CITY OF SANTA CLARITA

AGENDA REPORT

NEW BUSINESS
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: ADJUSTMENTS TO LOS ANGELES COUNTY BUSINESS

LICENSING REGULATIONS FOR GUN AND AMMUNITION

DEALERS
DEPARTMENT: Community Development
PRESENTER: Tracy Sullivan

RECOMMENDED ACTION

City Council receive a presentation on recent changes to Los Angeles County business licensing regulations for gun and ammunition dealers, review the options presented, and provide direction to staff.

BACKGROUND
Local businesses engaging in the sale of firearms are required to adhere to various California state and federal laws, including but not limited to requirements on posting notifications and warnings to consumers, reporting firearms lost or stolen from the dealer’s inventory, securing storage of firearms, completing employee background checks, reporting inventory records, carrying a general liability insurance policy with coverage for at least $1 million per incident, and most recently, as of January 1, 2024, installing and maintaining a fixed digital video surveillance and audio recording system on their business premises pursuant to Senate Bill 1384.

California firearms dealers must obtain and maintain a valid Federal Firearms License (FFL), a valid Certificate of Eligibility issued by the California Department of Justice (DOJ), a valid Seller’s Permit issued by the California Department of Tax and Fee Administration, active status on the DOJ Centralized List of Firearm Dealers, and any regulatory business license required by local government.

On November 7, 2023, the Los Angeles County (County) Board of Supervisors adopted a new Gun and Ammunition Dealers Ordinance (Ordinance). Prior to the Ordinance taking effect on December 8, 2023, the County Treasurer Tax Collector (TTC) was issuing business licenses to gun and ammunition dealers operating business within the City of Santa Clarita (City). However, in order for the TTC to continue issuing business licenses to gun and ammunition dealers within 2 Packet Pg. 15

Page 2 ends

the City, the City would be required to adopt its own local ordinance, conforming to the County.

The County Ordinance imposes new requirements for gun and ammunition dealers to obtain a County business license and additionally applies them to ammunition-only dealers. Previously, ammunition-only dealers were not required to have a specific County business license; however, under the new Ordinance, ammunition-only dealers are required to follow the same standards as gun dealers. According to information provided by the County, there are currently four gun and ammunition dealers located in the City and one ammunition-only dealer.

While the majority of the requirements are consistent with the current California Penal Code, which subject businesses are already required to adhere to, the County Ordinance also contains provisions that go beyond the standards set forth currently by state and federal law. For example, the Ordinance requires that gun and ammunition stores restrict access by unaccompanied minors under the age of 18. Where gun or ammunition sales activity is not the primary business performed at the business premise, the Ordinance states that the business could allow unaccompanied minors inside the store as long as all guns and ammunition are wholly kept, displayed, or offered within a separate room or enclosure where minors are excluded.

The County Ordinance additionally increases the licensing fee from $739 to $954 for a first-year license and from $279 to $577 for each annual renewal thereafter. A copy of the approved Ordinance is available in the Clerk's Reading File.

Pursuant to California Penal Code Section 26700, firearm dealers must obtain any regulatory or business license required by the local government or a letter from the duly constituted licensing authority having primary jurisdiction for the applicant’s business location stating that the jurisdiction does not require any form of regulatory or business license or does not otherwise restrict or regulate the sale of firearms beyond state and federal law.

In order to prevent an interruption of business for local gun and ammunition dealers, the City currently has two options for the City Council to consider:

Option 1 - Adopt the County Gun and Ammunition Dealers Ordinance Under this option, the County would resume administering business licenses for gun and ammunition dealers located in the City. Local gun and ammunition dealers would need to obtain a County business license, under the new set of requirements, and be subject to TTC enforcement.

Option 2 - Not adopt the County Gun and Ammunition Dealers Ordinance and authorize the City Manager or designee to issue letters to local firearms dealers of this decision, pursuant to Penal Code Section 26700
Under this option, the County would not administer business licenses for gun and ammunition dealers located in the City. Local gun and ammunition dealers would not be required to obtain a local business license, but would still be subject to all applicable state and federal laws and regulations. In lieu of paying the County licensing fee, gun and ammunition dealers in the City would be required to pay the DOJ an annual inspection fee of $95 per dealership location.

Councilwoman McLean commented that residents are already taxed for Measure H and homelessness is on the rise, the City does not know where the money is being spent, and cities are not receiving their equitable share of the funds. Councilwoman McLean also spoke of the Public Utilities Commission's (PUC) plan to carry out state legislation that would change the way electric companies bill customers based on their income, as well as raising rates for residents who have installed solar panels. Councilwoman McLean requested further information on these items and that the City place PUC contact information on its website.

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: FISCAL YEAR 2022-23 ANNUAL COMPREHENSIVE FINANCIAL

REPORT AND OTHER RELATED REPORTS
DEPARTMENT: Administrative Services
PRESENTER: Brittany Houston

RECOMMENDED ACTION

City Council approve the Annual Comprehensive Financial Report and other related reports for fiscal year ending June 30, 2023.

BACKGROUND

The City of Santa Clarita's (City) independent audit firm, The Pun Group, LLP, has completed the City's annual audit for fiscal year ending June 30, 2023. The Pun Group, LLP, conducted the audit in accordance with Generally Accepted Auditing Standards, whereby an audit plan was prepared and followed to obtain reasonable assurance the City's financial statements were free from material misstatements. The audit included a review, on a test basis, of documents supporting the amounts and disclosures in the financial statements. The audit also included assessing the accounting principles used and significant estimates made by management, as well as evaluating the overall general purpose financial statement presentation.

The Annual Comprehensive Financial Report (ACFR) reflects the City's strong financial condition with a healthy General Fund balance.

Based on the audit performed, The Pun Group, LLP, issued an unmodified "clean" audit opinion letter. The opinion reflects the best level an organization can receive on its financial statements.

The letter is identified as the "Independent Auditor's Report" in the City's ACFR for fiscal year ending June 30, 2023.

In accordance with Generally Accepted Auditing Standards (AU-C 260), the Auditor’s Communication with Those Charged with Governance, a Report to the Honorable Mayor and Members of the City Council, has been prepared by The Pun Group, LLP, to provide specific information related to the audit scope and performance. 5 Packet Pg. 29

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: AMENDMENT TO MICROSOFT ENTERPRISE LICENSE

AGREEMENT
DEPARTMENT: Administrative Services
PRESENTER: Ryan James

RECOMMENDED ACTION

City Council:

1. Amend the existing three-year contract with SoftwareOne, Inc., to include additional Microsoft Client Access Licenses and authorize an expenditure authority increase in the amount of $72,754 for a total contract amount not to exceed $213,637.

2. Authorize the City Manager or designee to execute all contracts and associated documents, subject to City Attorney approval.

BACKGROUND
The City of Santa Clarita (City) utilizes Microsoft (MS) software to operate desktop computers, servers, databases, applications, and email. The contractual agreement between the City and MS, known as an Enterprise Agreement (EA), grants licensed use of MS products and authorizes the City to use, connect, and receive support for all licensed MS products. A typical EA lasts for three years, at which time the agreement is re-entered to allow the continued use and support of MS software. The existing agreement was approved by the City Council on June 28, 2022.

For more than 13 years, the City has utilized an EA to ensure proper licensing of MS software for use by City staff, as well as the flexibility for growth as the organization expands. The EA licenses City staff to connect to Windows servers from desktop computers to share network resources, including storage, email, printers, as well as a centralized repository for managing user access and computer configurations. Due to the benefits and desire to extend these resources to the City’s Part-time/Temporary/Seasonal staff (PTS), as well as the annual accounting to “true-up” licenses with MS to account for any growth in Full-time Employees (FTE), it is recommended that the City increase the number of EA licenses allocated from 575 to 885. In 6 Packet Pg. 31

Page 2 ends

doing so, FTE and PTS will be properly licensed for the features available to them under the EA and in compliance with Microsoft’s licensing terms.

On July 11, 1995, the City Council approved the use of competitive and co-operative purchasing agreements. This process permits the City to place orders against a competitively awarded, existing public agency contract. The County of Riverside Licensing Solution Provider Agreement Number PSA-0001530 was competitively solicited and awarded on October 22, 2019, allowing the City to take advantage of an existing competitive procurement process to enter into a Microsoft Enterprise Agreement.

Staff finds that the County of Riverside Licensing Solution Provider Agreement Number PSA- 0001530 contract through SoftwareOne, Inc., provides the most competitive pricing. The differential cost of $72,754 will properly license the aforementioned PTS and FTE accounts to utilize all licensed MS products and receive enterprise support from Microsoft through the current EA’s expiration date of June 30, 2025.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds are available in Information Services expenditure account 1002200-516101 to support the recommended action.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: CRYWOLF FALSE ALARM AND NOISE DISTURBANCE

MANAGEMENT SERVICES CONTRACT
DEPARTMENT: Administrative Services
PRESENTER: Brittany Houston

RECOMMENDED ACTION

City Council:

1. Award a three-year contract in an amount of $270,000 with an option for two one-year renewals in an amount of $90,000 annually, not to exceed a 26 percent net revenue share paid to CentralSquare Technologies for false alarm and noise disturbance management services.

2. Appropriate an ongoing annual amount of $45,000 to Treasury expenditure account 1002102-516137 (General Fund); increase revenue account 100-451102 (General Fund) by $140,000.

3. Authorize the City Manager or designee to execute contract and all associated documents, subject to City Attorney approval.

BACKGROUND

The City of Santa Clarita (City) Finance Division is responsible for overseeing activities related to false alarm and noise disturbance enforcement Citywide, which is needed to uphold provisions of the Santa Clarita Municipal Code. The City’s false alarm function is made up of two distinct elements: the issuance of false alarms and noise disturbances, and the subsequent processing and management of those citations. The City contracts with Los Angeles County Sheriff’s Department for false alarm and noise disturbance citation issuance, and contracts with a third party for false alarm and noise disturbance processing and management.

In September 2019, the City awarded a 10-year contract to Superion, LLC/CentralSquare Technologies (CentralSquare), for the replacement of the City’s enterprise resource planning (ERP) system, also known as its financial system. As part of its proposal, CentralSquare 7 Packet Pg. 35

Page 2 ends

proposed the CryWolf solution to service the City’s false alarm and noise disturbances. It is now industry standard for these billings to be handled as a service, and software is no longer available for City staff to continue to handle these billings in-house. At the time of CentralSquare's proposal, City staff chose to postpone a decision for a billing solution until it had time to evaluate CryWolf’s billing and reporting capabilities and compare them to its current processes.

Following CentralSquare's demonstration of its high quality of work, focus on customer service, and expertise in the matter, the City awarded a three-year contract to CentralSquare for its CryWolf solution in November 2020. During the three-year contract period, staff further evaluated CentralSquare's false alarm and billing management services and determined its solution successfully fulfilled the City's billing needs and met the City's customer service expectations.

Staff recommends the City award a three-year contract with an option for two one-year renewals to CentralSquare for its CryWolf false alarm and noise disturbance management services.

CentralSquare's CryWolf solution offers several benefits to the City. First, they have the capability to send bills within days of an event occurring instead of on a monthly basis, enabling residents to be aware of events as soon as they occur. Residents may also opt to receive their bills via email, further reducing the time in which they receive a bill. The solution also offers an online payment option as a convenient payment method. Resident's false alarm accounts can be viewed online, and their contact information can be updated on an as-needed basis.

As part of this agreement, the processing of false alarm and noise disturbance citations would be handled by CryWolf staff at the direction and management of the City. This work effort includes the processing of citations and payments from violators, managing appeals, and handling customer inquiries.

CentralSquare will be compensated based on a percent share of the program's revenues after direct costs of approximately $30,000 annually are deducted, including bank fees, credit card processing fees, and mailing costs. The revenue share to be paid to CentralSquare is 26 percent or approximately $60,000 annually. The City will retain the remaining 74 percent of net revenues or approximately $170,000 annually.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Upon approval of the recommended action, the Treasury expenditure budget will be increased by $45,000 for a total annual expenditure budget of $90,000. Annual gross revenues are estimated to be $260,000 and annual expenditures are estimated to be $90,000, for a net financial impact to the City of $170,000 excluding public safety costs.

1. Approve the 2024 Community Services and Arts Grants Committee’s program funding recommendations in an amount not to exceed $99,545 for Community Services Grants and $99,500 for Arts Grants, for a total not to exceed $199,045.

2. Direct staff to execute Grants Program Agreements with the agencies approved for funding.

BACKGROUND

The City of Santa Clarita has provided funds for nonprofit organizations through the Community Services and Arts Grants program for approximately 34 years. Each year, a Grants Committee (Committee) is assembled to determine funding categories, review and rate applications, and make funding recommendations for community service and arts projects throughout Santa Clarita.

This year’s Committee included Mayor Cameron Smyth; Councilmember Laurene Weste; Parks, Recreation, and Community Services Commission Chair Skye Ostrom; Arts Commission Chair April Scott-Goss; and three staff members from across the City Manager’s Office, Human Resources and Library Services, and Neighborhood Services departments. The Committee, with the exception of Arts Commission Chair April Scott-Goss, is responsible for reviewing and rating the Community Services grants.

All grants under the Arts categories were reviewed and rated by a separate Peer Review Rating Panel, which included the following members:

1. April Scott-Goss - Arts Commission Chair

2. Brenda Slaughter Reynolds - Regional Arts Advocate, City of Los Angeles Department of Cultural Affairs

3. Marc Winger - Local Arts Educator, Retired Educator, Newhall Union School District

4. Abigail Salling - Local Arts Advocate, California Institute of the Arts

The Committee continues to be responsible for determining the funding categories and making funding recommendations based on aggregate scores for each of the individual grant applications. This year, the Committee selected “City of Santa Clarita Community Benefit” for Community Services grants and “Supporting the Arts in the City of Santa Clarita” for Arts grants as the focus areas.

The maximum funding limit for each category was broken down as follows:

1. Community Services Grants $5,000

2. Community Arts Grants $5,000

3. Arts Organization Capacity Grants $5,000

4. Santa Clarita Presents Grants $7,500

With the adoption of the Fiscal Year 2023-24 budget, the City Council approved a budget for the Community Services and Arts Grants program of $200,000. The allocated amount for each area of the grant program is $100,000 for Community Services grants and $100,000 for Community Arts, Arts Organization Capacity, and Santa Clarita Presents grants.

Community Services Grants - Twenty-eight Community Services Grants applications were received, with requests totaling $137,545. This year’s grant program includes a recommendation from the Committee to fund 20 of the applicants with a total grant allocation of $99,545.

Arts Grants - Thirty-five Arts Grants applications were received across all three Arts categories, with grant requests totaling $180,000. The Committee is recommending that funding be awarded to 18 of the applications, totaling $99,500.

Attachments A1 and A2 list the agencies and their respective programs or projects recommended for funding. Attachment B lists the agencies and their respective programs not recommended for funding.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: NEWHALL RANCH ROAD AND BOUQUET CANYON ROAD
INTERSECTION IMPROVEMENTS, PROJECT C4017 - PLANS,

SPECIFICATIONS, AND CONSTRUCTION CONTRACT
DEPARTMENT: Public Works
PRESENTER: Shannon Pickett

RECOMMENDED ACTION

City Council:

1. Approve the plans and specifications for the Newhall Ranch Road and Bouquet Canyon Road Intersection Improvements, Project C4017.

2. Award the construction contract to Toro Enterprises, Inc., in the amount of $418,593 and authorize a contingency in the amount of $62,789, for a total contract amount not to exceed $481,382.

3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND

In anticipation of ongoing and future development in and around the City of Santa Clarita (City), and overall traffic increases, the Newhall Ranch Road and Bouquet Canyon Road Intersection Improvements project, shown on the attached location map, will modify medians and striping to enhance traffic flow and accommodate future traffic volumes. The proposed improvements include modifications to the raised medians, traffic signals, signing and striping, and paving. In addition, a catch basin will be relocated to accommodate a third westbound left-turn lane on Newhall Ranch Road. This project supports the Sustaining Public Infrastructure theme of the City of Santa Clarita’s five-year strategic plan, Santa Clarita 2025.

Requirements for the California Environmental Quality Act (CEQA) for the project were satisfied through Master Case 18-089 (Bouquet Canyon Project) which was certified by the 9 Packet Pg. 43

Page 2 ends

Santa Clarita City Council on November 10, 2020. The Environmental Impact Report (State Clearinghouse Number 2018121009) was certified, and the Mitigation Monitoring and Reporting Program was adopted. The Newhall Ranch Road and Bouquet Canyon Road intersection improvements were analyzed in the Environmental Impact Report.

Construction Solicitation Process
An invitation to bid was prepared and published twice in The Signal newspaper, on November 21 and 28, 2023, and was posted on BidNet. A total of two bids were submitted to the City and opened by Purchasing on December 21, 2023. The results of the bid are shown below:

Company Location Bid Amount
Toro Enterprises, Inc. Oxnard, CA $418,593
R.C. Becker and Son, Inc. Valencia, CA $451,101

Staff recommends awarding the construction contract to Toro Enterprises, Inc., the lowest responsive and responsible bidder. This contractor possesses a valid state contractor’s license and is in good standing with the Contractors State License Board. Staff reviewed the bid response for accuracy and conformance to the contract documents and found it to be complete.

The bid proposal adheres to the project's plans and specifications and is available in the City Clerk’s Reading File.

While the City maintains a Support of Local Businesses policy that can be utilized by the City Council when warranted, the City is governed by the California Public Contract Code with regard to public works project procurement. In this type of procurement, the California Public Contract Code does not permit a city to utilize a Support of Local Businesses policy and instead requires the contract be awarded to the lowest responsive and responsible bidder.

The requested construction contingency will cover the cost of unforeseen site conditions such as potential utility conflicts and fees, abandoned utilities not shown in record drawings, field adjustments, additional work requested by the City, and unanticipated costs associated with nighttime work.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds are available in the expenditure account C4017233-516101 (TDA Article 8 Fund) to support the recommended contract and project administrative costs.

BACKGROUND

The Final Tract Map for Tract No. 61924, a location map exhibit of which is attached hereto, has been reviewed by City of Santa Clarita (City) staff and found to be in substantial conformance with the principles and standards required by the Unified Development Code and State Subdivision Map Act. Tentative Tract Map No. 61924 was approved by the City’s Planning Commission on March 16, 2021, under Master Case MC20-041 for a proposed 164-unit residential apartment project. The Tentative Tract Map was approved for condominium purposes allowing flexibility to either rent or sell the units. Final Tract Map for Tract No. 61924 consists of the subdivision of 20.38 acres into four lots located at the southwest corner of Golden Triangle Road and Isabella Parkway. The site is partially developed with an existing commercial automotive parts store, Pep Boys, located within lot 2. The subdivision also includes the proposed 164 residential condominiums units within lot 1, a water quality detention basin within lot 3, and an open space within lot 4.

The Final Tract Map for Tract No. 61924 was reviewed to the satisfaction of the City Engineer and found to be in substantial conformance with the previously approved tentative tract map. ALTERNATIVE ACTION

Staff has not identified alternative actions that would conform to requirements set forth in the Subdivision Map Act.

FISCAL IMPACT

The additional width of the public streets shown on the Final Tract Map for Tract No. 61924 will be dedicated to the City and will be constructed by the developer. The maintenance of the additional width of the public street will have minimal impact to the City’s street maintenance budget.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: January 23, 2024
SUBJECT: CONTRACT EXPENDITURE AUTHORITY FOR SOUND AND

STAGE SERVICES FOR EVENTS
DEPARTMENT: Economic Development
PRESENTER: Phil Lantis

RECOMMENDED ACTION

City Council:

1. Authorize an expenditure authority increase to the existing contract with Advantage Productions in the amount of $30,000, for an annual contract amount not to exceed $75,720, plus the cost of any Consumer Price Index (CPI) increases.

2. Authorize the City Manager or designee to execute all contracts and associated documents, subject to City Attorney approval.

BACKGROUND

The City of Santa Clarita (City) entertains thousands of residents and visitors each year through a variety of special events, including the Cowboy Festival, SENSES Block Parties, Celebrate Cultural Series, Free To Be Me Music Festival, and Light Up Main Street.

On June 24, 2021, the City’s Purchasing Division, in coordination with the Arts and Events Division, issued a Request for Quotes (RFQ) for sound and stage services for City events. The quote was publicly advertised on BidNet, the City’s e-procurement platform. Eleven companies downloaded the RFQ. Only one bid, from Advantage Productions, was received for the City’s consideration. After review and evaluation of the bid, a contract was awarded to Advantage Productions for an initial one-year term. At the June 14, 2022, City Council meeting, additional contractual expenditure authority was approved for the three additional one-year contract renewals to the existing contract at a not to exceed cost of $41,600 annually plus the cost of any Consumer Price Index (CPI) increases.

Page 2 ends

Contract Usage To-Date for FY 2023-24

The contract for sound and stage services sufficiently met the needs for City events during the initial term and first year renewal. However, as we approach the midway point for year two of the contract, staff has determined that an increase in the contract authority is needed. The requested increase in funds is attributed to new events being planned by the Arts and Events division, as well as an unanticipated event in 2023 that required usage of a large amount of the existing funds.

Events Using Sound and Stage Services
Completed Events - 2023 SENSES- July 20
SENSES- August 17
SENSES- September 21
SENSES- October 19
Deputy Clinkunbroomer Memorial (Unanticipated)
Light Up Main Street
Future Events SENSES- March 21
SENSES- April 18
SENSES- May 16
SENSES- June 20
Free To Be Me Music Festival- May 5
Trek Bike Park Event- Date TBD (Unanticipated)

Request for Increased Expenditure Authority

The current contract expenditure authority for Advantage Productions, which includes the CPI increases to the original contract amount, is $45,720. Due to the increase in demand for events and unexpected activities that the City supported in the last year, these funds have largely been expended. In order to continue to produce quality events in a timely fashion, staff is requesting an additional $30,000 of expenditure authority be granted for the Advantage Productions contract. This would bring the total annual contract expenditure authority to $75,720.

ALTERNATIVE ACTION

Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds to support this agreement are contingent upon appropriations of funds by the City Council during the annual budget process.
