The bill would prohibit a local agency from imposing or enforcing on a student or faculty and staff housing project subject to ministerial consider ation certain r estrictions, including a minimum automobile parking r equirement. The bill would r equire student or faculty and staf f housing to have certain r ecorded deed restrictions, except as provided, that ensure for at least 55 year s that, among other things, at least 20% of the units ar e affordable to lower income households, as defined, except as provided. CEQA also requires a lead agency to prepare a mitigated negative declaration for a project that may ha ve a significant effect on the environment if revisions in the project would avoid or mitig ate that effect and there is no substantial e vidence that the project, as re vised, w ould ha ve a significant ef fect on the 98 — 2 — AB 1630
environment. CEQA does not apply to the appro val of ministerial projects.
By establishing a streamlined, ministerial approval process for certain housing developments, this bill w ould expand the e xemption for the ministerial approval of projects under CEQA.
The bill w ould include findings that changes proposed by this bill address a matter of state wide concern rather than a municipal af fair and, therefore, apply to all cities, including charter cities.
The California Constitution requires the state to reimb urse local agencies and school districts for certain costs mandated by the state.
Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.
