RESOLUTION NO.
A RESOLUTION OF THE CITY OF SANTA CLARA, CALIFORNIA, AUTHORIZING THE ACCEPTANCE OF A CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL (ABC) GRANT AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE THE GRANT AGREEMENT.
WHEREAS, the City Council of the City of Santa Clara desires to undertake a certain project designated as ABC Education Initiative and Enforcement Campaign to curb alcohol-related challenges in the community, to be funded in part from funds made available through the Alcohol Policing Partnership (APP) Program administered by the Department of Alcoholic Beverage Control (ABC); WHEREAS, in accordance with ABC’s APP requirements, the City Council deems it to be in the best interests of the City to formally accept by resolution the grant funds and to authorize the City Manager (or designee) to execute grant-related documents.
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF SANTA CLARA AS FOLLOWS:
That the funds provided by ABC through its APP for the purposes of undertaking the ABC Education Initiative and Enforcement Campaign are hereby accepted; That the City Manager or designee of the City of Santa Clara is authorized to execute on behalf of the City the grant contract with ABC, including any extensions or amendments thereof and any subsequent contract with the State in relation thereto, and other documents as necessary, all in final forms approved by the City Attorney.
Constitutionality, severability. If any section, subsection, sentence, clause, phrase, or word of this resolution is for any reason held by a court of competent jurisdiction to be unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of the resolution. The City of Santa Clara, California, hereby declares that it would have passed this resolution and each section, subsection, sentence, clause, phrase, and word thereof, irrespective of the fact that any one or more section(s), subsection(s), sentence(s), clause(s), phrase(s), or word(s) be declared invalid.
Effective date. This resolution shall become effective immediately.
