NOW THEREFORE, BE IT RESOLVED BY THE CITY OF SANTA CLARA AS FOLLOWS:

That the City Council hereby finds that the above Recitals are true and correct and by this reference makes them a part hereof.

That the City Council hereby finds that the proposed boundary change is a “reorganization” under the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 because it consists of two related changes of organization: (a) detachment of the affected territory from the City of San Jose and (b) concurrent annexation of that territory to the City of Santa Clara.

That the City Council hereby finds that the affected territory consists of approximately 0.94 acre currently located within the City of San Jose, as more particularly described in the legal description attached as Exhibit A and depicted on the map attached as Exhibit B.

That the City Council hereby finds that the proposed reorganization would place the affected territory and the remainder of the proposed University Station development within a single municipal jurisdiction, establish a more logical municipal boundary, facilitate coordinated land-use regulation and development of the property, and allow municipal facilities and services to be provided to the entire development in a coordinated and efficient manner.

That the City Council hereby finds that the affected territory is contiguous to the existing boundaries of the City of Santa Clara. The proposed detachment and annexation would transfer the territory directly from San Jose to Santa Clara without creating an intervening unincorporated area.

That the City Council hereby finds that the proposed annexation would not adversely affect the delivery of services to the subject parcel and that the City can feasibly provide the municipal services to the affected parcel.

That the City Council hereby finds that the annexation would not adversely affect the delivery of necessary services to other properties in the City of Santa Clara.

That the City Council hereby finds that the proposed development and concurrent proposed land use pre-designation are consistent with Santa Clara’s General Plan, and the property is concurrently being prezoned as required by Government Code section 56375(a)(7), and therefore the Project would not enable development or land uses incompatible with other properties in the area.

9. That the City Council hereby finds that the reorganization will promote logical boundaries, efficient service delivery, and orderly development and will not impair San José’s ability to serve its remaining territory.

10. That based on the foregoing, the City Council hereby finds that the proposed annexation is in the public interest and the Council supports the annexation of the 0.94-acre parcel (APN: 230-09-021) into the City of Santa Clara.

11. That the City Council hereby authorizes the City Manager to submit to the Local Agency Formation Commission (LAFCO) of Santa Clara County applications for annexation and detachment of the 0.94-acre parcel (APN: 230-09-021) and for a corresponding amendment to the spheres of influence of the affected cities, and to execute all documentation necessary and take all steps necessary to complete the annexation of the subject parcel.

12. That the City Council hereby directs that upon LAFCO’s recordation of a Certificate of Completion, which is the effective date of annexation of the 0.94-acre parcel (APN: 230-09-021), the City of Santa Clara’s pre-zoning classification and pre-designation classifications shall become effective on the subject parcel and the City of Santa Clara’s zoning map shall be revised accordingly. //
