Subject: Recommendation for Augmentation of Budget for Levi’s Stadium Cooling Towers Project
Recommendation
1. Recommend a budget augmentation for the Levi’s Stadium Cooling Towers Project (Project) in the amount of $6,952.90, increasing the maximum compensation from $129,085 to $136,037.90 to complete the Project.
2. Authorize Stadium Manager to execute any and all documents associated with, and necessary for the award, completion, and acceptance of this Project.
3. Authorize Stadium Manager to execute Contract Change Order No. 1 with a not to exceed amount of $16,989.
4. Authorize Stadium Manager to execute change orders up to 10% of the Project cost or $1,698 for a total not to exceed construction contract amount of $136,037.90.
Solicitation Process
On December 6, 2022, the Santa Clara Stadium Authority (SCSA) approved the Forty Niners Stadium Management Company’s (Stadium Manager) recommendation to award an agreement to United Mechanical, Inc., in the amount of $117,350, to replace the internal parts and systems for the cooling towers at Levi’s Stadium. The SCSA Board also approved a 10% contingency amount of $11,735 to execute change orders for a total not to exceed construction contract amount of $129,085.
Stadium Manager has a need to issue Contract Change Order No. 1 in the amount of $16,989 to complete the work. This amount exceeds the amount authorized by the Board and therefore Stadium Manager is recommending a budget augmentation to cover the difference including a 10% contingency amount to issue an additional change order if required to complete the Project.
Stadium Manager is recommending a budget augmentation to address the following costs for this Project:
1. United Mechanical, Inc. Bid - $117,350

3. Total amount approved by the SCSA Board on December 6, 2022 is $129,085
4. Proposed Change Order No. 1 Amount - $16,989
5. Contingency 10% of Change Order No. 1 Amount - $1,698.90
6. Total Amount Needed - $18,687.90
7. Difference is 6,952.90
Once Stadium Manager receives approval from the SCSA Board, the Contract Change Order No. 1 will be executed with United Mechanical, Inc., and a fully executed copy will be forwarded to the SCSA. In addition, Stadium Manager requests authorization to issue change orders up to $1,698.90 or 10% of the project cost which will allow Stadium Manager to take timely administrative action if required and not delay completion of the Project.
