Please state reasons why you want to become a member of this Board/Commission/Committee, including what specific objectives you would be working toward as a member of this advisory board:
As parents, wa frequently complain about the amount of time our kids are in front of a screen. As adults wa find ourselves and our society plagued by obesity, diabetes and cardiovascular disease. As \\e age, wa find 1\e don't have the stability and strength to have a health-span that matches our modern medicine granted lifespan. I believe our parks, pools and recreation programs have much to offer to make a substantial difference in our community's wall-being. Getting our community outdoors and active v.ill have secondary benefits of getting them to know each other and to make them be more understanding of each other and be there for each other.
Despite all these benefits, 110 find our resources and programs under utilized and some facilities poorly maintained such as the International Sv.im Center, \\hich has been dov,n for the last three months and is not the first time, and the Mary Gomez Pool. We can do better as a community and a city.
The way m can do better as a community and a city is if m drive our decisions based on data and outcomes. We can do better if m had greater ccmmunity participation and listening to their needs, wants and ideas. We can do better if m have better management and oversight.
I believe I have:
- the ability to IM:lrk v.ith people having IM:lrked in small and large organizations and managed very large teams. I have over 30 years of el<!)erience of v..hich 25 years have been in leadership positions and 17 years in management positions - the creativity and problem solving skills necessary to come up v.ith solutions mrking \\ith fellow team mates. I have 11 issued US patents in my name - the passion and desire necessary to see the best interest of the community having volunteered to mrk in and v.ith multiple non-profit and community organizations including Catalyze SV, Santa Clara S\\im Club, Santa Clara Community Advocates - a interest in seeing our parks and recreation resources and our community thrive given my. interest in outdoor activities, sports and community organizing for community benefit
- the necessary skills to drive choices and decisions using data, analytics, robust discussions and community support I v.ish to offer these skills in serving our community on the Park and Recreations Commission v.ith the objective of improving and better managing our resources, engaging our community in understanding their needs, developing our programs based on community need, and helping our community thrive.

City Attorney’s Office
Memorandum
Date: July 12, 2023
To: Honorable Mayor and Members of the City Council
From: Luis Martin Haro, Deputy City Attorney
Subject: Conflicts Review – Parks & Recreation Commission Applicants
Background
The City Attorney’s Office has been asked to review applications to City Boards and Commissions regarding potential conflicts of interest. The applications generally do not provide complete information regarding potential conflicts; however, they do occasionally disclose potential confl icts of interest or incompatible offices. The purpose of this memorandum is to highlight areas of potential conflict that are disclosed by the application. In order to analyze potential conflicts, it is necessary to consider the duties of the particular commission for which the applicant is seeking appointment. This review is limited to the information provided on the applications and is not intended to be comprehensive investigation of potential conflicts involving the applicants.
Commission Duties
Pursuant to the City Charter and the City Code, the Parks & Recreation Commission is responsible for the establishment, acceptance and continue supervision of a long-range parks and recreations program for the City; planning and implementing an annual program of recreational and cultural activities for all age groups; recommending and supervising all the City’s contractual relationships with other agencies in the recreational field; and serve as correlating agency between the City and other units of government o n recreational undertakings.
Legal Conflicts that May Preclude Vote or Participation
Certain positions may preclude a commissioner from participating in a commission discussion or from voting if a matter involving the entity comes before the commission. While this list is not complete, these types of conflicts generally fall within one or more of the following situations:
• An applicant has an interest in property the value of which could be affected by a decision coming before the Commission
• An application shows entities that are “sources of income” to a potential commissioner within the 12 months preceding the start of the commission term, as defined under the Political Reform Act, • An applicant is an officer or employee of an entity that could be involved in a matter coming before the commission, or
• An applicant engages in a profession serving the local market that is likely to realize financial benefits or detriments, distinguishable from the public generally, that would result from the work performed by the Commission.

Appearance of Bias
There may be facts which would not amount to a legal conflict of interest requiring a commissioner to recuse him- or herself from a commission vote or discussion, however the relationship could create an appearance of bias on the part of the commissioner. The Code of Ethics and Values requires that Commissioners “make impartial decisions, free of . . . financial and other personal interests that impair [one’s] independence of judgment or action.” Accordingly, a situation may arise that may require a commissioner to recuse him- or herself if the facts could reasonably lead one to conclude that the applicant would be biased for or against an entity or entities.
Review of Applicants
Set forth below are the applicants and any apparent legal conflicts of interest and/or appearance of bias related to entities that are likely to come before the commission in some manner, as identified on the applications.
• Peter Louis Delaney
o The applicant is semi-retired and has listed that he has been a Linux/Unix developer since 1980. No other sources of income were disclosed.
o The information disclosed reveals neither incompatible offices nor apparent conflicts of interest.
• Vikas Gupta
o The applicant did not disclose any sources of income. o The applicant disclosed membership on the Santa Clara El Camino Specific Plan Community Advisory Committee. Participation on the Committee is advisory and non- voting and therefore does not present a conflict of interest. o The applicant disclosed membership in Catalyze SV, Santa Clara Swim Club, and Santa Clara Community Advocates. Based on a web search of these organizations, it does not appear that the applicant still serves on the board of these organizations. However, if the applicant currently serves on the Swim Club board or serves on the board in the future, it would be prudent to recuse from taking action on any items coming before the Commission related to the Swim Club.
o The information disclosed reveals neither incompatible offices nor apparent con flicts of interest.
• Kiran Shinde
o The applicant is currently employed as a Senior Program Manager with Infosys. o The applicant has disclosed that he has served as a secretary and treasurer for the Maharashtra Mandal Bay Area. The application is not clear as to whether the applicant is currently serving in those roles. Participation with this organization does not present any conflicts.
o The information disclosed reveals neither incompatible offices nor apparent conflicts of interest.
Conclusion
The City Council may wish to consider the above comments in making its appointments to the Commission.

COUNCIL PILLAR
Enhance Community Engagement and Transparency
BACKGROUND
At the March 22, 2022 Council meeting, the City Council adopted Ordinance 2043 which modified and established the procedure by which the Bicycle and Pedestrian Advisory Committee (BPAC) membership is appointed. The Committee membership was formerly appointed by the BPAC Committee members, upon final adoption of Ordinance 2043 the procedure has changed to follow the same recruitment/appointment process that the City Clerk’s Office has for all the City Board, Commission, and Committees with the exception that BPAC applicants may either live or work in the City to be eligible to serve.
At the May 23, 2023 Council meeting, the City Council declared three vacancies on the Bicycle and Pedestrian Advisory Committee.
Advertising of the vacancy was done via the City’s website, social media outlets. The City Clerk’s Office also emailed vacancy notification to all parties listed on the email vacancy interest list.
On July 12, 2023 the City Clerk’s Office received an email resignation from Chair Hardy on behalf of Committee Member Lloyd Cha effective immediately.
DISCUSSION
The City Clerk’s Office held a recruitment for four weeks and received no applications by the June 26, 2023 5:00 p.m. application deadline. The City Clerk’s Office extended the recruitment period to July 7, 2023 which yielded six applications. On July 13, 2023 there was an applicant who withdrew from the process leaving a total of 5 applicants in the process.
A past practice has been that upon appointment to fill a vacancy, the City Council may choose to establish an eligibility list with an applicant(s) of their choice for six months should a vacancy arise.
The City Clerk’s Office proceeds with the recruitment/interview process with the following candidates:
1. Ashish Joshi

2. Ken Kratz
3. Betsy Megas
4. James Parissenti
5. Stephen Clark Seninger
Each candidate met the requirement of either being a resident and/or work in the City of Santa Clara and have each submitted proof of residency.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT
There is no additional cost to the City other than administrative staff time and expense.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City’s official-notice bulletin board outside City Hall Council Chambers. A complete agenda packet is available on the City’s website and in the City Clerk’s Office at least 72 hours prior to a Regular Meeting and 24 hours prior to a Special Meeting. A hard copy of any agenda report may be requested by contacting the City Clerk’s Office at (408) 615-2220, email [email protected] <mailto:[email protected]> or at the public information desk at any City of Santa Clara public library.

That subcomrrittee needs to imestigate more c001eeti\ity to infamatioo about cycling and pedestrian infrastructure and programs in the Oty. (f) Because youths are roe of our our city's largest cycling and pedestrian p:)piiation, the Safe Routes to Schad program. a pn:;gan1 that educates youth aoout safely \\61king and cycling to schcd, shoud be continued. We need to reV.eN the effic.acy of that poJfafTI by pericdically rei.ie.,ing the crash statistics for those age goops, if Mlable, frcm the police department I \•.cold suggest this if app:iinted to Sel\e on the committee. (g) AnolherDq'ectiva I v.ou!d 00 \\a'king ta.vard as a member of the coolffiittee is to identify other proJraf'llS to assist cyclists. The BPACshould recorrrnend Ulat the Oty continue to apply to the Bicyde Frierdy Prcgram offered b-J the League of American Bicyclists (LAB). BPAC needs to continually assess our currefil facilities and programs, as \\ell as ex,jcre ne€ded impro\ements identified b-J the LAB. I 1\0.id like to attain the next le\€1 in that LAB program, the Silw rating.
(h) To assist the City staff in lmestigating ard applying for p-tjects and prcgrams. the LAB suggests and I \\ill cootinue to advx-ate for a fiJI lime bicycle and pedestrian coordinator to be hired by the Oty. The coordinator can be the scle staff member assisting the BPAC and can UjXlate the bicycle and pedestrian ,jans, thus sa\/ng the Qty money.
The COO"dinator can also, as existing staff do oo.v, Muate our present cycling and pedestrian infrastructure and prq;rams and imestigate fundng sources, particularly g<)\errnnent funding sources, that allo.v a v.ide latitude in the sccpe of p<qXt.Sed projects. This acli\Hy could imd1.e ga,,envn-eflt grants, pul::Jic/pti\ete partrwships, ar.d taxing strategies in order to accm1Jjish committee goals more quickly.
M Lastly, another objective I \',OOd be \1.00<ing to.-.erd as a member of the cocrmittee is to prq.x)Se mere funding sources be pursued to pay fcr prcgrarns and ~ects that sur:p:::rt cycling aOO pedestrians in the city. In addition to the co;;oing go\efnrnent grant aps:'ications, I \',ould suggest the committee explore additional sources of liJrlding for appD\9J by the C.OUncil such as increasing taxes includng forming special assessment districts.
Any other infonnatlon which you feel would be u~ful to the City Council in reviewing your application:
My conrnunity inv::hement:
Attendance at CSC BPAC meetings: I attend Oty ct Santa Oara Bicyde and Pedestrian Ad\isOI)' C.ornmittee m::etings regularly and pt>\ide input as a member of the generaJ put)ic and as a member of tv.o of their subcommittees, Roundaboots and Bike to Shop Day. I also attend many of the BPACs field meelings orgarized b-j Oty staff that are open to memb€rs of lhe ccrnmittee and the gereral put:lic.
Past member of the CSCBPAC: As a past mesrbE<of Oty of Santa Oara BPAC, I suggested that BPAC reoonmend lhe Oty Oxincil send a letter to the Santa Oata Valley WaterC\strict to sa\e the poi:,Jar Intel pedestrian bridge ow the San Too,as Aquino Qeek that con~ts the Intel property \•.ith the San Tcmas Aquino Oeek Trail. lhe bridge w:1s s3\ro.
Bike to Wak e\eflt: I hclped al se\.efal Oty of Santa dara Bike to Work/Where.er Day e-.ents. Not only h8\e I staffed the table to help distribute pranotimal items but also I made minor repairs to commuters' bicydes v.tiffl needed. That ex.perien:::e has led me to think aboot additional San TonlaS Aquino Creek Trail erihancanents that the BPAC may \\0nt to consider, such as repair statims, repair statico shelters, rr,are drinking fountains, restrooms, benches, and more pedestrian bridges to connect businesses en the east side of the creek to the trail.
Major Taylor O;cling Oub: From 1994 to :!ill?, I organized and \Olunteered at a poi:,Jar c-Ol'>-jlrO\it, 501(cX3) bicycle repair clinic, the Majcr Taylor O;cling Oub of East Palo Alto. I was the secreta,y, repair clinic supe!\isor, and a mechanic fcr the orgarization for thirteen yeais. Unfortunataly the club has closed. Toe club operated a tv,ice-monthly bicycle repair cliric for the youth of that city at no charge to the participants; O\€f foor thcosand (4,000) participants atteoded du,ing that pe,i(:d.
Oub menlbefs, aJI VJ!unteers, assisted youths in the repair and maintenance of their ticydes and taught ricing skills. Repairs \i,ere accompished by reusing bicyde parts from saheged bicycles that \\ere headed fcr the durrp.
I helped de\elop and a,.asc.r,,,, al! prcgrams and operations including donaticns, repair clinic, bicycle rodeo and an Cam a Bike~ program, and I ccnstructed all the necessa,y infrastructure to sllfJIX)rt the prcgrarns, such as tat:les, tethered tOOs, tro carts, and slcrage facilities. I also prO\ided free lunches to the~ and youth \Clunteers, Toe club also attended and helped at bicycle rodeos and parades sp::osored b-j the Oty of East Palo Alto. lhe club attended and prO'Jded logistic,,! support lcr a bicycle reuse ewnt sp::osored b-J the O:lurly of San Mateo.
O..irclub's achie.ements \'.ere recognized by the Oty c.ouncil of the Oty of East Palo Nto and the County of San Mateo Board of Supef\iscrs, in large part due to ourpuJding senices not Mlable in the p-i\0te sectcr. Since that time, other organiza!ims haw imitated this model in other locations around the South Bay Area.

Please state reasons why you want to become a member of this Board/Commission/Committee, including what specific objectives you would be working toward as a member of this advisory board:
I have, during my 35 year career in the City's Engineering Dept., been responsible for the construction of most of the City's bike facilities, including almost all of the San Tomas Aquino Creek Trail and miles of painted bikeways. I was also responsible for pedestrian improvements such as huge lengths of sidewalk and countless ramps and driveways.
In a typical year I ride my bike about 3000 miles mostly from and to my house in town and extending throughout the South Bay.
It is intent to bring this experience, both experience on the bike and that gained with the "real world" challenges of building public improvements, to the BPAC.
