RESPONSE TO COUNCIL QUESTIONS RE: 9/27/22 AGENDA

Agenda Item 3.A: Board, Commissions and Committee Minutes

Council Question:

I know it’s a very minor issue, but the Parks and Rec committee meeting minutes don’t indicate when the meeting concluded:

Staff Response:

The correction has been made by the Parks and Rec staff, The revised set of minutes will be forwarded to council for approval and note for the record that there was a correction made to the adjournment.

2 Agenda Item 3.B: Action on Agreement with Dasher Technologies, Inc. to Provide and Implement an Enterprise Data Storage Solution

Council Question:

1. How do we protect against a fire wiping out a data site? Will we lose much data?

2. Suppose we got hacked by ransomware and our data got damaged. How do we recover without having to pay a ransom? I didn’t really see much about a discussion about cyber-security.

Staff Response:

Due to the sensitive and confidential nature of the topic, a separate briefing can be prepared for this item in 1:1 meetings. Generally, data is stored in separate facilities with back up. Staff is also working on new projects to strengthen cyber security.

Agenda Item 3.G: Action on Amendment No. 5 to the Agreement for Professional Services with Perkins + Will for the Tasman East Specific Plan

Council Question:

I plan to pull this item. I would like a presentation of the scoping plan for the 1500 units before we begin the supplemental EIR. I would also like to know the level of community outreach that has been done for the additional 1500 units as well as the status of the park and school. Will there be a grocery store at TE?

Staff Response:

The department will prepare responses to be heard during the meeting.

Agenda Item 4.C: Action on Request Submitted by the Stadium Manager to Award Purchase Order to imageOne Uniforms for Guest Services Uniforms

Council Questions:

Given that we have settled with the 49ers/Manco on the management agreement which includes authority of up to $100K to ED, why is a 10K item coming to Council?

Staff Response:

The Settlement Agreement does not change Chapter 17.30 (Stadium Authority Procurement Policy) of the Santa Clara City Code, which currently requires Board approval for all Stadium Authority contracts or agreements to acquire services, materials, and equipment. Below is a snippet of Section 5 of the Settlement Agreement which discusses the Procurement Ordinance:

The referenced Ordinance will have to be introduced through a first reading and adopted by the City Council at the second reading. Until then, all Stadium Authority procurement requests will continue to require Board approval.

3 Agenda Item 6: Public Hearing: Actions on the Mitigated Negative Declaration (MND) and the Mitigation Monitoring and Reporting Program (MMRP), General Plan Amendment from Community Commercial to High Density Residential, Rezone from General Office (OG) to Planned Development (PD), and density bonus agreement to allow a multifamily affordable housing development with 108 rental units at 1601 Civic Center Drive

Council Question:

Regarding this property 1601 Civic Ctr Dr property there was a council meeting held on 10/19/2021, where the following item was brought forward:

21-1478 Action on a Written Petition (Council Policy 030) submitted by Morteza Shafiei, as representative of HOAs on October 7, 2021 to add an Agenda Item to a future Council Agenda to Consider the Purchase of lot at 1601 Civic Center Drive

Council approved that this item be brought forward to the council at a future council meeting.

Why was council direction not followed and why this item as approved by council majority was not brought forward for discussion as an agenda?

Staff Response:

This item appears on the February 2022 priority setting list of 030s and on our referral log, however it is listed as TBD and it was noted that there was no staff capacity or resources to complete at the time, due to the departure of the Assistant to the City Manager overseeing Real Estate.
