WHEREAS, on December 7th, 2022, the Planning Commission voted unanimously to adopt the Resolution to Approve the Variance for the Project at 2121 Sheraton Drive (5-0-0); WHEREAS, on December 8th, 2022 Annekathrin Chatterjee (“the appellant”) formally appealed the Planning Commission’s action to adopt a resolution to approve the variance on December 7th, 2022;

1. That the City Council hereby finds that the above Recitals are true and correct and by this reference makes them a part hereof.

2. That the City Council hereby sustains the Appellant’s appeal and overturns the Planning Commission’s December 7, 2022 decision to approve a Resolution for a variance, and denies the project.

3. That pursuant to SCCC Section 18.108.040, the City Council hereby makes the following findings with respect to the variance:

Resolution/ 2121 Sheraton Drive Page 3 of 4
A. That there are no unusual conditions applying to the land or building which do not apply generally in the same district , because the shape, dimensions, and size of the lot are not unusual for the R1-6L zone.

B. That the granting of the Variance is not necessary for the preservation and enjoyment of substantial property rights of the Property Owner, because the Owner could locate an accessory structure in an alternate location on the lot and still comply with Code requirements. //
