WHEREAS, Caltrans Service Contract (DRMT) 75LX332, dated April 30, 2018, provides up to $573,750 to the City of Santa Clara (hereinafter referred to as Local Agency) for the installation ofrailroad /highway grade crossing safety improvements in the City of Santa Clara at the grade crossing located at the intersection of Agnew Road and UPRR's tracks, CPUC No. 00lL-41.60 , Federal DOT No . 7499650.
WHEREAS, there have been delays in the coordination of the work between the Local Agency and UPRR to be completed under the project;
WHEREAS, the Local Agency has not yet obtained an order from the California Public Utilities Commission approving the project; and
WHEREAS, a one-year time extension to complete construction and all contract requirements has been requested by UPRR and Local Agency, due to delays in completion of the final plans ; NOW THEREFORE: It is mutually agreed by the paiiies hereto, that all terms and conditions of this Service shall remain in full force and effect, except that the expiration date is hereby extended from November 22, 2020, until December 31, 2021.
IN WITNESS WHEREOF, the parties have duly executed this contract as of the dates shown below with the effective date shown above.

WHEREAS, Amendment No. 1 was extended to the expiration date for Service Contract No. 75LX332 , to December 31, 2021 and Amendment No. 2 will extend the expiration date for Service Contract 75LX332, to June 30, 2023, WHEREAS, there have been delays with cross agency plans review and approval; WHEREAS, the local agency has not yet obtained an order from the California Public Utilities Commission approving the project, WHEREAS, an eighteen (18) month time extens ion to complete construction and all contract requir ements has been requested by the Local Agency, due to delays in comp letion of the final plans; NOW THEREFORE: It is mutually agreed by the parties hereto , that all terms and conditions of this Service Contract No . 75LX332, as amended, shall remain in full force and effect, except that the expiration date is hereby exte nded from December 31, 2021, until June 30, 2023 .

WHEREAS: Cal trans Service Contract (CT) 75LX332, dated April 3, 2018, provides $573,750.00 to the City of Santa Clara for the installation of railroad/highway grade crossing safety improvements in the City of Santa Clara at the grade crossing located at the intersection of Agnew Road and UPRR's tracks, CPUC No.00rL-41.60. Federal DOT No. 749965G.
WHEREAS, Amendments No. I, No. 2 and No. 3 extended the Service Contract through June 30, 2024 and; WHEREAS, Amendment No. 4, The original scope is being modified to include advanced traffic signal preemption as an integrated safety feature thereby requiring at least twenty-four months additional contract time to determine exact changes to scope, schedule, and budget and,
WHEREAS, A Cooperative Work Agreement (CWA Cycle 20 has been approved and the budget authority for the FY I 7/18 funds in the amount shown above are available during the mentioned period and will revert on June 30, 2025.
NOW THEREFORE, that all terms and conditions of Service Contract 75LX332 shall remain in full force and effect except it is mutually agreed by the parties hereto; that the contract expiration date is hereby extended through June 30, 2026.
IN WITNESS WHEREOF, the parties have duly executed this contract as of the dates shown below with the effective date as shown above.
