The Consolidated Appropriations Act, 2022 (Public Law 117-103) appropriatesa total of $2,444,927,823 for HighwayInfrastructure Programs (HIP) fromthe General Fund of the Treasury for fiscal year (FY) 2022. Of such amount, $846,927,823 is set asidefor “Community Project Funding / Congressionally Directed Spending.” The project descriptions for the309 projects can be found in the “Community Project Funding / Congressionally Directed Spending” tablein the Joint Explanatory Statement incorporated by reference in Division Lof theConsolidated Appropriations Act, 2022. State departments of transportation (DOTs) are the recipients for 307 projects totaling $845,719,823 and the Office of Federal Lands Highway (FLH) was allotted funding for two Gila River Indian Community projects totaling $1,208,000. These funds arein addition to any other funds, including contract authority, provided in FY 2022.
With this memorandum, weare allocating $845,719,823 for 307 projects to the States, as indicated in the attachment to this memorandum, to beadministered in theFiscal ManagementInformation System (FMIS) (FMIS program codeY928; DELPHIfund value 1550574B50 050). This funding is not subject to any obligation limitation that applies to Federal-aid contract authority.
Thesefunds remain availablefor obligation through September 30, 2025. Any such amounts not obligated on or before September 30, 2025, shall expire. Once the period for obligation has expired, these funds will only remain availablefor adjusting and liquidating obligations as authorized inaccordance with title 31, United States Code (U.S.C.), section 1553.

Obligatedearmarkbalancesareavailableforexpensesproperlychargedtotheaccountand incurreduntilSeptember30,2030. Afterthatdate,anyunexpendedbalancesofobligated earmarkfundsshallbecancelledinaccordancewith31U.S.C.1552andshallnolongerbe availableforobligationorexpenditure.
DemoIDshavebeenassignedforeachprojecttoproperlytrackthesefundstoensurethat theyareonlyobligatedandexpendedforthespecificprojectforwhichtheyweredesignated. EachprojecthasbeenassignedauniqueDemoIDthatlinksthefundingtothespecific projectdescriptionaslistedintheJointExplanatoryStatementaccompanyingthe ConsolidatedAppropriationsAct,2022. Sincetheprojectdescriptiondefinesthescopeof workonwhichthefundsmaybelegallyexpended,thefundingfortheprojectcanonlybe utilizedfortheactivitieswithinthescopeandphysicallimitsoftheprojectasdefinedbythe projectdescription. TheDemoIDsunderwhichthesefundsarebeingdistributedarealso includedintheattachmenttothismemorandum.
Exceptasotherwiseprovided,thesefundsaretobeadministeredasifapportionedunder chapter1oftitle23,U.S.C. Therefore,theseprojectsaretobeadministeredastitle23 projectsinaccordancewiththeapplicablestatutoryandregulatoryprovisionscontainedin title23,U.S.C.andCodeofFederalRegulations(CFR),aswellasotherapplicableFederal requirements,suchastheNationalEnvironmentalPolicyAct(42U.S.C.4321,etseq.)and theDisadvantagedBusinessEnterpriseProgram. TheState,throughitsDOTinaccordance with23U.S.C.302,isthedirectrecipientofthesefundsandisresponsibleforadministration ofthesefunds. IftheStateDOTactsasapass-throughentityofFederalassistance,theState DOTmaintainsthepassthroughresponsibilitiesspecifiedin2CFR200.332.1 TheFederalsharefortheseStateprojectsisgovernedby23U.S.C.120,asamendedbythe InfrastructureInvestmentandJobsAct(IIJA)(PublicLaw117-58,alsoknownasthe “BipartisanInfrastructureLaw”)(BIL). Itisgenerally80percent(See23U.S.C.120(b)). TheFederalshareforprojectsontheInterstateSystemis90percentunlesstheprojectadds lanesthatarenothigh-occupancy-vehicleorauxiliarylanes(See23U.S.C.120(a)). For projectsthataddsingleoccupancyvehiclecapacity,thatportionoftheprojectwillrevertto the80percentlevel. AnupwardslidingscaleadjustmentisavailabletoStateshavingpublic lands(SlidingScaleRatesInPublicLandStates). StatesmayusealowerFederalshareon Federal-aidprojectsasprovidedin23U.S.C.120(h). Thesefundsmaynotbeusedasthe non-FederalmatchforotherFederalprogramsunlessthereisspecificstatutoryauthority(2 CFR200.306(b)(5)). TheConsolidatedAppropriationsAct,2022,doesnotprovideauthority foruseofthesefundsasanon-FederalmatchforotherFederalprograms,includingFederal- aidprogramsundertitle23,U.S.C.
