REPORT TO GOVERNANCE AND ETHICS COMMITTEE
SUBJECT
Action on the Santa Clara Police Department’s Recommendation to Name the Police Building’s Motorcycle Garage the “Pete Malae Traffic Unit Motorcycle Garage”
COUNCIL PILLAR
Deliver and Enhance High Quality Efficient Services and Infrastructure
BACKGROUND
The Police Building complex on El Camino Real includes an ancillary building that houses Records Unit retention, a Bicycle Unit garage, the Traffic Unit’s Motorcycle Garage, Special Response Team equipment, and employee fitness facilities.
The Traffic Unit (Motorcycle Unit) is part of the Field Operations Division. The primary goal of the Traffic Unit is to reduce injury collisions through engineering, education, and enforcement. This is achieved by enforcing traffic laws, responding to collisions, and investigating major injury accidents and fatalities. Community Services Officers in this Unit are responsible for the enforcement of parking violations. This team works closely with the City's Department of Public Works’ Traffic Engineering Division to solve traffic issues in the City.
Retired Police Officer Peter “Pete” Malae Sr. worked for the City from January 1977 through August 2003 and was instrumental in the development of the Department’s Traffic Unit and was the inaugural motorcycle officer in 1979. Pete was the lead trainer for new riders for the majority of his career and spent 25 unprecedented years as a motorcycle officer. He also utilized his military training to create the framework for the Department’s SWAT team (currently referred to as the Special Response Team) and was the first “E-1” (Entry leader). Many of his officer safety teachings continue to be utilized in both units.
Prior to joining the Police Department, Pete enlisted in the Army in 1965 and was assigned to Company C, 1st Battalion (Airborne), 503d Infantry Regiment, 173rd Airborne Brigade, a Special Warfare Unit. From 1966 through 1968, Specialist Malae served in Vietnam. His courageous actions and heroism earned him a Silver Star with Valor, two Bronze Stars with Valor, and a third Bronze Star.
Following his service, he played football for Westfield College in Coalinga before being recruited by Bill McPherson to play football for Santa Clara University.
DISCUSSION
In accordance with Council Policy 035 (“Naming of Facilities”) (Attachment 1), the Governance and Ethics Committee is being asked to consider naming the Police Building’s Motorcycle Garage in honor of retired Police Officer, Peter “Pete” Malae Sr. Pete spent his career serving the Police City of Santa Clara Printed on 11/30/2023Page 1 of 2

Department and had a tremendous impact on the development and implementation of the Traffic Unit.
With a recommendation from the Governance and Ethics Committee, the full Council will consider this item in the near future. Should it be approved, the family will be notified, and a sign will be ordered. The Department will conduct an unveiling ceremony with the family and current and former employees, at a future date.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment.
FISCAL IMPACT
There is no fiscal impact for the current action.
If the Council subsequently approves naming of the Motorcycle Garage in Pete Malae’s honor, the Police Department would utilize federal Asset Forfeiture Funds to purchase one sign for the entrance of the Motorcycle Garage. A pending Report to the City Council will further highlight the equitable sharing amount the Police Department intends to receive via Asset Forfeiture Funds as well as the intended uses of the funds.
COORDINATION
This report was coordinated with the City Manager’s Office and the Mayor and Council Offices.

REPORT TO GOVERNANCE AND ETHICS COMMITTEE
SUBJECT
Review Council Policy and Procedure 007 (“Citizen Complaints Addressed to the City Council”) and Approve Amended Policy (“Constituent Complaints Addressed to the City Council”)
BACKGROUND
At the March 13, 2023 Governance and Ethics Committee, the Committee approved as part of the workplan to review and update the Policy and Procedure 007 (“Citizen Complaints Addressed to the City Council”) (Attachment 1). As background, the Policy and Procedure 007 was last revised in April 1992 and set forth a procedure on handling citizen complaints addressed to the City Council.
DISCUSSION
The City team continues our commitment to provide excellent constituent service to members of the public. At this time, constituent requests received by City Councilmembers are submitted in various channels to staff in the City Manager’s Office and the Mayor and Council Offices.
To streamline communication protocols in place, Council Policy 007 provides a general framework on the handling of constituent requests. The primary goal of this policy is to provide exceptional service to constituents and provide support to the City Council on issues that may arise in Councilmembers’ interactions with the public.
In the effort to align the policy with the City Charter that provides for the City Manager to guide and direct staff, revisions to the Policy provide general guidance on the process for addressing: (1) Constituent Requests for Service, (2) Constituent Operational and Policy Interpretation Questions, and (3) Constituent Legal Inquiries.
Additionally, a reference copy of the current memorandum from the City Manager on City Council Inquiries and Requests to Staff is attached to this report (Attachment 2). The memorandum offers guidance on how members of the City Council should submit requests and constituent inquiries to City staff. As noted in the document, the memorandum will be periodically reissued when staff members or assignments change.
At the December 4, 2023 Governance and Ethics Committee, Committee members may bring forward additional feedback and discussion on the current policy. Given the substantive changes to the revised policy, staff has included the current policy (Attachment 1) and the proposed amended policy (Attachment 3). If the amendments are approved by the Governance and Ethics Committee, staff will forward the revised policy and a resolution to the full City Council for their consideration and approval at a future Council meeting.

CITIZEN COMPLAINTS ADDRESSED TO CITY COUNCIL
POLICY
PROCEDURE
The Mayor/Council Offices may receive complaints from citizens either over the phone, in person, or in writing.
When a complaint is received over the phone or in person, the Executive Assistant to the Mayor and City Council will attempt to direct the caller to the appropriate City department for resolution of the complaint. If the caller has tried unsuccessfully to resolve the matter with the appropriate department or does not wish to deal with the department directly, the Executive Assistant will type the complaint information in memo form and refer the memo to the City Manager for investigation and response to the citizen. If the citizen has requested that Council be informed of the complaint, copies of the memo will be distributed to Council members.
Written complaints are forwarded to the City Manager for follow -up, and copies of the complaint are given to the Council members.
If a Council member receives a citizen complaint directly, in person or by a phone call, the Council member should re lay the information to the City Manager for follow -up. The City Manager will investigate the complaint and respond to the citizen on the Council member’s behalf or will draft a letter for the Council member’s signature, if that is preferred. All complainant information is kept confidential.
1. When the City Manager receives a memo from the Executive Assistant regarding a citizen complaint or receives a written complaint to Council from the Executive Assistant, the City Manager will assign the complai nt to the appropriate Department Head or to the City Manager’s staff, requesting a report for the City Manager’s review and follow-up.
2. At the same time, the City Manager will send a letter to the citizen, explaining that the citizen’s concern has been referred to the City Manager and that the City Manager will investigate the concern and respond back to the citizen.
3. After investigation of the complaint, a response letter will be sent to the citizen by the City Manager. A response will be remitted within two weeks time, if possible, or a follow-up letter will be sent to the citizen explaining the delay.

Many of the above email addresses are general distribution accounts because multiple staff monitor inquiries and the use of distribution accounts ensures that support is provided when specific employees are on vacation and during routine absences. Additionally, staff uses an internal software system to track Councilmember requests/inquiries. This allows staff and management to ensure that responses are provided, and follow-up is conducted for complex requests when a response cannot be immediately provided.
Further, Councilmembers can and should refer constituents to the MySantaClara application, where they can submit their City service requests directly. Often, a direct submission by a resident or business through the MySantaClara application is received by the staff member in charge of the service faster than if a Councilmember submits it. A general service request submitted by a Councilmember on behalf of a constituent adds additional steps and can involve follow-up communications with the Councilmember to clarify the request.
Response to Constituent Matters Submitted by Councilmembers Staff will strive to acknowledge all emailed inquiries within 48 hours or sooner (business days).
Staff will also send a confirmation to the requesting Councilmember when a constituent inquiry has been completed. When it is appropriate to provide the Councilmember with a summary of the response that will be done. However, please know that in some cases it may not be appropriate to communicate the specific details of a constituent response to Councilmembers.
For example, when a member of the public contacts a Councilmember on any given topic such as a code enforcement issue (e.g. fence issues, tree issues, signage), traffic sign safety issues, RV parking, utility billing, etc., and the Councilmember forwards the request to staff, staff will confirm receipt with the Councilmember and add the issue to our internal tracking system. Staff will then work directly with the constituent to resolve the issue without a copy to the City Council Inquiries and Requests to Staff
November 29, 2023
Councilmember. However, staff will acknowledge the Councilmember's request and inform the Councilmember when the matter has been addressed.
Councilmember Inquiries to the City Manager and Executive Staff It is the role of the City Manager to ensure that the organization’s resources are aligned to the workload. To that end, it is important that City Council inquiries or policy matters which may entail a greater amount of staff resources be directed to the City Manager, usually via Council Meetings or Priority Setting Sessions. There are however cases where Councilmembers may have questions or inquiries that can be addressed quickly. While some City Managers request that Councilmembers do not contact Department Directors and other executive staff, I understand that occasionally these types of brief requests for information are needed and, at times, I may not be immediately available. In those instances, I am comfortable with Councilmembers e-mailing Department Directors or other executive staff (Chief Operating Officer and Assistant City Managers). I ask that you be mindful of what I have referred to as a “10-minute Rule”. This means that if a Councilmember request is brief in nature and will not require staff resources beyond ≈10 minutes, it is appropriate for the Councilmember to contact an executive staff person (by e-mail). I ask that you also please copy me directly on such requests. To the extent that the workload of such requests does not interfere with the regular duties of executive staff, I intend to maintain this practice.
Request/Inquiries of Other Staff
Please refrain from contacting staff not listed in this memorandum on City or Stadium Authority business items. The guidelines detailed in this memorandum will not only assist me to ensure proper resource allocation but they will also help prevent any perception of councilmanic interference, as referenced in the City of Santa Clara Charter §807.
I would be remiss if I also did not mention that our staff that sit in the Mayor and Council Division of the City Manager’s Office are always there to assist and serve the City Council. They do their best to balance their assigned workload while also trying to be responsive to Councilmembers who may be in the office and have questions.
In closing, thank you in advance for your efforts to ensure streamlined and effective City Council communication with staff. Feel free to reach out to me with any questions or feedback.
This memorandum will be periodically reissued when staff members or assignments change. A copy of the latest version will also be available upon request or by emailing [email protected].

SUBJECT
Review Meeting Management Procedures
BACKGROUND
At the August 17, 2021 mid-year check-in on City Council Priorities session, the City Council developed procedures for meeting management. The session facilitator introduced a segment on meeting management procedures and norms, including a review of Robert’s Rules of Order. The Council determined that it was in the best interest of the City to promote Council meeting efficiency by adopting a set of meeting procedures governing the process by which Council would conduct its discussion of agenda items.
At this session, the City Attorney’s Office was to return to Council with a resolution on the meeting management procedure. The City Council also agreed to use this process for a period of approximately six months, and to revisit the topic at the 2022 Council Priority Setting session. Due to staff departures and transitions, the draft resolution (Attachment 1) did not return to a Council meeting and the item was not heard at the 2022 Council Priority Setting session held on February 8, 2022.
As a result, the City Council has been using these procedures in practice since the 2021 Priority Setting Session. During the March 13, 2023 Governance and Ethics Committee meeting, the Committee approved, as part of the workplan, to bring forth the current meeting management protocols for review and discussion.
At this December 4, 2023 meeting, the Governance and Ethics Committee shall review and discuss the current meeting management procedures, subject to any further amendments it may agree to, and recommend to the full Council for consideration and approval of a resolution formalizing the procedure.
DISCUSSION
As noted above, since the establishment of the meeting management procedures, the City has continued to use the established procedures as set forth below when discussing agenda items. At the August 17, 2021, City Council Priority Session check-in session, a motion was passed by the City Council to utilize the following procedure for a period of approximately six months, which has extended to the present day.
Current Procedure
Each item on a Council and/or Authorities agenda shall be heard and discussed in accordance with City of Santa Clara Printed on 11/30/2023Page 1 of 6
powered by Legistar™
23-1264 Agenda Date: 12/4/2023
the following procedure:
1. City staff provides a report on the item, if warranted;
2. Each Councilmember shall have the opportunity to ask their questions;
3. City staff shall, to the extent possible, provide a response to all Councilmember questions;
4. The public shall have the opportunity to provide public comment on the item;
5. At the Mayor’s request, City staff shall, to the extent possible, provide responses to the comments or questions from the public;
6. A Councilmember shall then make a motion and the motion should be seconded by another Councilmember;
7. Each Councilmember who wishes to speak to the motion (during the deliberation portion of the meeting) shall then have the opportunity to make statements regarding the motion; and
8. A vote shall then be taken.
Options to Consider
Option 1:
The Committee may consider continuing the use of the current procedure in place and direct staff to formalize the procedures with a formal Resolution for Meeting Management and bring forth to the City Council for approval.
Option 2:
The Committee may consider revising the current procedure in one or more ways. Below are some areas for possible further consideration by the Committee. Some of these rules are consistent with current Council practices, but have not been formalized.
1. Establishing Time Limits and/or Limits on the Number of Times each Councilmember speaks on Items: This could help focus remarks and ensure all have an equal opportunity to speak.
· On the other hand, specific time limits and/or limits on the number of times a member is allowed to speak may negatively impact Council deliberations and information/idea sharing on important policy matters. Continuing to rely on the powers of the meeting’s Chair to guide the City Council’s discussions in a timely manner is an effective strategy that is used in many (if not most) jurisdictions.
2. Consent for Extended Comments: Councilmembers seeking to make extended comments may request consent from the Chair or the Council to allow extended speaking time. This can be utilized if the City Council elects to set time limits (as outlined in Option 1) or without time limits and requested if the Chair seeks to limit discussion/questions.
3. Add a Provision for Discussions Prior to the Making of a Motion: Council could consider the formal addition of a Council “discussions” step prior to the making of a motion. This is generally consistent with existing practices and can, particularly for more significant matters, facilitate the making of constructive motions that take into account the collective thoughts of the Council. As per standards, the Presiding Officer would manage this process with all Councilmembers given an opportunity to speak.

23-1264 Agenda Date: 12/4/2023
4. Addressing the Chair: Councilmembers should address comments to the Chair (as the Presiding Officer), not directly to other members to assist with maintaining order and civility.
5. Minimize Repeating Points: Councilmembers should avoid extended restatements of points already made by others to keep discussions efficient. The Chair will preside over these matters and may minimize repeated remarks.
6. Respectful Language: Maintain a professional and respectful tone during discussions and avoid personal attacks or disrespectful language based on the City Code of Ethics and Values Behavioral Standards for Councilmembers (Attachment 2).
7. Focus on Agenda Items: Comments should relate directly to the agenda items being discussed and off-topic discussions may be redirected by the Chair.
8. No Interruptions: Allow each member to speak without interruption.
9. Enforcement: As the Chair of the meeting, the Presiding Officer may raise points of order to address violations of meeting rules, with a right for an appeal from the majority of the Council.
Questions regarding applicable rules or questions of interpretation may be presented to the City Attorney for advice.
Option 3:
In addition, the Committee may consider directing staff to consider the options to replace the current Robert’s Rules of Order with Rosenberg’s Rules of Order. Rosenberg’s Rules of Order is a simplified set of parliamentary rules used in several cities throughout California. Many institutions have adopted Rosenberg’s Rules in lieu of Robert’s Rules, by finding them practical, logical, simple, easy to learn and user-friendly, while retaining the basic tenets of order.
If the Committee is interested in this option, the staff will prepare to present a comparison of Robert’s Rules of Order vs. Rosenberg’s Rules of Order at a future Governance and Ethics Committee meeting.
Benchmarking:
As background, below are excerpts from procedures being utilized by neighboring cities in relation to meeting management.

PROGRAM IN ETHICS & VALUES
BEHAVIORAL STANDARDS FOR CITY COUNCIL MEMBERS 1
INTRODUCTION
Ten years ago, the City of Santa Clara began its ethics and values program to foster public trust by promoting and maintaining the highest standards of personal and professional conduct. Since the adoption of the Code of Ethics & Values in 2000, the City Council has promised the people of Santa Clara that Council Members, all elected and appointed officials, candidates for public office, and City Staff will meet the most demanding ethical standards and demonstrate the highest levels of achievement in practicing eight core values identified in the Code.
Those values, which are fundamental to public trust, were adopted to guide the decisions and actions of individual Council Members and the Council as a whole.
City Council and City Staff have worked hard to integrate these values into the everyday operating culture of City Hall. The City has conducted extensive outreach to residents encouraging them to hold public officials accountable at the ballot box for being credible role models for these values, in word and in deed, in public or in private.
To help the Council make these values real in their regular work with the City, the Code describes for each value a basic set of character traits and actions residents can expect to see Council Members meet and exceed.
This document translates these traits and actions into concrete behavioral standards for the City Council. These standards describe what impeccable leadership ethics looks like in the everyday work of the Council. They reflect commonly accepted “best practices,” rather than specific issues or problems the Council has faced. The list seeks to include enough positive behaviors to practice (and negative behaviors to avoid) that a reasonable person can assess how credible he or she is as a role model and ethical leader.
This information is presented in four columns. Columns 1 and 2 reproduce the approved Code of Ethics. Columns 3 and 4 list the behavioral standards.
1 This document is based on the Behavioral Standards for Commissioners, Boards, and Other Appointed Officials, developed during 2000-2002, and approved by the City Council in February 2003. A representative committee of Board Members and Commissioners, working with the City’s initial Ethics Ordinance Committee, drafted that document. It was then revised based on extensive feedback from all Board Members, Commissioners, and Staff Liaisons. In a working session in April, 2008, the Council used that docume t to develop the fi rst draft of its own standards. The City’s Ethics Consultant, Dr. Tom Shanks, and City Staff drafted the final version for City Council review on May 6. 2008. n
Approved by City Council on May 20, 2008.
