Pattern of Abusive History
• One member on this city council, Councilmember Watanabe does not say hello or communicate to any councilmember besides the Mayor. She avoids pictures with us, has outbursts like in closed session and just recently last week with anothe Councilmember. She never acknowledges me however she shows up to my hearings with her gang ot bullies. I have asked her repeatedly why show up to my nearing if you pretend I don't exist. It is simple, it is harassing and bully behavior • Mayor Gillmor & Councilmember Watanabe Often claim to be attacked when they are indeed attacking or making accusations first.
• The other Way around : Ask any Councilmember about behavior on council from the two I named.
• Where is the discussion of these ethics and behavior of bullying? Where is the special advisor to the mayor or ethics expert Dr. Shanks? 11 Based on the Findings
• To repeat, Facts show I was not threatening, bullying nor abusive • Tip of the iceberg
•
• There is more that needs to be talked about that is not in the findings page, there is more that needs to be talked about that is currently under confidentiality.

Words Matter, Accusations Hurt
• Unlike the Mayor and Councilmember Watanabe who are set in their lives do not need to worry about headlines that mislead people to think bad behavior.
• This affects working class people that don't have a silver spoon and are working age. There is reputation and name recognition in trying to find work. Smearing names like this is wrong.
• Claiming to be a victim when someone stands up to them and wont take their abuse anymore.
• I ask both the Mayor and Councilmember Watanabe, Why did you take it this far when it was far from the extremes you described in public? Was it election advantage? Hate?
13 Reasons for Releasing
• Full Report is more specific and detailed, more to the story. Findings only tells half the story. The full report debunks continuing false narratives. • Explains police presence.
• Does it set a precedent? Short answer is no, Long Answer is no, these are public elected officials we are talking about.
• Redact only city employee or former City Employee names • Fulfills full transparency.
• Was already discussed in public on November 1st, 2022 meeting as well as one side has already spoke out in public while the rest of council has to be quiet. • Let the Public Read it and let them compare what was said in public and said in the full report.
• The Public Demand outweighs the privacy.

The Details Matter in the full report.
• I Request that a motion be made for the following
• Immediate release of the full investigative report, no delays. • No redactions. Only redactions should be for City of Santa Clara Employee Names not members of the City Council.

Congratulations, Santa Clara, you're the 49ers'

San Francisco 49ers players participate in drills during training camp at the practice fields at Levi's Stadium in Santa Clara, Calif., on Tuesday, Aug. 23, 2022.
Ethan Swope, Staff / The Chronicle
Congratulations, Santa Clara. You've been known for a lot in your rich 245-year history. You are the site of a historic mission, host a fine university, have provided fertile soil for first agriculture and then tech, and have borne witness to many kids' first upside-down roller-coaster ride.
But now? Now, you're a company town. Bought and paid for by Jed York and the San Francisco 49ers.
• Grand Jury report: City Council majority put 49ers' interests ahead of Santa Clara's.

The travesty of a City Council "vote" Tuesday night was the epitome of a slimy backroom deal. Tasked with the job of considering the 49ers' self-proclaimed "best and final" offer to settle multimillion-dollar lawsuits with the city of Santa Clara, the farce of a meeting devolved into name-calling and threats and ended with little transparency for the public. And, ultimately, probably far less money than the public had coming.
In the public portion of the meeting, pro-49ers talking points were read, The Chronicle was vilified for daring to report on public transactions, some citizens expressed concerns about rushing to settlement, and the four pro-49ers council members in attendance voted down an independent analysis and public discussion of the deal.
More From Ann Killion
Why Jimmy Garoppolo's 49ers return is awkward, strange and wonderful Between BYU and the Bills, why does sports make doing the right thing so hard?
Once the meeting went behind closed doors, the two members of the council who routinely push back on the 49ers walked out of the rancorous environment and police were called (yes, really!). The four remaining council members are all part of the "49ers Five," including one of two members who are under investigation for ethics violations involving the 49ers and had been asked to recuse themselves.
When the backroom dealings were over, the interim city attorney — also put in place by the pro-49ers faction after it fired the city attorney — told the public and the media there was "no reportable action." But on Wednesday morning — voila! - an agreement to the 49ers' proposal was announced. How especially opaque.

Article continues below this ad
The settlement itself is questionable. A Chronicle analysis shows that it was a bad deal: the offer was in actuality about 10% of what the 49ers claimed. However, if a settlement wasn't reached, the case was set to go to mediation, which the 49ers really didn't want, lest a mediator rule against the team on the slate of lawsuits.
What's happening in Santa Clara is a microcosm of politics in America. The powerful and wealthy outspend and outmuscle until they get what they want. They fear transparency. They flood the market with misinformation and duplicitous advertising as a way of bulldozing a path to more profit and less oversight.
That's the Santa Clara 49ers.
In 2020, York poured $2.9 million into the City Council race to get a team-friendly majority on the council, an absurd figure for local politics in a city of 127,000. Now, he's getting what he bought: complete and total fealty.
The 49ers created a misleading organization called Santa Clara Now — trying to make it look like an independent civic entity — and flooded Facebook with pro- settlement ads, claiming their deal would save the city millions, bring in millions and "defend concerts" and live events at the stadium. They ran ads vilifying their archenemy (and top 49ers critic), Mayor Lisa Gillmor. The ads were too egregious even for Facebook (yes, really!) and the social-media platform pulled them as being against their advertising policy until the 49ers agreed to add a disclosure as to who was funding the ads.
Yet, with apparently a straight face, York recently told the Athletic's Tim Kawakami on his podcast, "We're going to continue to be a good community partner." Santa Clara has been Exhibit A in why it is a bad idea for a smallish city to get in bed with the NFL. And why stadium deals can go so very wrong for municipalities and their citizens.
When the 49ers decided to move to Santa Clara, I worked for the San Jose Mercury News and was one of the very few at that outlet to voice skepticism that such a deal was a good idea. When the city ceded control of the stadium to the 49ers as part of the agreement, the seeds of subsequent disaster were planted.
So now what? Now that Santa Clara has settled lawsuits for what one independent analyst described as "funny money," what can the public do? You can be certain the 49ers will come wanting more. They'Il want those disputed youth soccer fields. They'll go after a reduction in rent. They will continue to refuse to open their books to independent auditors.
Gillmor is running for mayor against pro-49ers council member Anthony Becker.
Becker and Gillmor sparred verbally during the public part of Tuesday's meeting and, according to Gillmor and council member Kathy Watanabe, Becker's behavior became more erratic in the closed session. According to Gillmor and Watanabe, Becker screamed "F- you" at Watanabe, flipped off the women and continued to verbally accost them until they both left the room and the police were called.
So, yeah, Santa Clara citizens, you could vote in November.
Other than that? Put on your 49ers gear and bend the knee when York saunters past. You're a company town now.

49ers, Santa Clara settle lawsuits after mayor calls

The city of Santa Clara agreed to settle its lawsuits with the San Francisco 49ers over management of publicly owned Levi's Stadium, but only after Mayor Lisa Gillmor and another City Council member walked out of a heated closed session Tuesday night — and Gillmor called the police.
The 49ers added $325,000 to their previous settlement offer, bringing the team's cash payment to Santa Clara's general fund to $1.675 million, according to interim City Attorney Steve Ngo. He wrote in an email to the City Council on Wednesday that the agreement was finalized.

When the council emerged from its closed session at which the matter was discussed Tuesday night, Ngo told the public that officials had taken "no reportable action" on the matter. But his email Wednesday said the decision to accept the 49ers' offer was made "consistent with board majority direction" at the closed session the night before.
Ngo's email followed a rancorous closed session. Gillmor and council member Kathy Watanabe, who both have been critical of the team's proposal, said they left the meeting after Council member Anthony Becker, who typically supports the 49ers on stadium-related issues, bullied and cursed them.

"Then he continued verbally assaulting me," Gillmor told The Chronicle on Wednesday. "It just went on and on, to the point I felt so uncomfortable and I wasn't going to take the abuse. So I stood up and left. "I called the police because it was obvious he was having huge anger issues. I'm always very careful if it appears anyone is getting out of control. But he was so emotional and I wanted to protect myself."
Becker, who is running against Gillmor for mayor in the November election, said, "We don't talk about closed-session material" during a brief phone interview Wednesday. Asked whether that included occasions on which the police were called, Becker repeated his comment and hung up.
Gillmor said the incident left her "very shaken."
"The flipping off and the F-bomb took it to another level that was shocking," she said. "I've never seen anything like that."
A Santa Clara police officer arrived and remained at council chambers for the rest of the open session, which proceeded without incident. Gillmor wasn't sure whether she would file a police report, though she plans to file a complaint about Becker with the city's human resources department.
"This was worse than anything I've experienced in my six years on the council," Watanabe said. "I've never felt this uncomfortable."
The feud escalated soon after the closed session began, according to Watanabe and Gillmor, after a brief discussion of the 49ers' settlement offer. Becker then said he was ready to make a motion to vote on the proposal, before the conflict with Watanabe and the mayor prompted them to leave.
If the council took a vote on the 49ers' proposal Tuesday night, it occurred without Watanabe and Gillmor in the room. Council member Raj Chahal also was absent because of a family matter, leaving only four of the seven council members present.
Earlier, Watanabe introduced a motion to debate the team's offer in open session and seek an independent analysis of the terms "in the interest of transparency and public trust." The motion lost 4-2, with Becker, Sudhanshu "Suds" Jain, Karen Hardy and Kevin Park opposed and Gillmor and Watanabe in support.
The 49ers had claimed their offer was worth $13 million in benefits to the city, but a Chronicle analysis found only a fraction of that amount was cash. Most of the $13 million cited by the team was based on assumptions about money the city might save or obtain from other sources if the lawsuits were settled, as The Chronicle previously reported, or funds the city already controls. "My initial reaction was they were using our own money to settle this transaction," Gillmor said after learning of Wednesday's settlement. "Some of the most serious issues, like wage theft, self-dealing and conflict of interest, apparently would be wiped away. I have concerns.
"If this settlement is indeed final, I want the staff to put it on the agenda for next City Council meeting, so we can let the public know exactly what this council accepted and bring some transparency.... I'm very concerned they didn't report the action out of closed session. There's been no explanation, and it lends to a lot more suspicions of a back-room deal."
Ngo, the interim city attorney, did not return a phone call requesting comment.
Rahul Chandhok, the 49ers' spokesperson, also didn't respond to an email.
The central lawsuits in this years-long feud involved the City Council's vote in 2019 to terminate the 49ers' contract to manage the stadium. The team sued to stop the move, and the city countersued.
Then, in the November 2020 election, Becker, Jain and Park were elected to the council with the help of a $2.9 million donation from 49ers CEO Jed York. The reshaped, more 49ers-friendly council majority has since given the team what it sought on several stadium-related issues, public records show.

The City Council Voting Bloc is not holding ManCo (49ers Stadium Management Company) accountable for its financial accounting deficiencies or its inability to hold non-NFL events that create revenue for the City. Neither does it require ManCo representatives or 49ers representatives to attend City Council meetings to explain matters related to the Stadium and its management.
The City and Stadium Authority have recently settled litigation brought by the 49ers. Two members of the City Council Voting Bloc (Raj Chahal and Karen Hardy) who are up for re-election, and one (Anthony Becker) who is challenging the current Mayor (Lisa Gillmor), received almost $750,000 in donations from 49ers PACs within days after the settlement was reached.
The Civil Grand Jury learned that some members of the City Council Voting Bloc have failed to follow City protocol regarding "operational tours" of the Stadium. The Fair Political Practices Commission (FPPC) has opened a case into whether two council members (Raj Chahal and Karen Hardy) violated state law regulating gift limitations related to these operational tours. This conduct potentially violated City policy as well. Not surprisingly, there is no City-level inquiry into these actions because that would require a vote by the City Council, which is ruled by the City Council Voting Bloc whose conduct is at issue.
The former City Attorney and former City Manager raised many of these financial, safety, and ethical concerns to the City Council publicly at City Council meetings. Registered lobbyists with the 49ers informed members of the City Council Voting Bloc that they wanted the City Attorney and City Manager fired. The City Council Voting Bloc obliged, and both the City Manager and City Attorney were fired - leaving City management rudderless and without strong leadership.

In 2019, before the current City Council Voting Bloc was in place, the City Council voted to terminate the contract with ManCo, triggering a lawsuit by the 49ers contesting the termination.
That lawsuit and others were combined by the court, and the parties were directed to attend mediation. Anxious to wrap this up quickly, the 49ers began an almost daily pressure campaign to sway public opinion and force the City to settle the lawsuits, all of which were initiated by the 49ers.
The settlement would enable them to continue managing the Stadium.
A settlement was announced on August 31, 2022, pursuant to which ManCo would continue managing the Stadium and non-NFL events. There are reports of shouting, swearing, offensive hand gestures, and aggression by one of the members of the City Council Voting Bloc (Anthony Becker) during the closed session that occurred the evening prior to the announcement. The police were called, and they remained present for the balance of the Council meeting.
