BACKGROUND
On April 11, 2023, with a 4-1 vote, the City Council introduced and passed to second reading two distinct ordinances, which address rules and regulations pertaining to vehicles parked over 72 hours and oversized vehicle parking.
The ordinance amending Chapters 12.08 and 12.64.200 of the Santa Clarita Municipal Code (SCMC) pertains to vehicles parked over 72 hours. This ordinance establishes a minimum distance of 150 feet and makes other, non-substantive clarifications to existing definitions.
The ordinance amending Chapter 12.94 of the SCMC pertains to oversized vehicle parking. This ordinance removes the weekend and holiday exemption, and allows for a maximum of three (3) 72-hour parking permits within any 120 day period.
The City’s Parking Enforcement Program (Program) enforces these rules and regulations on a reactive basis, meaning that Parking Enforcement Officers only investigate vehicles out of compliance in response to a received complaint. The Program does, however, engage in proactive enforcement if a vehicle is parked in a manner that poses a health and safety risk. This is reinforced through City Policy I-11.2, as it relates to enforcement of the oversized vehicles.
The policy specifically states, “[I]t is the declared policy of the City to address enforcement of the aforementioned provisions [Chapter 12.94 of the SCMC] on a reactive or complaint basis unless an oversized vehicle poses an immediate risk to public health and safety.”
A copy of Policy I-11.2 – Enforcement of Oversized Vehicle Ordinances is attached for reference, in addition to redline changes to existing SCMC. Upon approval of the recommended actions, the proposed changes will take effect on May 25, 2023.
ALTERNATIVE ACTION
