CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: November 28, 2023
SUBJECT: LOCAL APPOINTMENTS LIST
DEPARTMENT: Administrative Services
PRESENTER: Mary Cusick

RECOMMENDED ACTION

City Council approve the Local Appointments List and designate all branches of the Santa Clarita Public Library to receive a copy of the list.

BACKGROUND

Section 54970 et seq. of the Government Code, also known as “The Maddy Act,” takes into consideration a vast and largely untapped reservoir of talent which exists among the citizenry that frequently is not aware of the opportunities for participation on local regulatory and advisory boards and commissions. For that reason, the Maddy Act was enacted for maximum public awareness of appointments to be made by the Governor, the City Council, or other legislative bodies.

Government Code Section 54972 requires that, on or before December 31 of each year, the legislative body, or City Council, must cause to be prepared a list of appointments of all ongoing boards, commissions, and committees which are appointed by the City Council. The list must include which terms will expire during the next calendar year, with the name of the incumbent appointee, the date of appointment, the date the term expires, and the necessary qualifications for the position. Section 54973 requires that the legislative bodies designate the public library with the largest service population within the jurisdiction to receive a copy of the list.

In accordance with these provisions, and to make the information more readily available to the public, the City Clerk will cause to be posted the attached Local Appointments List at all branches of the Santa Clarita Public Library and on the City’s website before December 31, 2023.

CITY MANAGER APPROVAL:

DATE: November 28, 2023
SUBJECT: MCBEAN PARKWAY REALIGNMENT, PROJECT S1047 -

DEVELOPER AGREEMENT BETWEEN THE CITY OF SANTA

CLARITA, HENRY MAYO NEWHALL HOSPITAL, AND HCN G&L

VALENCIA SUB, LLC
DEPARTMENT: Public Works
PRESENTER: Shannon Pickett

RECOMMENDED ACTION

City Council:

1. Approve the draft developer agreement between the City of Santa Clarita, Henry Mayo Newhall Hospital, and HCN G&L VALENCIA SUB, LLC, stipulating Henry Mayo Newhall Hospital and HCN G&L VALENCIA SUB, LLC, will provide all project related costs above and beyond grant funds obtained by the City of Santa Clarita and providing the City of Santa Clarita right-of-entry to construct and stage on Henry Mayo Newhall Hospital and HCN G&L VALENCIA SUB, LLC, properties.

2. Authorize the City Manager or designee to execute all required documents, subject to City Attorney approval.

BACKGROUND

The proposed McBean Parkway Realignment Project, shown on the attached Location Map, will improve circulation on McBean Parkway at Orchard Village Road and improve ingress and egress at Henry Mayo Newhall Hospital (HMNH). The project will realign the existing medians east and west of Orchard Village Road and install street improvements along the frontage of HMNH providing for the addition of a dedicated right turn pocket on westbound McBean Parkway into the hospital for improved emergency services access. A dedicated right turn pocket from eastbound McBean Parkway onto southbound Orchard Village Road will be added to improve eastbound afternoon traffic on McBean Parkway. This work is part of the Henry Mayo Hospital Master Plan and supports the Building and Creating Community theme of the City of Santa Clarita’s (City) five-year strategic plan, Santa Clarita 2025. 6 Packet Pg. 27

Page 2 ends

In October 2017, the City Council approved a contract for design services for the McBean Parkway Median Realignment Project to Anderson Penna, and construction drawings were completed in 2020. On June 28, 2022, the City was granted $1,120,000 from the Consolidated Appropriations Act, 2022, under the Community Project Funding/Congressionally Directed Spending, recommended by Congressman Mike Garcia, to construct these improvements. These funds will be administered through the California Department of Transportation (Caltrans).

These improvements have been deemed to be mutually beneficial to the City and HMNH prompting a collaboration between the City and the hospital campus property owners, HMNH and HCN G&L VALENCIA SUB, LLC (HCN Valencia), for project planning and preparation of a developer agreement. The agreement includes the following terms:

• HMNH and HCN Valencia will provide funding to cover all project-related costs in excess of grant funds obtained by the City.
• The right-of-entry agreement will be executed to allow the City to access HMNH and HCN Valencia properties for construction activities and laydown yard. • HMNH and HCN Valencia will procure materials with long lead times in advance of the start of construction.

In order to maintain and utilize the grant funding, the City needs to execute this developer agreement to acquire the right-of-entry approval from property owners and to complete a full right-of-way review as required by Caltrans.

All parties have reviewed and commented on the agreement and generally agree on the terms. A draft of the agreement is available in the City Clerk’s Reading File. Final adjustments are anticipated to be minor and primarily related to format and syntax.

Once all parties have approved the agreement, staff will advertise the project and return to City Council to obtain approval of the award for construction.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

None by this action. The recommended action only allows the City to enter into an agreement to secure a right-of-entry agreement, establish responsibility for project cost sharing and procurement of materials, and provide credit for Bridge and Thoroughfare eligible construction costs paid for by HMNH. Reimbursable construction costs are within Valencia Bridge and Thoroughfare District (Fund 303).

8. Find Parcel Map No. 83898 exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15061(b)(3) because the division does not include any proposed development or construction.

BACKGROUND
The parcel map for Parcel Map No. 83898, a location map of which is attached hereto, has been reviewed by City of Santa Clarita (City) staff and found to be in substantial conformance with the principles and standards required by the Unified Development Code and State Subdivision Map Act. Tentative Parcel Map 83898 (TPM) was approved by the Planning Commission on December 6, 2022, under Master Case No. MC22-164. This parcel map consists of the creation of thirty (30) commercial condominium units within an existing 38,040 square-foot, two-story medical office building located at 23206 Lyons Avenue. No new development is proposed with this map. The parcel map consists of one lot and is approximately 1.55 acres.

There is an existing easement for slope purposes within the boundaries of this map which was acquired per a road deed recorded October 23,1970, as instrument number 3481. The easement for slope purposes was determined by staff to be unnecessary due to the area’s topography.

Therefore, the easement is being abandoned per this map. The abandoned easement is shown in the attached easement abandonment exhibit.

Pursuant to Section 66474.1 of the Subdivision Map Act, a legislative body shall not deny approval of a final or parcel map if it was previously approved as a tentative map for the proposed subdivision, and if it finds the final or parcel map is in substantial compliance with the previously approved tentative map.

The parcel map was reviewed to the satisfaction of the City Engineer and the City Surveyor and found to be in substantial conformance with the previously approved TPM. The conditions of approval established by the City were also met and fees have been paid as indicated on the attached Fact Sheet. Therefore, this parcel map is ready for City Council approval and abandonment described thereon.

ALTERNATIVE ACTION
Staff has not identified alternative actions that would conform to requirements set forth in the Subdivision Map Act.

FISCAL IMPACT

There is no fiscal impact.
