CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: READING OF ORDINANCE TITLES
DEPARTMENT: Administrative Services
PRESENTER: Mary Cusick

RECOMMENDED ACTION

City Council determine that the titles to all ordinances which appear on this public agenda have been read and waive further reading.

BACKGROUND
Government Code Section 36934 requires that all ordinances be read in full prior to Council taking action on the ordinance. By listing the ordinance title on the Council meeting agenda, Council may determine that the title has been read. In addition, by placing an item on the Consent Calendar to waive further reading of all ordinances whose titles appear on the public agenda, the reading requirement set forth in the Government Code is satisfied once Council approves the Consent Calendar item.

This provides an opportunity to streamline the process and shorten Council meetings and is in compliance with the Government Code regarding the introduction and adoption of ordinances.

ALTERNATIVE ACTION

The City Attorney or City Clerk would read aloud all ordinance titles prior to Council introducing or adopting any ordinance.

FISCAL IMPACT

None by this action.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: FIRST READING OF AN ORDINANCE CONCERNING

COUNCILMEMBER COMPENSATION PER GOVERNMENT CODE
SECTION 36516
DEPARTMENT: City Manager's Office
PRESENTER: Kenneth W. Striplin

RECOMMENDED ACTION

City Council introduce and pass to second reading an ordinance entitled "AN ORDINANCE OF

THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING SECTION 2.04.048 OF THE SANTA CLARITA MUNICIPAL CODE CONCERNING CITY COUNCIL SALARY."

BACKGROUND

Members of the Santa Clarita City Council are compensated monthly by the City of Santa Clarita (City), under specific provisions of state law, for the substantial amount of time and effort they contribute leading our local government. In addition to participating in regular meetings, City Councilmembers represent the City on regional and statewide boards and commissions and organizations. Councilmembers also participate in a wide variety of community events and meet with Constituents on issues of concern to residents of the City.

Government Code Section 36516(a) sets forth basic provisions which allow regular adjustments to the City Council compensation. Government Code Section 36516.5 requires City Council compensation adjustments be adopted by the present City Council to be effective after a future City Council election. The Government Code also provides for Councilmember compensation to be increased up to 5 percent for each calendar year from the effective date of the last salary adjustment.

On January 1, 2021, Councilmember compensation was increased to $2,217.41 per month. This increase was equal to 2.5 percent per year for the calendar years 2017, 2018, 2019, and 2020.

This compensation increase was less than the 5 percent per year allowed by Government Code.

The City Council has not received a salary adjustment since January 1, 2021, and the earliest the 5 Packet Pg. 27

Page 2 ends

next increase can be effective is January 1, 2023.

Consistent with the Government Code, Councilmember compensation may be reviewed for consideration of a salary adjustment anytime prior to the November 2022 election. A salary adjustment is proposed for a total pay increase of up to 5 percent (not compounded) for the calendar years, 2021 and 2022, for a total increase of up to 10 percent, to go into effect January 1, 2023 or after the November 2022 election results are certified by the Los Angeles County Registrar Recorder and the Santa Clarita City Clerk, whichever date is later.

The proposed monthly salary adjustment is as follows:

Current salary Proposed salary up to
$2,217.41 $2,439.15

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

The maximum budget impact would be $221.74 per month per Councilmember or an annual increase to the City budget of $13,304.40 for all five Councilmembers. Should the City Council approve a lesser percentage adjustment, the adopted budget will reduce the fiscal impact accordingly. The annual percent change for the Consumer Price Index (CPI) for the Los Angeles Area since the last Council salary adjustment is 7.5 percent for January 2022.

ORDINANCE NO. 22-___

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING SECTION 2.04.048 OF THE SANTA CLARITA

MUNICIPAL CODE CONCERNING CITY COUNCIL SALARY

THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. That Section 2.04.048 is amended to read as follows:

"2.04.048 City Council Salaries

The salary for City Councilmembers shall be increased as provided for in Government Code Section 36516 from the amount of $2,217.41 to $2,439.15 per month effective on January 1, 2023 or after the November 2022 election results are certified by the Los Angeles County Registrar Recorder and the Santa Clarita City Clerk, whichever date is later. This salary increase represents a total pay increase of 5 percent (not compounded) for the calendar years 2021 and 2022, for a total increase of 10 percent. Such salary shall be payable on a monthly basis and in the same manner as salaries are paid to other officers and employees of the City of Santa Clarita."

SECTION 2. This ordinance shall take effect as set forth in Government Code section 36937, but the date set forth in section 2.04.048 reflects that the change in salary will not apply to any Councilmembers during their current term of office. Instead it shall apply after one or more members of the council has become eligible for such change in salary by virtue of commencing a new term of office, at which time it shall apply to all Councilmembers.

SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: AWARD CONTRACT FOR PROFESSIONAL AUDITING SERVICES DEPARTMENT: Administrative Services
PRESENTER: Brittany Houston

RECOMMENDED ACTION

City Council:

1. Award a three-year contract for Auditing Services to The Pun Group, LLP, for $379,763, with an option for two one-year renewals not to exceed the annual bid amount plus an adjustment in compensation consistent with the appropriate Consumer Price Index.

2. Authorize the City Manager or designee to execute all contracts and associated documents, subject to City Attorney approval. Authorize the City Manager to execute up to two annual renewal options not to exceed $129,945, plus an adjustment in compensation consistent with the appropriate Consumer Price Index.

3. Appropriate on-going funds in the amount of $22,500 from the General Fund (Fund 100) to Accounting Professional Services expenditure account 1002101-516102.

BACKGROUND

Annually, the City of Santa Clarita (City) issues various audited financial and compliance reports. The reports are published to meet various federal, state, and other regulatory requirements, and to report to the City Council and the citizens of Santa Clarita on the City's annual financial status. The City's auditors are required by auditing standards to perform the audit to obtain a reasonable assurance about whether the financial statements prepared by management are "free of material misstatements" and to report on the results of the audit in the Independent Auditor's Report.

The contract with the current audit firm, Eide Bailly LLP (formerly Vavrinek, Trine, Day & Co., LLP), was awarded in 2016 and has now expired. In order to ensure the City would be receiving the highest quality auditing services, a Request for Proposal (RFP) for Professional Auditing 6 Packet Pg. 31

Page 2 ends

Services was issued on January 3, 2022.

The RFP was published on BidNet, the City's purchasing site. Audit firms registered on the site received an email notification that the City had posted its RFP. The RFP was downloaded by 14 firms. The following firms submitted proposals:

Company Location Three-Year Cost

Eide Bailly, LLP Rancho Cucamonga, CA $548,840
The Pun Group, LLP Santa Ana, CA $379,763
Moss, Levy & Hartzheim, LLP Culver City, CA $314,555
Badawi & Associates Berkeley, CA $314,970

Staff scored the proposals from each firm, evaluating their qualifications and experience, audit methodology and management approach, quality of personnel, and commitment to timeliness.

Three of the four firms were interviewed by the evaluation panel. As a result of this evaluation process, The Pun Group, LLP, is recommended based on their ability to provide professional guidance, qualified staff, experience auditing local governments, and the positive feedback received from their municipal clients contacted for references.

The Pun Group, LLP, is one of the "Top Accounting Firms" in Orange County according to the Orange County Business Journal and is also on the list of CalCPA Top 150 firms. The firm provides governmental auditing services to over 75 municipalities. The firm also won 2022's Best of Accounting® award from ClearlyRated which recognizes the best in staffing, accounting, and the other professional services.

To ensure the highest quality audit, The Pun Group, LLP, has a full-time partner and staff dedicated to quality control and over 15 percent of the audit hours will be performed directly by firm partners and managers. Based on total audit hours, the bid submitted by The Pun Group, LLP, has competitive hourly rates for Fiscal Year (FY) 2021-22.

Based on the results of this competitive process, the annual cost to the City for acquiring auditing services will be $125,600 for FY 2021-22, $124,218 for FY 2022-23 and $129,945 for FY 2023-

24. ALTERNATIVE ACTION

Other direction as determined by City Council.

FISCAL IMPACT

Upon approval of the recommended action, adequate funds will be budgeted for the contracted amount not to exceed $379,763 over three fiscal years.

2. Appropriate one-time funds in the amount of $150,000 from the American Rescue Plan Act Fund (Fund 228) to expenditure account P3034228-516101.

3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND

The proposed Santa Clarita Roller Skating Rink (Rink) will be the first of its kind in Santa Clarita and will offer the community a new intergenerational outdoor recreation amenity. The project will be located at the Santa Clarita Sports Complex, adjacent to the gymnasium, and is anticipated to include a gated roller skating rink with a single-story covered structure, shaded spectator seating, an audio booth with a sound system, dasher boards, security cameras, WIFI access point, LED lighting, and landscaping. The final amenities will be determined through a concept plan and public outreach process. This project supports the Building and Creating Community theme of the Santa Clarita 2025 plan.

A Request for Proposal (RFP) for the design of the project was prepared and posted on BidNet, and published in The Signal newspaper on January 27, 2022. The RFP asked firms to identify their relevant experience with similar projects, describe their approach for the design, and 9 Packet Pg. 42

Page 2 ends

complete all design documents necessary for construction. The bid specifications were downloaded by 36 vendors and one proposal was submitted by the set deadline of March 3, 2022. Staff reviewed the proposal and based on their evaluations, scored the firm on a 100-point scale as follows:

Rank Company Location Score
1 Anil Verma Associates, Inc. Los Angeles, CA 89.33

The scoring system was based on the following criteria: an understanding of the scope and approach to the required work and key development tasks, the consultant’s previous experience with similar projects and experience working with the City of Santa Clarita (City), qualifications of the project team and their resources, and organization of the proposal. Additionally, each consulting firm was asked to provide a detailed scope of work required to prepare the plans, specifications, and engineer’s construction estimate. Due to the volatile bidding environment and high construction activity throughout Southern California, the City continues to receive fewer bids on projects at a higher cost.

Considering the unique nature of this type of project, staff reached out to several firms before the RFP was posted to garner interest in the project. To accommodate out-of-state firms that downloaded the project documents, a virtual pre-proposal job walk was provided along with an in-person meeting one week prior to the RFP deadline. On March 3, 2022, one firm submitted a proposal to the City. Staff from the Public Works, Neighborhood Services, and Recreation and Community Services departments reviewed and evaluated the proposal.

Anil Verma Associates, Inc., demonstrated an in-depth understanding of the project’s needs and provided a detailed scope of work and approach to the project. They analyzed and identified key design factors that will need to be addressed in the design and presented ideas that clearly represent the vision of the City for the project. Anil Verma Associates, Inc., is a sub-consultant for the City’s Via Princessa Park and Vista Canyon Metrolink Station projects. They have also worked on projects such as Disney California Adventures - Cars Land and Gateway to LA at LAX. Based on their design experience with similar projects and the completeness of their proposal, staff recommends awarding the design contract to Anil Verma Associates, Inc.

The current project budget of $300,000 is insufficient to complete the design phase of this project. The appropriations request of $150,000 will cover the remaining contract cost, topographic survey, geotechnical investigations and report preparation, field investigations, potholing services, and permit fees for the project. The budget will also cover administrative costs associated with the anticipated public outreach component and staff time.

The requested contingency will cover the costs of unforeseen design constraints and account for potential design modifications requested by the City and other permitting agencies during the design of the project. This includes potential adjustments to the architectural drawings, engineered grades, change order requests made by the design firm, and change orders for additional work requested by the City.

California Government Code Section 4526 prescribes selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for 9 Packet Pg. 43

the satisfactory performance of the services required and does not authorize the selection of professional architect and engineering services based on cost. City staff was able to reach an agreement with Anil Verma Associates, Inc., at a fair and reasonable price.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Upon approval of the recommended actions, adequate funds will be available in expenditure account P3034228-516101 to support the recommended contract.

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: TAX-SHARING RESOLUTIONS FOR SANITATION DISTRICT, ANNEXATION NOS. 1107 AND 1108
DEPARTMENT: Public Works
PRESENTER: Amalia Marreh

RECOMMENDED ACTION

City Council:

1. Adopt the Santa Clarita Valley Sanitation District's resolutions approving and accepting the negotiated exchange of property tax revenues resulting from Santa Clarita Valley Sanitation District Annexation Nos. 1107 and 1108.

2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND
The Santa Clarita Valley Sanitation District (District), formerly known as County Sanitation District Nos. 26 and 32, provides wastewater treatment services within the District’s service area.

To provide wastewater treatment service to properties located outside the District’s service area, the boundary must be expanded through the annexation process. As part of this process, a tax- sharing resolution to provide the required funding to the District is adopted by the public agency responsible for providing services to the subject property.

Local agencies receiving an apportionment of the property tax from the annexing area, including cities and utility districts, must determine the percentage of tax revenues to be exchanged between the affected agencies. Listed below are the annual tax increment percentages attributable to the land area involved in the corresponding annexation and to be transferred to the District:

0.9593853% for Annexation No. 1107

0.9814810% for Annexation No. 1108
10 Packet Pg. 46

Page 2 ends

For this total, the City of Santa Clarita is contributing the following percentage of its revenues from the annual tax increment for this annexation area:

Annexation No. 1107:

0.0992227% for City of Santa Clarita

Annexation No. 1108:

0.1010502% for City of Santa Clarita

There is a separate tax-sharing resolution for Santa Clarita Library for each annexation. The following is the percentage of revenues from the annual tax increment for each annexation area:

Annexation No. 1107:

0.0399113% for Santa Clarita Library

Annexation No. 1108:

0.0376437% for Santa Clarita Library

There is a separate tax-sharing resolution for Santa Clarita Street Lighting Maintenance District No. 2 for one of the annexation areas. The following is the percentage of revenues from the annual tax increment for the area:

Annexation No. 1108:

0.0364221% for Santa Clarita Street Lighting Maintenance District No. 2

The annexations consist of the following (see attached resolutions with corresponding maps):

Annexation No. 1107 - One proposed club and lodge hall (Canyon Country Community Center) located on Sierra Highway, north of Soledad Canyon Road and east of Solamint Road.

Annexation No. 1108 - Four proposed single-family homes identified by APNs 2834- 034-001, -002, -003, -004, and located on Alderbrook Drive.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

As proposed, the annexations to Santa Clarita Valley Sanitation District should result in no adverse fiscal impact to the City.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: RENEW CONTRACTS FOR BUILDING PLAN REVIEW, BUILDING

INSPECTION, AND PERMIT-RELATED PROFESSIONAL

SERVICES
DEPARTMENT: Public Works
PRESENTER: John Caprarelli

RECOMMENDED ACTION

City Council:

1. Approve one-year contract renewals for JAS Pacific, Scott Fazekas & Associates, Interwest Consulting Group, and TRB and Associates for building plan review, building inspection, and permit-related professional services for a combined total annual amount not to exceed $500,000, effective Fiscal Year 2022-23.

2. Authorize the City Manager or designee to execute all contracts and associated documents, contingent upon the appropriation of funds by the City Council in the annual budget for such fiscal year, subject to City Attorney approval.

BACKGROUND

The City of Santa Clarita (City) uses contractual services on an as-needed basis to assist staff with building plan review, inspection, and permit-related professional services for new buildings during periods of high construction activity. Contractual support for building plan review and building inspection helps supplement staff’s efforts to reduce plan check turnaround time and manage the inspection workload as demand fluctuates. Contractual services help maintain appropriate staffing and customer service levels.

The City Council awarded contracts to JAS Pacific, Scott Fazekas & Associates, Interwest Consulting Group, and TRB and Associates for building plan review, building inspection, and permit-related professional services at its April 13, 2021, meeting. Each of the firms were selected through a Request for Proposal (RFP) and were evaluated based on their ability to meet 11 Packet Pg. 74

Page 2 ends

the specific needs of the City in three areas: building plan review, building inspection, and permit-related services. By utilizing the four firms selected, staff has the flexibility to assign projects to contract building plan reviewers and/or inspectors who are best suited to meet the City’s needs, while retaining appropriate staffing and customer service levels.

Contracts entered into pursuant to the RFP may be renewed annually, up to four times, with City Council approval. Staff recommends awarding one-year contract renewals to JAS Pacific, Scott Fazekas & Associates, Interwest Consulting Group, and TRB and Associates for a combined total annual amount not to exceed $500,000, effective Fiscal Year 2022-23.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Upon adoption of the Fiscal Year 2022-23 budget, adequate funds will be available in expenditure account 1004100.516101 to provide for the recommended action.

BACKGROUND

The annual overlay and slurry seal projects are an integral part of the City of Santa Clarita’s (City) Overlay and Slurry Seal Program. Each year, streets are evaluated and identified for the need for pavement preservation and rehabilitation treatments. The 2021-22 Overlay and Slurry Seal Program will resurface streets, seal cracks, and coat the surface of streets in various areas of the City (see attached project street lists). These treatments will provide a smoother ride for vehicles and reconstruct or extend the life of the roadway, depending on the type of treatment applied. This year's projects are expected to begin construction in April 2022 and will be completed by the end of November 2022. The 2021-22 Overlay and Slurry Seal Program is divided into three projects: Overlay A, Overlay B, and Slurry Seal. These projects will run concurrently to maximize the work being done during the summer season. This project supports the Santa Clarita 2025 theme of Sustaining Public Infrastructure.

Solicitation Process for the Overlay A Project

An invitation to bid was prepared and published twice, on February 10 and 17, 2022, and was posted on BidNet. Four bids were submitted to the City and opened by Purchasing on March 7, 2022. Each of the bids included a base bid and five bid alternates. The basis for award was the total for the base bid and alternates combined. The results of the total bids (including bid alternates) are shown below:

Company Location Total Bid
C.A. Rasmussen, Inc. Santa Clarita, CA $18,209,820
Toro Enterprises, Inc. Oxnard, CA $18,339,221
Sully-Miller Contracting Company Brea, CA $18,447,000 PALP Inc. DBA Excel Paving Company Long Beach, CA $20,543,131

Staff recommends awarding the construction contract for the Overlay A project to C.A.

Rasmussen, Inc., the lowest responsive bidder, in the amount of $6,509,158 for the base bid, authorizing an expenditure of $1,426,516 for bid alternate four, and authorizing a contingency in the amount of $793,567, for a total not to exceed $8,729,241. The City reserves the right to add or remove any of the alternates at the time of award or by contract change order during construction. The contractor possesses a valid state contractor’s license and is in good standing 12 Packet Pg. 77

The City reserves the right to add or remove any of the alternates at the time of award or by contract change order during construction. The contractor possesses a valid state contractor’s license and is in good standing with the Contractors State License Board. The bid from Toro Enterprises, Inc., was reviewed for accuracy and conformance to the contract documents and found to be complete.

While the City maintains a Support of Local Businesses policy that can be utilized by the City Council when warranted, the City is governed by the California Public Contract Code with regard to public works project procurement. In this type of procurement, the California Public Contract Code does not permit a city to utilize a Support of Local Businesses policy and instead requires the contract be awarded to the lowest responsible bidder.

Solicitation Process for the Slurry Seal Project

An invitation to bid was prepared and published twice, on January18 and 25, 2022, and was posted on BidNet. Five bids were submitted to the City and opened by Purchasing on February16, 2022. The contractor possesses a valid state contractor’s license and is in good standing with the Contractors State License Board. The bid from Pavement Coatings Co. was reviewed for accuracy and conformance to the contract documents and found to be complete.

Solicitation Process for Materials Testing and Inspection Services for the Overlay A, Overlay B, and Slurry Seal Projects

The City Council awarded a materials testing and inspection services contract to Twining, Inc., at its June 8, 2021, meeting. Twining, Inc., was selected through a Request for Proposal (RFP) process, which provided up to three annual renewal options, subject to City approval.

Staff recommends using the first renewal option to award the contract for materials testing services and project inspection to Twining, Inc., in the amount of $1,293,710 for base bid and alternate services for Overlay A, Overlay B, and Slurry Seal projects and a contingency in the amount of $129,371, for a total amount not to exceed $1,423,081.

Solicitation Process for As-Needed Surveying and Monument Preservation Services and Construction Support Services for the Overlay A, Overlay B, and Slurry Seal Projects

The procurement process for the PSOMAS and FCG Consultants, Inc., professional services as- needed contracts took place through RFP CIP-19-20-05. The City conducted this RFP to solicit proposals from qualified firms to provide professional engineering services in eight categories of work on an as-needed basis to support the City’s Public Works department’s Capital Improvement Projects division. The RFP responses were reviewed and evaluated based on each firm’s ability to meet the specific needs of the City. The RFP was advertised on the City’s website on October 11, 2019. The RFP was downloaded by 137 companies and in the category of Surveying and Monument Preservation and Restoration, eight responses were received and in the Staff Augmentation category, nine responses were received. Of those received, eight proposals for Survey and Monument Preservation and Restoration services and six proposals for Staff Augmentation services were selected to enter into as-needed contracts, among them PSOMAS and FCG Consultants, Inc.

PSOMAS and FCG Consultants, Inc., were selected for this project based on their pre- qualifications and their availability to meet the project deadlines and milestones.

Staff recommends awarding the contract for survey, monument preservation, and restoration services for Overlay A, Overlay B, and Slurry Seal Projects to PSOMAS for a total contract amount not to exceed $326,525.

Staff also recommends awarding the contract for staff augmentation services for the Overlay A, Overlay B, and Slurry Seal projects to FCG Consultants, Inc., for a total contract amount not to 12 Packet Pg. 79

exceed $200,000.

Total Budget for the Overlay and Slurry Seal Projects and Inspection and Materials Testing

Following is the cost breakdown for the 2021-22 Overlay and Slurry Seal Program, Project M0144 contract awards:

Overlay A Project $8,729,241
Overlay B Project $9,426,380
Slurry Seal Project $2,246,769
Inspection and Materials Testing $1,423,081
Surveying Monument Preservation $326,525
Construction Support Services $200,000
Total Awarded $22,351,996

The Overlay and Slurry Seal Program budget will fund the construction, inspection, materials testing, surveying, monument preservation, speed humps installation, project management software, urban forestry support, irrigation support, and construction support services. The budget will also provide for labor compliance, staff oversight, public works inspection, and miscellaneous project administration costs.

The requested 10 percent contingencies for the Overlay A, Overlay B, and Slurry Seal contracts will allow for additional streets from the City's pre-designed inventory and available bid alternates to be added to the project if funds are available after construction of the original scope of work. Additionally, the remaining contingency will cover costs associated with unforeseen site conditions, such as potential utility conflicts and abandoned utilities not shown in record drawings that are often discovered during construction, as well as change order requests made by the contractor.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds are available in expenditure accounts M0144264-516101 (Measure R Local Return), M0144266-516101 (Measure M Local Return), M0144267-516101 (SB 1), M0145233- 516101 (TDA Article 8 Street & Road), and M0145266-516101 (Measure M Local Return) to support the recommended contracts and associated project costs.

Agenda Item: 13

CITY OF SANTA CLARITA

AGENDA REPORT

PUBLIC HEARINGS
CITY MANAGER APPROVAL:

DATE: April 12, 2022
SUBJECT: ADJUST CONSOLIDATED FIRE PROTECTION DISTRICT

DEVELOPER FEE
DEPARTMENT: Public Works
PRESENTER: Nicholas Berkuta

RECOMMENDED ACTION

City Council conduct a public hearing and adopt a resolution to adjust the Consolidated Fire Protection District developer fee from $1.3120 per square foot to $1.4316 per square foot in accordance with the Developer Fee Agreement between the City of Santa Clarita and the Consolidated Fire Protection District of Los Angeles County.

BACKGROUND
In accordance with the City of Santa Clarita’s (City) agreement with Los Angeles County (County) to be part of the Consolidated Fire Protection District (Fire District), the City is required to adopt the attached updated Developer Fee Detailed Fire Station Plan within a reasonable period of time. The last increase to the Fire District developer fee became effective May 1, 2021.

Fire District developer fees finance the construction of new (and replacement) fire stations and related fire protection improvements within the City.

The current proposed fee increase from $1.3120 per square foot to $1.4316 per square foot is consistent with the fee increase adopted by the Los Angeles County Board of Supervisors on January 25, 2022. The proposed fee adjustment is largely a result of cumulative fire station development financing costs as well as increased fire apparatus and equipment costs. The Fire District developer fee is charged on new residential buildings, new detached residential accessory structures, new commercial buildings, and residential or commercial additions over 2,000 square feet. The fee is collected at the time of building permit issuance.

The increased fee amount will ensure the City’s Fire District developer fees are consistent with the fees collected by the County in the unincorporated areas of the Santa Clarita Valley and will 13 Packet Pg. 89

Page 2 ends

satisfy the agreement with the County.

Staff recommends conducting a public hearing and adopting a resolution to adjust the Consolidated Fire Protection District developer fee, which if approved will go into effect July 1, 2022.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

There is no anticipated fiscal impact to the City as a result of this resolution. There are minor administrative costs for collecting and transmitting Fire District developer fees to the County.

These costs will not be affected by the fee adjustment.

CITY OF SANTA CLARITA

NOTICE OF A PUBLIC HEARING REGARDING A PROPOSED INCREASE IN

CONSOLIDATED FIRE PROTECTION DISTRICT DEVELOPER FEES

PUBLIC NOTICE IS HEREBY GIVEN:

A public hearing will be held before the City Council of the City of Santa Clarita to consider an increase to Consolidated Fire Protection District developer fees from $1.3120 to $1.4316 per square foot of new development in the Santa Clarita Valley Area of Benefit. The proposed fee adjustment is largely a result of cumulative fire station development financing costs, as well as increased fire apparatus and equipment costs. In accordance with the City of Santa Clarita’s agreement with the County of Los Angeles to be part of the Consolidated Fire Protection District, the City of Santa Clarita is required to adopt the updated Developer Fee Detailed Fire Station Plan within a reasonable period of time. The proposed fee adjustment is consistent with the fee increase adopted by the Los Angeles County Board of Supervisors on January 25, 2022.

The public hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, first floor, the 12th day of April 2022, at 6:00 p.m.

If you wish to challenge the action taken on this matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.

Proponents, opponents, and any interested persons may be heard on this matter at this time.

Further information regarding the proposed fee increase may be obtained by visiting www.santa- clarita.com/building, or by contacting John Caprarelli, Building Official, at (661) 255-4935.

Kenneth Striplin, City Manager
City of Santa Clarita
23920 Valencia Boulevard, Suite 300
Santa Clarita, CA 91355

Dear Mr. Striplin:

We have prepared our annual request to the Los Angeles County Board of Supervisors (Board) to update the Developer Fee Program for the benefit of the Consolidated Fire Protection District of Los Angeles County (Fire District). A copy of the updated Detailed Fire Station Plan, the 2021 Developer Fee Update Fee Calculation Summary, and the Developer Fee Funds 2020-21 Fiscal Year-End Report are enclosed for your information. This year we are recommending an increase in the developer fee rate from $1.3120 to $1.4316 per square foot of new development in the Santa Clarita Valley Area of Benefit. This rate increase is a result of cumulative fire station development financing costs, land costs, fire station development costs, fire apparatus and equipment costs, as well as increased administrative costs associated with the Developer Fee Program.

Also enclosed is the Notice of Public Hearing which will be held on January 25, 2022. This notice shall be published in four local newspapers within the affected areas and posted on the Board’s website and at the Fire District’s Fire Prevention offices within the Developer Fee Areas of Benefit. Please also have a copy of the notice posted at a public counter within the City of Santa Clarita for a period of at least ten days prior to the public hearing date.

If you have any questions or wish to discuss this matter, you may contact me at (323) 881-2404, or at [email protected].

Very truly yours,

Fiscal Year The Fiscal Year period be gins July 1 and ends June 30.

Initiating Priority Year Refers to the fiscal year that the land acquisition or construction of the fire station is anticipated to begin.

Target Occupancy Target occupancy is approximately one to two years from the actual start of construction.

Where actual costs are not yet available, the anticipated capital projects costs are based upon the Fire District's current cost experienced for construction, land and equipment.

Developer Fee credit may be granted for the conveyance of a site, apparatus, or construction of a fire station to help offset the impact of development on the Fire District.

Based on average costs for fire stations recently completed and stations under development; includes plans, specifications, consultant services, plan check, permit and inspection fees, construction, project management, furnishings, and equipment.

The amount budgeted could be from Developer Fee funds collected or advanced from Fire District general revenues or certificates or participation. All advances made and/or interest incurred by the Fire District to finance station development are to be repaid when Developer Fee revenues are sufficient. If no amount is budgeted, the development of the fire station may be delayed until Developer Fee revenues are sufficient to fund the site acquisition and/or construction of the fire station.

This plan reflects the proposed staffing and equipment to be implemented when each station and the development served by each station are built out in the respective areas of benefit. In many instances, a transitional staffing confirguration will be utilized until build out occurs.

DEVELOPER FEE DETAILED FIRE STATION PLAN

PREFACE
This Developer Fee Detailed Fire Station Plan (Plan) reflects the Consolidated Fire Protection District's (Fire District) fire service requirements as of September 2021 based upon growth projections and contacts with cities and developers who have shared their development plans with the Fire District.

The Plan identifies 5 completed fire stations, 12 additional fire stations, one completed replacement station, one station expansion, two helispots, and the necessary capital equipment that will be required in the Areas of Benefit as well as the anticipated costs and time frames provided that development occurs as expected. The anticipated costs identified in the Plan will be funded by Developer Fee revenues or funds which the Fire District has advanced from other sources. These advances will be repaid to the Fire District when sufficient Developer Fee revenue is generated.
