RE: NEWHALL GATEWAY BEAUTIFICATION
(RFP NUMBER: CIP-21-22-B2018)
Dear Selection Committee Members,
Pacific Coast Land Design (PCLD) is pleased to submit our proposal to the City of Santa Clarita for the Newhall Gateway Beautification project. Newhall, with its rich history and cultural ties to the beginnings of Santa Clarita, deserves to be celebrated as both a ‘Gateway’ to the City and destination in its own right.
The team looks forward to developing an Interchange landscape that extends Santa Clarita’s beautiful public realm landscape to the City’s southeast edge, welcoming those traveling to the City along the I-5 and SR-14 corridors.
PCLD and our consultant team are proud to have had a part in developing projects within the adjacent community that have helped shape Downtown Newhall’s revival and impact on the City as a growing cultural district. The team, with extensive experience working together within the City of Santa Clarita, is structured to meet the variety of public agency requirements posed by this project. Each of the team members have ample Caltrans and public agency experience and feel fortunate to have developed strong working relationships with City staff and local stakeholders. PCLD will be engaged as the Prime design consultant to the City, with the primary focus of the work being produced in collaboration with Encompass Consultant Group and consulting Traffic Engineer, Adam Chase of CR Associates. The team is backed by Rincon Consultants and R.T Frankian for as-needed environmental and geotechnical support relative to the project design goals and Caltrans permit process.
While we recognize the importance of the technical process requirements for a project within the Caltrans right of way and feel confident in our team facilitating a streamlined review and approval process with the agency, the primary goal of this project remains to create a beautiful and lasting interchange landscape that is unique to Newhall and complements the beauty of the City and the surrounding environment.
Pacific Coast Land Design values our strong relationship with the City of Santa Clarita and this beautification project is an important opportunity for our firm. We and our consultant team members look forward to the potential of continuing to work closely with City of Santa Clarita staff on this community defining project.

THE EXISTING SITE
DESIGN OPPORTUNITIES
(SEE SITE OPPORTUNITIES

Pacific Coast Land Design (PCLD) understands that the City of Santa Clarita is seeking the services of a well-qualified landscape architect to develop conceptual design details, create detailed plans, specifications and estimates (PS&E), and work with the City to obtain Caltrans approval of the final design of the Newhall Gateway Beautification project. PCLD and the consultant team will prepare the required documents necessary to obtain approval of 100% plans, specifications and estimates, and work closely with the City to successfully complete the project goals and protect the interest of the City.
The project is isolated to the unimproved areas of the on- and off-ramp interchange located at Newhall Avenue and SR-14. Over the years, no improvements have been made to provide an aesthetically pleasing, regionally adapted landscape. The land is barren, with no color, nor any consistency with the City’s well established landscape infrastructure.
While the full extents of the unimproved and blighted interchange open space are close to 10-acres in total area, we understand the City intends to target the beautification improvements for maximum effectiveness in key locations; limiting the intensive beautification landscaping and related improvements to approximately 4.5 acres. Special emphasis will be placed on creating beautifully landscaped gateway entry and exit points visible to motorists on this regionally significant freeway as they travel to, from, and through Santa Clarita, a major economic center of the Southern California region.
The PCLD team understands the goal of the project is to provide beautification elements for the areas adjacent to the on- and off-ramps, improving existing blighted conditions, highlighting and framing views to the already beautiful natural landscape and mountainous terrain of the adjacent area, and enhancing previously constructed Caltrans freeway infrastructure. Pacific Coast Land Design, in developing the City’s Design Standards for Medians, as well as, designing the context appropriate improvements for Oldtown Newhall, is well versed in the low water-use, regionally adapted plant palette that will beautify the area while minimizing maintenance and overall water-use that is so critical at this time. The project will also explore cost effective gateway character elements that draw on the palette of materials and amenities so successfully established in Oldtown Newhall. In complying with the state Model Water Efficient Landscape Ordinance AB 1881, the team envisions a largely “point source” irrigation distribution system in which water is distributed by bubblers to plant roots, and not sprayed over the entire landscape. This will reduce maintenance (fewer weeds and longer lasting mulch in areas without planting) and water use (highest water distribution efficiency rating by state rating standards). A variety of trees, shrubs, and ground covers that both highlight the interchange and complement the location’s natural habitat will be utilized. Where possible, and as the budget will allow, mature plants will be used.

PERMITTING
Right-of-way conveyances:
The project doesn’t
involve ROW dedications,
modifications, etc.
New permanent stormwater
treatment facilities or create
5,000 sq ft of non-highway
impervious surface or 1-acre
or more of new highway
impervious surface:
Project will not increase
more than 1-acre of new
highway impervious surface.
The project may consider
new permanent stormwater
treatments which would
trigger additional reviews.
Total construction costs within
the State highway R.O.W. is
$1 million or less:
If this is the only number
checked (#15) the District
Encroachment Permit
Engineer in consultation with
the impacted functional
units will determine the
appropriate Caltrans review.
Low Impact Development (LID) drainage solutions and green streets strategies will be a key component of the project design. The site can be developed to contain its run-off, and possibly filter freeway paving pollutants already flowing through the open space and into the existing drainage infrastructure. Gentle mounding will direct water along low gradient swales that will absorb pollutants and increase permeability.
The PCLD team acknowledges that the proposed project boundaries lie within the permitting jurisdiction of Caltrans District 7. While the focus of the project is to develop beautification improvements for the interchange, we want to be sure we are providing the City with the balanced services necessary to secure the needed approvals and permits from Caltrans.
The project will be subjected to the encroachment permit process and Caltrans evaluates each local agency request based on the complexity and construction cost of the work within the State Highway right-of-way.
Our initial review of the proposed project confirms some of the challenges the project will need to navigate. To explain our understanding, we begin with the Project Background (with QMAP Process) which discusses the in-depth Caltrans District 7 Project Delivery Process and how it applies directly to this project, as this sets the scope of work. The team must determine if the project will be managed through the Encroachment Permits Office Process (EPOP), Mr. Paul Shin’s office, or the Project Delivery Quality Management Process (QMAP). With these challenges in mind, we must ask the following from the QMAP. See information on the left and Applicant’s Checklist.

DESIGN REQUIREMENTS
Depending on the significance of the stormwater treatment facilities proposed and the environmental studies required to achieve a CE CEQA clearance, the project may end up as either a Permit Engineering Evaluation Report (PEER TR -0110) or a Design Engineering Evaluation Report (DEER) which replaces the former. Typically, the DEER replaces the need of a PSR-PDS, PSR-PR, and Project Report . The PCLD design team has been staffed to assist the City with either process, but we have initially scoped the project with a PEER to provide a baseline scope from which to work from. It is not anticipated that the DEER process would involve additional services by PCLD, ECG and CRA; but the project would incur services for additional environmental studies and documentation that is not currently included in the baseline scope of services for this proposal.
It is assumed that the Owners’ Allowance for additional Caltrans permitting, and related services can cover the as-needed environmental documentation process that would be derived from initial project review meetings with Caltrans. Initial meetings with Caltrans are included in the project scope to define early on in the project delivery, the extent of the reporting that will be required to support the approval of the Encroachment Permit.
PCLD and each of the subconsultant firms are registered with the Department of Industrial Relations and we acknowledge that this project is subject to prevailing wage compliance monitoring. The team has reviewed all released Addenda and the solutions and scope of work presented in the proposal are based on the information provided in the RFP and answers to proposer questions given as part of Addendum 3.
The work to be performed will be based on the latest pertinent City policies, codes, standard drawings, and ordinances and meet all applicable state and federal guidelines. Development of the interchange improvement plans will be consistent with City format and in accordance with the Caltrans Design Guidelines for Highway Planting and Irrigation. Per Addendum 3, Caltrans Standard Plans and Specifications will be followed.
The City’s Project Manager will direct and coordinate this Project. The Consulting Project Manager, PCLD Senior Associate Brooke McDonnell shall receive, coordinate, and transmit reports and documents to and from the consulting team and act as a liaison with the City team, stakeholders, and Caltrans. Working in partnership with the Civil and Traffic Engineers, PCLD will take the lead in developing overall design concepts that will improve the character of this open space, highlighting it as a gateway to the historical Newhall community and welcoming entry to the City of Santa Clarita as a whole.

The project site at the on- and off-ramp
interchange of Newhall Avenue and the SR-
14 freeway provides diverse opportunities
for serving as a beautiful gateway to the
City while improving safety, connection, and
conservation. This exhibit highlights many of the
existing challenges and illustrates opportunities
to implement solutions.
Locations along the north bound off-ramps
can be used to intercept the off-ramp flows
to minimize the commingling of offsite run-
off and can provide areas for bioretention.
The areas adjacent to the southbound and
northbound on- and off-ramps can also be
used to install roadside vegetated treatment
sites. These measures not only capture water
for treatment and infiltration but also help
provide safe driving conditions.
The interchange should have a unique
landscape character through the use of
drought tolerant native and regionally
adapted plants with cobble and accent
planting. By planting in strategic, designated
locations, the impact can be maximized to
welcome motorists to the city and tie into the
existing character of Old Town Newhall and its
rich cultural history.
Using non-landscaped areas of the
interchange for Caltrans staging areas
provides maintenance staff with safety in
performing their duties.
The slope paving under the freeway provides
an opportunity for telling Old Town Newhall’s
rich history in the Santa Clarita Valley through
a public art mural via Caltrans’ Transportation
Art program. There is also an opportunity for
future connections from Old Town Newhall
to both the Newhall Park & Ride and Whitney
Canyon Park incorporating views of the
adjacent mountains.

Our studio, located in downtown Ventura, specializes in regional projects throughout Ventura County, Santa Barbara County, and Northern Los Angeles County
PCLD is proud to have contributed to the development of a broad range of public-serving projects in our community. In recent years, Pacific Coast Land Design has expanded our portfolio of public space projects, supplemented by experience in private sector projects. Our experience in working with many local jurisdictions allows us the ability to be a bridge between the municipalities and the agencies we serve, and the community we’re designing with. Working within these shared spaces, as both designers and client representatives, we create client-specific strategies by combining our varied knowledge base, keen sense of place, and existing relationships. Our approach is tailored to municipality-specific needs including project design services, community engagement, grant and funding administration, and project and program management.
Pacific Coast Land Design (PCLD) has been involved in the design and maintenance of the Santa Clarita landscape for more than thirty years.
For projects like the 4.5-acre interchange at Newhall Avenue and SR-14, our knowledge of a variety of plants that will remain healthy and beautiful with minimum water and maintenance is an important key to developing an interchange that will improve the character of this important landscape setting and serve as a gateway to the city.
Much of the PCLD’s portfolio over the last 20 years has included public works projects ranging from streetscapes to urban and neighborhood parks, highway interchanges to medians, green infrastructure to complete streets transportation solutions. In the pages following the team’s staff qualifications, we’ve provided examples of the team’s distinguished recent work with constructed improvements and scopes-of-work that have a relevance to those proposed for the Newhall Gateway Beautification project.

PROJECT EXPERIENCE
ORCHARD VILLAGE MEDIANS
Santa Clarita, CA
PROJECT BACKGROUND
DESIGN
SCOPE OF WORK
Starting in January 2016, PCLD provided landscape architectural design services for the medians along Orchard Village Road, one of the City’s main thoroughfares. The wide medians are non-standard, and the design team worked with City staff to define beautification treatments while still serving the yearly use as the 4th of July parade route. The project completed construction in September 2018 and hosted its first 4th of July parade the following year.
In achieving the City’s goal of potable water use reduction, the project features drought tolerant and adapted plantings and a low flow irrigation system that has been retrofitted for connection to the City’s recycled water source as it becomes available. The net water savings is expected to exceed 1.5 million gallons annually. Project planning documents identified ground recharge stormwater treatment opportunities to incorporate innovative bio-infiltration and retention features within the existing median footprint. The project team incorporated Rain Gardens as the best suited stormwater treatments from the Los Angeles County Low Impact Development (LID) Best Management Practices (BMPs). Rain Gardens are the first of its kind to act as the City’s preferred permanent BMP for a median project of this size.
PCLD provided conceptual design services leading to final PS&E and both bid and construction administration services. PCLD’s services concluded in September 2018.

PICO CANYON/LYONS AVENUE
+ I-5 INTERCHANGE Santa Clarita, CA
PROJECT BACKGROUND
SCOPE OF WORK
QUALITY OF LIFE
The rolling hills and native plantings around the Lyons Avenue / I-5 interchange are among the most beautiful natural areas in the City of Santa Clarita. This character guided a landscape design that relies on native plants and natural landforms.
The preliminary design for both consisted of planting, irrigation, gateway hardscape and grading. Construction documents included all listed items except grading, which was completed by an engineer. PCLD was heavily involved in site grading and the construction of the large boulders, the drainage drops, and the swales at the Lyons/I-5 interchange. Both Lyons/I-5 and Pico Canyon/I-5 interchange construction documents were submitted and approved by Caltrans. Lyons/I-5 was installed by the City of Santa Clarita. The Pico Canyon/I-5 construction documents are still awaiting installation by the County of Los Angeles.
This landscape was designed to survive on precipitation after 2-3 years of establishment. However, to maintain its “gateway” beauty, intermittent watering is likely. Sustainability elements include:
• Pollutant & water infiltration swales with retention areas • Native and native compatible plants that are drought, disease and insect resistant and do not require fertilization
• Weather based irrigation control
• Low gradient drainages with boulder drops and energy absorbing coble at top & bottom of drops to reduce erosion potential 20 | PCLD Newhall Gateway Proposal

BACKGROUND
DESIGN
Old Town Newhall is an historic township located in Santa Clarita, California. Since 2008, PCLD had been developing designs and plans for the sidewalks, intersections, and pedestrian connections along a 5-block long stretch of Main Street. Phases I & II are complete with Phase III, a terminal roundabout, currently under construction. We are presently working with the City of Santa Clarita to finalize designs for the public art component to be the center of the terminal roundabout. The process has included multiple meetings with City staff and community groups to help generate consensus for the final design expression.
The streetscape design of Old Town Newhall is an expression of the historic, cultural, and natural character of the Newhall region. Brick and boardwalk materials chosen for the paving along the street reference the “Old West” and Cowboy heritage. Additionally, boulders and “Hitching Posts” provide vertical elements to define spaces and screen small seating areas from the street. A “Western Walk of Fame” reflects the rich entertainment history of the area; showcasing the names of Western movie actors engraved in bronze plaques along the corridor.
The roundabout designed to provide a terminal entrance to the street is currently under construction and will contain a public art sculpture that reflects the character of the street, neighborhood, and its history.
Native plants and boulders along a nearby creek and the fascinating history of the town provided a strong design foundation. The corridor is already transforming from a Main Street with auto shops and thrift stores into a mixed use transportation oriented development nexus that will feature street level entertainment, restaurants and up-scale retail below at least two more stories of urban residences or offices.

WORK PLAN
TASK 1
1.1 1.2
The services proposed by Pacific Coast Land Design and our team of subconsultants include necessary tasks to implement the Newhall Gateway Beautification project as listed in the RFP and discussed in the Introduction section of this proposal. Project implementation will rely on close collaboration between the Design team and the Client with key input from stakeholders and the community.
PRELIMINARY INVESTIGATION
The Design Team will review and assess existing data and reports relative to the Newhall Gateway Beautification project and carry out the Preliminary Investigations that will set a basis for the detailed design work to follow. A kick-off meeting (See Task 2 - Project Management) will confirm the level of stakeholder involvement and the type of documents and communication routes that will best serve City decision makers. The design team will also acquire digital information needed to develop accurate base maps for the project site. The project manager will secure any City documents that PCLD does not already have. Existing conditions and utility information will be updated by the civil engineer while the landscape architect maps existing field conditions relevant to the design.
Site analysis maps will be produced and used in the field to document existing conditions.
The information gathered during this phase will be shared with staff, and Caltrans when appropriate, to ensure that all suitable information has been gathered. Then, a Design Opportunities and Constraints exhibit will serve as the basis for moving forward with the conceptual design effort listed in Task 3 – Design.
Background Document Review
Review any existing landscape design information from City or Caltrans upon which the design must be based. Summarize existing design related documents that will guide the design, including previous designs and or installations for Newhall Avenue Medians and Old Town Newhall and roundabout, gateway design data, and any potential future improvements withing the adjacent area.
» Output - Summarize existing design related documents
that will guide the design, including previous designs and or installations for Newhall Avenue Medians and Old Town Newhall and roundabout, gateway design data, and any
potential future improvements within the adjacent area.
Site Investigation
After reviewing City provided GIS mapping and background data, Pacific Coast Land Design and the consultant team will walk the site with the City Project Manager and representatives from Traffic Division and LMD.
The team will note existing conditions at this time. Particular attention will be paid to existing utilities and drainage features as well as in-use Caltrans staging areas and access points. Existing trees will be evaluated with input from City Urban Forestry Division to recommend whether they should be removed or protected in place. Pictures will be taken and filed.
The team will identify the items to be catalogued through field surveying (e.g. utilities, existing adjacent water and electrical facilities, traffic signs, trees, and any other conditions that may require team coordination and/ or other agency involvement).

development of design base map and basis for design.
Topographic Survey and Record Right of Way
ECG shall perform a topographical survey including record boundary survey for the project areas shown in Exhibit D of the RFP. Survey will include but not limited to; location of existing above ground improvements, slopes, visible utilities, flowlines, fence lines, trees, signage, edge of pavement, curb and gutters.
Aerial Topographical Base Map
Perform control survey for the purpose of establishing horizontal and vertical positions on aerial targets for aerial mapping and orthophoto production of the general mapping area as shown on RFP Exhibit. Offramps will be compiled for horizontal mapping only. Obtain aerial photography covering the project extents. Aerial photography will be captured at an accuracy that is suitable to compile topographic mapping at a scale of 1-inch equals 20 feet, with a 1-foot contour interval. Process photography to create a single ortho-rectified photo of the project site as shown in the attached exhibit. Perform field survey to locate visible surface features such as meters, valves, backflow preventers, poles, warning signs, new paint marks, exposed pipe sections, and critical design constraints known to the team, not identifiable from aerial mapping. Download and compute survey data and prepare an AutoCAD drawing file. Each surveyed feature will be clearly labeled or noted by symbol as identified in the field.
» Output - Caltrans encroachment permit for Field Survey, Topographical Survey. AutoCAD drawing files via email,
FTP or DVD as appropriate and a PDF signed and sealed
digitally by a California Licensed Lands Surveyor. Hardcopies available upon request.
Right of Way Mapping
Research of pertinent recorded maps and documents. Compile site right of way based on the information contained in the latest available assessor site information and available Caltrans maps. The computed boundary will be added to the AutoCAD drawing base map. Resolving boundary problems, such as conflicting descriptions and misclosures, are beyond the scope of this proposal. If easements of record are required to be plotted, a current preliminary title report will need to be provided by the City to determine additional level of effort, if any. Perform field survey to search for and recover existing record monuments sufficient in number to compile the record documents. The monuments will be tied to the project control survey and will be used to orient the boundary to the project mapping datum. ECG will coordinate with Caltrans to obtain an encroachment permit to perform the field survey. The team assumes all fees will be paid for directly by the City.
» Output - Boundary Survey
Existing Utility Research
The team will contact dry and wet utility companies and agencies to obtain record drawing information to document existing utilities within the work area specifically where relocations, grading and removals are proposed. Record utility maps will be compiled onto an existing utility 31 | PCLD Newhall Gateway Proposal
basemap used for design. ECG will contact USA Dig Alert to obtain a list of providers and utility owners for the project area. A letter and map will be sent to each entity on the list with a request for maps or a clearance statement. A log will be maintained documenting the contacted utility companies’ responses and coordination notes. Prior to mobilizing the survey crews, ECG will notify Dig Alert and request utility markings. It is understood that Dig Alert will mark utilities only if construction is planned immediately after and may not agree to perform the marking. ECG will compile alignments of subsurface utilities from record maps and atlases received in response to your requests. Subsurface alignments will be oriented and adjusted to the topographic mapping using the surveyed locations of surface features where possible. ECG shall coordinate existing utility relocations with the affected agencies.
» Output - Existing Utility Basemap, Existing Utility Response Log.
Geotechnical Investigations
Infiltration Study
The team anticipates a total of three (3) water quality infiltration basins within the project extents. It is assumed that the invert elevation of each basin will be approximately 3-feet below existing ground surface.
RT Frankian will provide an infiltration study in consideration of the Los Angeles County Department of Public Works, Administrative Manual GS 200.2, “Guidelines for Geotechnical Investigation and Reporting, Low Impact Development (LID) Storm Water Infiltration,” dated June 30,2021.
The guidelines include provisions for subsurface exploration, groundwater investigation and infiltration testing. The infiltration testing would be performed using the small diameter boring infiltration test procedure to determine the infiltration rates as outlined within the guidelines. • A single hollow-stem boring would be advanced to a depth of 50-feet below the existing ground surface to provide subsurface exploration and a groundwater investigation. Samples would be obtained from the boring for laboratory testing that would include moisture and density determination, gradation analysis and consolidation testing. The results of the testing would be used to help characterize the subsurface soils relative to infiltration. • A total of 3 additional hollow-stem auger borings would be advanced to a depth of approximately 4-feet below existing ground surface for infiltration testing. Each of the borings would be developed for small diameter boring infiltration tests. » Output - Formal report providing the results of the infiltration study, a summary of the subsurface exploration and
laboratory testing, the depth of groundwater and the results of infiltration testing.
Agronomic Sampling and Testing
The soil conditions within unimproved areas adjacent to the state highway system are often over-compacted and lacking nutrients to adequately support ornamental planting. The team will conduct agronomic testing to define planting area amendments to ensure the success of the beautification improvements. A total of 8 samples would be obtained from 8 shallow hand-auger borings within proposed landscape areas for agronomic testing. The samples would be collected from the upper 24-inches of the near surface soils below existing ground surface.

NOTICE TO PROPOSERS REGARDING INDEMNITY AND INSURANCE REQUIREMENTS PROFESSIONAL SERVICES AGREEMENT – DESIGN
PROPOSAL # CIP-21-22-B2018
Newhall Gateway Beautification
City Project No. B2018
City of Santa Clarita, California
SUMMARY OF CONTRACTUAL REQUIRMENTS
1. A contract is required for any service performed on behalf of the City of Santa Clarita (City).
2. By submitting a proposal, you have reviewed the sample contract documents contained within this request for proposals and agree to be bound by the requirements set forth.
3. Questions and requests for modification of these terms must be negotiated and approved prior to proposal submission and are at the full discretion of the City.
SUMMARY OF INDEMNITY AND INSURANCE REQUIREMENTS
1. These are the Indemnity and Insurance Requirements for Contractors providing services or supplies to City of Santa Clarita (City). By agreeing to perform the work or submitting a proposal, you verify that you comply with and agree to be bound by these requirements. If any additional Contract documents are executed, the actual Indemnity language and Insurance Requirements may include additional provisions as deemed appropriate by City’s Risk Manager.
2. You should check with your Insurance advisors to verify compliance and determine if additional coverage or limits may be needed to adequately insure your obligations under this agreement. These are the minimum required and do not in any way represent or imply that such coverage is sufficient to adequately cover the Contractor’s liability under this agreement. The full coverage and limits afforded under Contractor’s policies of Insurance shall be available to Buyer and these Insurance Requirements shall not in any way act to reduce coverage that is broader or includes higher limits than those required.
The Insurance obligations under this agreement shall be: 1—all the Insurance coverage and limits carried by or available to the Contractor; or 2—the minimum Insurance requirements shown in this agreement, whichever is greater. Any insurance proceeds in excess of the specified minimum limits and coverage required, which are applicable to a given loss, shall be available to City.
3. Contractor shall furnish the City with original Certificates of Insurance including all required amendatory endorsements and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to City before work begins. City reserves the right to require full-certified copies of all Insurance coverage and endorsements.
I. INDEMNIFICATION:
To the fullest extent permitted by law, including without limitation Civil Code sections 2782 and 2782.8, CONSULTANT shall defend (with legal counsel reasonably acceptable to CITY), indemnify and hold harmless CITY and its officers, agents, departments, officials, representatives and employees (collectively “Indemnitees”) from and against any and all claims, loss, cost, damage, injury (including, without limitation, economic harm, injury to or death of an employee of CONSULTANT or its subconsultants), 42 | PCLD Newhall Gateway Proposal
expense and liability of every kind, nature and description that arise from or relate to (including, without limitation, incidental and consequential damages, court costs, attorneys’ fees, litigation expenses and fees of expert consultants or expert witnesses incurred in connection therewith and costs of investigation) that arise from or relate to, directly or indirectly, in whole or in part, from: (1) any negligent act or omission of CONSULTANT, any subconsultant, anyone directly or indirectly employed by them, or anyone that they control; (2) any actual or alleged infringement of the patent rights, copyright, trade secret, trade name, trademark, service mark or any other intellectual or proprietary right of any person or persons in consequence of the use by CITY, or any other Indem nitee, of articles or Services to be supplied in the performance of this Agreement; or (3) any breach of this Agreement (collectively “Liabilities”). Such obligations to defend, hold harmless and indemnify any Indemnitee shall not apply to the extent such Liabilities are caused by the sole or active negligence or willful misconduct of such Indemnitee, but shall apply to all other Liabilities.
The foregoing indemnification provisions will not reduce or affect other rights or obligations which would otherwise exist in favor of the CITY and other Indemnitees.
CONSULTANT shall place in its subconsulting agreements and cause its subconsultants to agree to indemnities and insurance obligations in favor of CITY and other Indemnitees in the exact form and substance of those contained in this Agreement.
II. INSURANCE
(A) Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT will procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:
Type of Insurance Limits
Commercial general liability: $1,000,000
Professional liability $1,000,000
Business automobile liability $1,000,000
Workers compensation Statutory requirement
(i) Commercial general liability insurance will meet or exceed the requirements of ISO-CGL Form No. CG 00 01 11 85 or 88. The amount of insurance set forth above will be a combined single limit per occurrence for bodily injury, personal injury, and property damage for the policy coverage.
Automobile coverage will be written on ISO Business Auto Coverage Form CA 00 01 06 92, including symbol 1 (Any Auto). Liability policies will be endorsed to name CITY, its officials, and employees as “additional insureds” under said insurance coverage and to state that such insurance will be deemed “primary” such that any other insurance that may be carried by CITY will be excess thereto. Such endorsement must be reflected on ISO Form No. CG 20 10 11 85 or 88, or equivalent. Such insurance will be on an “occurrence,” not a “claims made,” basis and will not be cancelable or subject to reduction except upon thirty (30) days prior written notice to CITY. 43 | PCLD Newhall Gateway Proposal
(ii) Professional liability coverage will be on an “occurrence basis” if such coverage is available, or on a “claims made” basis if not available. When coverage is provided on a “claims made basis,” CONSULTANT will continue to renew the insurance for a period of at least three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONSULTANT for all claims made by CITY arising out of any errors or omissions of CONSULTANT, or its officers, employees or agents during the time this Agreement was in effect.
CONSULTANT will furnish to CITY duly authenticated Certificates of Insurance evidencing maintenance of the insurance required under this Agreement, including endorsements, and such other evidence of insurance or copies of policies as may be reasonably required by CITY from time to time.
Insurance must be placed with California- admitted insurers with (other than workers compensation) a current A.M. Best Company Rating of at least “A:VII.”
Waiver of Subrogation: The insurer(s) agree to waive all rights of subrogation against CITY, its elected or appointed officers, officials, agents, volunteers and employees for losses paid under the terms of the workers compensation policy which arise from work performed by CONSULTANT for CITY.
Should CONSULTANT, for any reason, fail to obtain and maintain the insurance required by this Agreement, CITY may obtain such coverage at CONSULTANT’s expense and deduct the cost of such insurance from payments due to CONSULTANT under this Agreement or terminate pursuant to TERMINATION section. In the alternative, should CONSULTANT fail to meet any of the insurance requirements under this Agreement, City may terminate this Agreement immediately with no penalty.
Should CONSULTANT’S insurance required by this Agreement be cancelled at any point prior to expiration of the policy, CONSULTANT must notify City within 24 hours of receipt of notice of cancellation.
Furthermore, CONSULTANT must obtain replacement coverage that meets a ll contractual requirements within 10 days of the prior insurer’s issuance of notice of cancellation. CONSULTANT must ensure that there is no lapse in coverage.
The CITY shall be entitled to any coverage in excess of the minimums required herein.
I have read and understand the above requirements and agree to be bound by them for any work performed for the City.

This addendum must be acknowledged via BidNet and should be included with the proposal response.
The purpose of this addendum is to address the following for this Request for Proposals (RFP):
I. PROVISION OF ANSWERS FOR Q&A PORTAL
Please see the following answers provided for questions #1-16 posted in the Q&A portal.
Q1) Are there target dates for completion of PSE, start of construction or completion of construction? If so, what are those dates? For purposes of consistency between the various proposals, the City might consider setting a target duration for the design so that all proposers will have a consistent duration in their proposed schedules.
A1) The design contract is anticipated to be awarded at the August 23, 2022 City Council meeting.
Part of the proposal evaluation process will be to review the schedules proposed by consultants.
Proposed schedules should demonstrate an understanding of the project scope as well as the requirements necessary to have plans and specifications approved by the various parties involved.
The project contract will be executed based on the length of time agreed upon with the City and selected consultant. Construction duration and dates will be determined during design.
Q2) The fourth page states that registration with the Depa rtment of Industrial Relations is required. Is that requirement applicable to this project's scope of work? A2) Registration with the Department of Industrial Relations is required on this project due to the anticipated contract value (over $25,000) and field work to be done (site investigative work).
Q3) The RFP does not mention environmental compliance, is that part of the project to be handled by others? Would our scope need to include anything in regard to that aspect of the project? A3) The consultant should anticipate design of post construction BMPs/LIDs to address runoff on site. Modeling of watershed feeding the drainage on site should be included.
Q4) Is there a Project Study Report (PSR) for the project? A4) No, there is not a Project Study Report (PSR) for the project.
Q5) Would a WQMP and/or a SWPPP w/permit be desired as part of our scope? A5) The project includes more than 1 acre of land disturbance, therefore a SWPPP that meets Caltrans requirements is to be provided by the cons ultant or sub- consultant. Consultant should assume the project is a Risk Level 2.

PROPOSAL # CIP-21-22-B2018
Q6) Does the irrigation system need to be connected to a fiber optic mainline system? A6) No. The City uses HydroPoint Weathertrak controllers.
Q7) Traffic engineering is not included in the requested scope. Would anything be needed in that area for things like traffic control plans for construction? A7) Traffic control plans are required and will need to be provided as part of the application submitted to Caltrans for the encr oachment permit(s). Traffic control plans shall follow the Caltrans Standard Plan and Specifications for Traffic Control as provided in Exhibit B and will also be reviewed and approved by the City’s Traffic Division.
Q8) In regard to the thr ee public meetings, will the City be responsible for mailing notifications, social media and website postings, and any other publicity or outreach efforts? A8) The City will be responsible for all notifications for public outreach.
Q9) Are the three public meetings to be held to present and discuss the same material at the same point in the project? Or would this be a series of meetings with the intent of taking comments, making revisions, then presenting revised plans at subsequent meetings? A9) There a re expected to be up to three separate public meetings, if necessary, with local residents and community members at the concept design stage of the project for the purpose of gathering comments and feedback. Any design changes are to be incorporated into the plans prior to the next plan iteration. No subsequent response or presentation will be made to the public.
Q10) Would there be a need for us to participate in any commission or City Council presentations? A10) The selected consultant may be requested to attend City Council meetings at award of construction or other milestones in the project in order to answer design questions that may be raised.
Q11) Task 2 states in bullet three that bi -weekly meetings are to be held, then bullet six says meetings will be held monthly. Is the intent to do meetings on both cycles or should we assume that meetings will be held bi-weekly (twice a month) for the duration of the project? A11) Bi-weekly (twice a month) meetings are to be held at the beginning of design unti l 30% (concept) plans are compete. Monthly meetings are to be held to coordinate the rest of the preparation of PS&E documents required.
Q12) The RFP states that both the Greenbook and the Caltrans spec will be used for this project.
Please clarify if the reference specification for this project will be Greenbook or Caltrans.
A12) Project specifications and details shall be prepared using current Caltrans Standard Plans and Specifications.

PROPOSAL # CIP-21-22-B2018
Q13) Regarding the infiltration testing, is one test location acceptable? If more than one location is desired, can you state how many you think would be needed? A13) The consultant shall determine the number of tests needed to determine the design in- situ infiltration rates. A minimum of two tests is required.
Q14) The sub-consultant section states that a “total approximate dollar amount” be provided for each sub-consultant. Please confirm a single lump sum not-to-exceed amount is all that is required for the sub -consultants (rather than a task breakdown with labor hours as is requested for the prime fee).
A14) Please provide a task breakdown with labor hours for any sub-consultants performing more than one task.
Q15) The ongoing drought has resulted in restrictions on water usage. These restrictions may increase over time. Has that been considered as a factor in this project? If so, what impacts/changes have been considered?
A15) In keeping with the City’s philosophy of being good stewards of water usage, drought impacts and water conservation should be taken into consideration along with any requirements in place at the time of design. Efficient irrigation, low water-use plant material, and a balance of hardscape and landscape are some of the elements to be included in the design.
Q16) Please confirm that the City requests both five hard copies and an electronic version (submitted via Bidnet) of the proposal.
A16) The hard copy submission requirement has changed to four ( 4) hard copies, but o ne (1) electronic copy submission via BidNet.
II. HARD COPY SUBMISSION REQUIREMENT UPDATE
The requirement for hard copy submissions has changed to four (4) hard copies.
