Architectural Review Findings & Considerations
To approve or deny the architectural review, Council must make findings set forth in City Code.
• Findings have not changed in new zoning ord.
• Findings are subjective (supports neighborhood character & harmonious development, etc.)
• Ok to have subjective findings for single-family residences. (Must be objective for multi-family.)

Santa Clara
The Center of What's Possible
Architectural Review Findings & Considerations
• (1) That any off-street parking areas, screening strips and other facilities and improvements necessary to secure the purpose and intent of this chapter and the general plan of the City are a part of the proposed development. - Compliance with the City's Parking Standards, which are in the Zoning Code • (2) That the design and location of the proposed development and its relation to neighboring developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood, will not unreasonably interfere with the use and enjoyment of neighboring developments, and will not create traffic congestion or hazard.
- The proposed use is a simple expansion of an existing single-family residence and the modifications should have a relatively limited impact on the surrounding neighborhood 12 12

The Center of What's Possible
Architectural Review Findings & Considerations (continued) • (3) That the design and location of the proposed development is such that it is in keeping with the character of the neighborhood and is such as not to be detrimental to the harmonious development contemplated by this chapter and the general plan of the City. - The proposed development should be in conformance to the General Plan and be consistent with the character of the neighborhood.
• (4) That the granting of such approval will not, under the circumstances of the particular case, materially affect adversely the health, comfort or general welfare of persons residing or working in the neighborhood of said development and will not be materially detrimental to the public welfare or injurious to property or improvements in said neighborhood.
13 — The construction will be in compliance with the California Building Code 13 1485 Bellomy Street Rezoning City of

Architectural Review Findings & Considerations (continued) (5) That the proposed development, as set forth in the plans and drawings, is consistent with the set of more detailed policies and criteria for architectural review as approved and updated from time to time by the City Council, which set shall be maintained in the planning division office. The policies and criteria so approved shall be fully effective and operative to the same extent as if written into and made a part of this title.

Quotes from Council Members at 10/10/23 Meeting
"Send back and scale down"
"Make darn sure the neighbors are in "It's just too big." support."
"Scale back by mass and form."
"Listen to the neighborhood."
"Scale to something that fits better."
"The old quad is different and we've

"If you take the planning & HLC votes,

"This is a special neighborhood that "We don't have to do this." we treat differently."

They are currently at less than 36 feet in
interior length, so this is not to code. design standard for a two-car tandem garage.
THE INSTRUCTIONS WERE TO SCALE IT BACK... NOT ADD PARKING.
STILL HAVE TO FOLLOW R1-6L CODE
In addition, they've missed the fact that they still have to follow the standards of R1 zoning. The extra parking space doesn't get them everything they want.
FROM THE ORIGINAL REZONE CONDITIONS OF APPROVAL:
P13. A future addition to the house at 1485 Bellomy Street may be permitted, subject to Architectural Review Approval by the Director of Community Development or by the Architectural Committee, provided the addition does not exceed 500 square feet nor result in a dwelling with more than three potential bedrooms total unless two covered parking spaces are provided; and, provided the addition complies with the development standards of the R1-6L Zoning District.

DENY this proposal...
• Ignored the neighbors from the contract stages & Council's feedback • Made it BIGGER
• Trying to just get around the rules instead
• The 2 car tandem attempt doesn't meet code
• The design is flawed - no egress windows in bedrooms
• They've been given ample opportunities to compromise, and they have shown they don't want to.
Please DENY this project and set the precedent that people need to listen to the feedback they're given before wasting everyone's time going down such a long road.
• This is obviously not the right fit for them to build their home on.
