RESOLUTION NO. 26-9563
A RESOLUTION OF THE CITY OF SANTA CLARA, CALIFORNIA,
DELEGATING AUTHORITY TO THE CITY MANAGER TO
NEGOTIATE AND EXECUTE MUNICIPAL HAZARDOUS
MATERIALS RESPONSE SERVICES AGREEMENTS
WHEREAS, it is the City of Santa Clara’s obligation to provide public safety services within its jurisdictional boundaries, including at Levi’s Stadium; WHEREAS, in order to provide the sufficient number of specialty hazardous materials response personnel, the City may contract with neighboring agencies to provide such services (pursuant to Government Code Sections 55632 and City Charter Section 1108) to work at the Stadium and in surrounding areas on event days;
WHEREAS, generally the form of the agreement with the partnering agency will be a Municipal Hazardous Materials Response Services Agreement wherein the partner agency is providing staff who will be performing services under the umbrella of their home agency ; WHEREAS, currently if the partnering agency agrees to provide personnel at a time when Council is not in session, or the contract cannot be brought to Council for approval prior to the event day for some other reason, the City risks having insufficient public safety staffing for the event; and
WHEREAS, in order to ensure that such timing considerations do not negatively impact the City’s ability to contract for the necessary public safety staffing, the City Council wishes to delegate authority to the City Manager to negotiate and execute Municipal Hazardous Materials Response Services Agreements for public safety services on behalf of the City. //

NOW THEREFORE, BE IT RESOLVED BY THE CITY OF SANTA CLARA AS FOLLOWS:
1. That the City Manager is hereby authorized to negotiate and execute Municipal Hazardous Materials Response Services Agreements on behalf of the City of Santa Clara, in a form approved by the City Attorney's Office, for services performed at or around Levi's Stadium .
2. Effective date. This resolution shall become effective immediately.
