emergency shelter is consistent, compliant, or in conformity. (Gov. Code § 65589.5(i)(4)).
Taken together, the HAA eliminates the ability of the City to lawfully disapprove this project because the project meets all objective development standards, and there is substantial evidence to allow a reasonable person, including both City staff and the Planning Commission, to conclude the project does not meet such standards.
Moreover, there is no evidence, much less a preponderance of evidence, to conclude that the project would have a specific, adverse impact upon the public health or safety.
Lisa M. Gillmor, Mayor
May 10, 2022
We commend City staff for its excellent work in connection with the project and in recognizing the applicability of controlling state housing law, as well as the Planning Commission for following staff's recommendation that the Commission recommend approval of the project to the City Council. We now respectfully request that the Council approve the project.
Sincerely,
MILLER STARR REGALIA
