CITY OF SANTA CLARITA

AGENDA REPORT

PUBLIC HEARINGS
CITY MANAGER APPROVAL:

DATE: May 14, 2024
SUBJECT: ADJUST CONSOLIDATED FIRE PROTECTION DISTRICT

DEVELOPER FEE
DEPARTMENT: Community Development
PRESENTER: Patrick Sprengle

RECOMMENDED ACTION

City Council conduct a public hearing and adopt a resolution to adjust the Consolidated Fire Protection District developer fee from $1.5499 per square foot to $1.6176 per square foot in accordance with the Developer Fee Agreement between the City of Santa Clarita and the Consolidated Fire Protection District of Los Angeles County.

BACKGROUND
In accordance with the City of Santa Clarita’s (City) agreement with Los Angeles County (County) to be part of the Consolidated Fire Protection District (Fire District), the City is required to adopt the attached updated Developer Fee Detailed Fire Station Plan within a reasonable period of time. The fee is typically updated annually. The last increase to the Fire District developer fee became effective April 1, 2023.

Fire District developer fees finance the construction of new (and replacement) fire stations and related fire protection improvements within the City.

The proposed fee increase from $1.5499 per square foot to $1.6176 per square foot is consistent with the fee increase adopted by the Los Angeles County Board of Supervisors on January 30, 2024. The proposed fee adjustment is primarily a result of cumulative fire station development financing costs as well as increased fire apparatus and equipment costs. The Fire District developer fee is charged on new residential buildings, new detached residential accessory structures, new commercial buildings, and residential or commercial additions over 2,000 square feet. The fee is collected at the time of building permit issuance.

The increased fee amount will ensure the City’s Fire District developer fees are consistent with the fees collected by the County in the unincorporated areas of the Santa Clarita Valley and will 1 Packet Pg. 8

Page 2 ends

satisfy the City’s agreement with the County.

Staff recommends conducting a public hearing and adopting a resolution to adjust the Consolidated Fire Protection District developer fee, which, if approved, will go into effect July 1, 2024.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

There is no anticipated fiscal impact to the City as a result of this resolution. There are minor administrative costs for collecting and transmitting Fire District developer fees to the County.

These costs will not be affected by the fee adjustment.

The proposed fee adjustment is largely a result of cumulative fire station development financing costs, as well as increased fire apparatus and equipment costs. In accordance with the City of Santa Clarita’s agreement with the County of Los Angeles to be part of the Consolidated Fire Protection District, the City of Santa Clarita is required to adopt the updated Developer Fee Detailed Fire Station Plan within a reasonable period of time. CITY OF SANTA CLARITA

AGENDA REPORT

PUBLIC HEARINGS
CITY MANAGER APPROVAL:

DATE: May 14, 2024
SUBJECT: 2024-28 CONSOLIDATED PLAN AND THE 2024-25 ANNUAL

ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK

GRANT PROGRAM AND HOME INVESTMENT PARTNERSHIP

PROGRAM
DEPARTMENT: Community Development
PRESENTER: Tracy Sullivan

RECOMMENDED ACTION

City Council approve the submission of the five-year Consolidated Plan with its associated priorities and the Annual Action Plan for year-one with the recommended funding therein to the U.S. Department of Housing and Urban Development.

BACKGROUND

The City of Santa Clarita (City) receives an annual allocation of Community Development Block Grant (CDBG) funds, and HOME Investment Partnership Program (HOME) funds, from the U.S. Department of Housing and Urban Development (HUD). The CDBG funds are designed to assist primarily low- and moderate-income residents in the areas of suitable housing and expanded economic opportunities, while HOME funds are designed to expand the supply of decent, safe, sanitary, and affordable housing, particularly rental housing, for low-income individuals and families.

In order to receive CDBG and HOME funds, the City is required to submit a Consolidated Plan (Con Plan) at least every five years. The Con Plan contains a Housing and Homeless Needs Assessment, a Housing Market Analysis, and a Strategic Plan. It also sets the priorities for the use of CDBG and HOME funds for the upcoming five years. The current Con Plan was developed to address the five-year period of 2019-20 to 2023-24 and will expire on June 30, 2024.

As part of the Con Plan process, the City must develop and submit an Annual Action Plan which outlines the specific ways that year's allocation of CDBG and HOME funds will be spent. The Annual Action Plan also contains service goals and an explanation of how the activities proposed 2 Packet Pg. 41

Page 2 ends

will meet the priorities in the Con Plan.

In previous years, the City was additionally required to submit an Analysis of Impediments to Fair Housing Choice (AI); however, HUD has since lifted that requirement and is in the process of establishing a new AI process.

To develop the 2024-28 Con Plan and the 2024-25 Annual Action Plan, the City contracted with the consulting firm of Veronica Tam and Associates (Consultant).

Five-Year Consolidated Plan Development

As part of the development of the Con Plan Priorities, staff conducted a Community Needs Assessment process to determine the needs of the low- and moderate-income community. The Community Needs Assessment process included in-person surveys at two community events, distribution of an online survey, outreach meetings for local non-profit providers, and a social media campaign. The results of the Community Needs Assessment process were provided to the City Council in a Public Hearing on February 27, 2024.

The needs identified through the Community Needs Assessment process, along with the information from the Housing and Homeless Needs Assessment and Housing Market Analysis, were used to develop the proposed 2024-28 Con Plan priorities listed below. If approved, all CDBG-funded activities undertaken from 2024-28 must meet one of the below Con Plan priorities.

Proposed 2024-28 Con Plan Priorities:

o Improve, Maintain, and Expand Affordable Housing
o Improve and Expand Public Facilities and Infrastructure in Lower Income Areas o Provide Services Addressing Homelessness and Homelessness Prevention o Provide Supportive Human Services
o Address the Impact of COVID-19 on Lower Income Residents o Planning and Administration

Annual Action Plan Development

As part of the development of the 2024-25 Annual Action Plan, staff released a Notice of Funding Availability for non-profit, community-based organizations to provide programs and services for the low- and moderate-income community under the CDBG Program. Over 250 community-serving non-profits were notified of the opportunity to apply for City CDBG funding.

Thirteen organizations submitted applications, requesting funding for 18 programs. Those applications were evaluated by an interdepartmental committee of City staff using a 100-point evaluation tool. A total of eight programs are recommended for funding under CDBG, and a total of seven programs are recommended for funding under CDBG-CV, totaling 15 programs recommended for funding. Also recommended for funding are public improvements to the Newhall Community Center.

HUD informed the City of its CDBG allocation for FY 2024-25, which totals $1,495,091. The 2 Packet Pg. 42

Page 3 ends

City also identified $226,502 in prior year savings, which can be added to the Annual Action Plan. Finally, the City’s 2024-25 HOME entitlement allocation is $529,340.

As required by HUD, the draft documents were available for public review and comment for a 30-day period, which ended on May 14, 2024. No comments from the public were received.

The 2024-28 Consolidated Plan and the Annual Action Plan are attached as reading file.

ALTERNATIVE ACTION

Other action as directed by City Council.

FISCAL IMPACT

All programs recommended for funding in the 2024-25 Annual Action Plan will utilize CDBG and HOME funds provided by HUD. The Con Plan and Annual Action Plan will not impact the General Fund.

COMMITTEE REPORTS/COUNCILMEMBER COMMENTS
Councilwoman McLean mentioned that the Homeless Task Force meets quarterly, thanked all the organizations involved for their hard work, and commented the last meeting was well attended. Councilwoman McLean announced that a new initiative is in the signature gathering phase that would increase an existing Measure H sales tax from one-quarter to one-half percent.

Councilwoman McLean explained that the County and City of Los Angeles receives millions of dollars from Measure H, Santa Clarita receives only a small share, and the County is now asking for more money. Councilwoman McLean warned residents to not be swayed by the title of the initiative to solve an issue that is already mismanaged. Councilwoman McLean spoke of attending the Cowboy Festival at the William S. Hart Park and enjoyed seeing the large crowds, entertainment, family fun activities, and Cowboy Festival weddings. Councilwoman McLean announced a framing walk-through at the construction site of the new Family Promise transitional housing location on April 24 and wished everyone a happy Passover.

Councilmember Gibbs spoke of attending the Los Angeles County Affordable Housing Solutions Agency monthly meeting where the board has not yet discussed the new initiative since it is still in the signature phase, but warned that it is a significant amount of money, with a goal of expanding not just homeless services, but also funding affordable housing needs in Los Angeles County. Councilmember Gibbs commented on attending the Silver Spur Award dinner at College of the Canyons, recognizing philanthropist Steve Corn; congratulated the Michael Hoefflin Foundation Walk for Kids with Cancer last weekend that had over 1,000 in attendance; and spoke of the Cowboy Festival where a performance group told him that they have never experienced a city event where staff was so attentive, helpful, and respectful. 4 Packet Pg. 49

UNFINISHED BUSINESS
ITEM 1

UPDATE TO SPEED HUMP/CUSHION PROGRAM
This item would streamline the City's Speed Hump/Cushion Program application process and bring responsibility for installation costs into conformance with existing practice.

RECOMMENDED ACTION:

City Council approve the update to the Citywide Speed Hump/Cushion Program, which will allow an individual property owner to request a speed hump/cushion evaluation with the initial support of ten percent of the property owners on the subject street and establish timelines for subsequent installation or removal requests. The City of Santa Clarita would assume responsibility of surveying affected property owners on the subject street and costs associated with program implementation.

Senior Traffic Engineer Ian Pari provided the staff presentation.

Councilwoman McLean inquired about the cost of installation for speed humps, and Mr. Pari responded that one strip of cushions cost $5,000 for material and $5,000 for installation.

Addressing the Council were Glenda Yakel, Tony Maldonado, and Diane Zimmerman.

Councilwoman McLean commented on Council's past discussions where upset residents complained that travelers would seek alternate routes and disrupt their own roads.

Councilwoman McLean stated that the cost of installing speed humps tax many to satisfy the few, and they do little to reduce accidents and speeding. Councilwoman McLean indicated that the proposed update to the program is an improvement, but is not in favor of it.

Councilmember Gibbs spoke of his appreciation of the updates and requested that data collected during surveys be documented for the property owners prior to the two-thirds vote on proposed speed humps.

CITY OF SANTA CLARITA

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: May 14, 2024
SUBJECT: AMENDMENT TO THE BENEFIT ZONE OF THE SANTA CLARITA

TOURISM MARKETING DISTRICT TO INCLUDE ADDITIONAL
HOTELS
DEPARTMENT: Economic Development
PRESENTER: Evan Thomason

RECOMMENDED ACTION

City Council:

1. Adopt a resolution to declare the City Council’s intention to amend the Tourism Marketing Benefit Zone of the Santa Clarita Tourism Marketing District to designate additional hotels as receiving benefits thereunder.

2. Set a public hearing for May 28, 2024, at a time and place to hear comments on this proposed action.

3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND

In conformance with the Parking and Business Area Law of 1989, the City of Santa Clarita (City) City Council adopted Ordinance No. 10-4 (Ordinance), enacting Chapter 3.36 of the Santa Clarita Municipal Code, and established a Business Improvement Area (BIA) in the City designated as the Tourism Marketing District (TMD). This Ordinance permits the City to levy assessments on businesses within the BIA and restricts revenues so they may only be used for the benefit of the businesses within the defined area.

The TMD encompasses a Tourism Marketing Benefit Zone (Benefit Zone), where hotels located within the Benefit Zone are to pay an assessment of two percent of total room rents charged and received from transient hotel guests. Only those designated hotels included within the Benefit 6 Packet Pg. 59

Page 2 ends

Zone are assessed. Currently, the City has five hotels operating within the TMD that are a part of the Benefit Zone:

• Best Western Valencia Inn – 27413 Wayne Mills Place
• Courtyard by Marriott – 28523 Westinghouse Place
• Embassy Suites – 28508 Westinghouse Place
• Holiday Inn Express – 27513 Wayne Mills Place
• Hyatt Regency Valencia – 24500 Town Center Drive

In recent years, four new hotels have been constructed and commenced business within the City limits, and a fifth new hotel is anticipated to be open by summer 2024. As part of the Conditions of Approval and prior to occupancy, the project applicant agrees to be added to the City’s TMD Benefit Zone, which allows the hotel to be included in the tourism advertising efforts for Santa Clarita. By adopting the resolution, the boundary of the Benefit Zone would be amended by the addition of the following new hotels to be included as part of the TMD as receiving benefits:

• Homewood Suites Santa Clarita – 28700 Newhall Ranch Road • Hotel Lexen Newhall – 24219 Railroad Avenue
• Springhill Suites Valencia – 27413 Wayne Mills Place
• Residence Inn Valencia – 27413 Wayne Mills Place
• Hampton Inn Santa Clarita – 28700 Newhall Ranch Road

All revenue received from the method of assessment go into the TMD Fund, which is used for programs and activities that promote the City as a tourist destination and to generate economic activity. The Ordinance established an Advisory Board, appointed by the City Council, which provides recommendations as to the best use of TMD funds. The TMD Advisory Board includes a representative from each of the participating hotels, along with two City representatives selected by the City Manager.

The Ordinance that guides the use of funds, with recommendations from the TMD Advisory Board, is to be used for the following purposes:

1. Promoting the identity of Santa Clarita through financial support of key regional and national events that support tourism and result in an economic impact; and

2. Developing and implementing a destination marketing strategy and promotions designed to increase visitor attraction to Santa Clarita, including overnight visits; and

3. Developing and undertaking an advertising and public relations program focusing on the business and leisure travel trade; and

4. Annual operation expenses including, but not limited to, annual district administration functions and expenses, consultants, printing, postage, and meetings.

Upon approval of the recommended actions, the proposed changes will be brought back to the City Council for a public hearing, introducing an ordinance on May 28, 2024, followed by a second reading of the ordinance on June 11, 2024.

ALTERNATIVE ACTION

Other direction as determined by the City Council.

FISCAL IMPACT

All funds received from the two percent method of assessment go into revenue account 360- 402406 (Tourism Marketing District - Assessment) and are only to be used for the purposes of programs and activities that promote the City of Santa Clarita as a tourist destination. There is no fiscal impact to the General Fund associated with this item.

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: May 14, 2024
SUBJECT: MUNICIPAL SERVICES AGREEMENT WITH THE COUNTY OF

LOS ANGELES FOR ANIMAL CARE SERVICES - CONTRACT

RENEWAL
DEPARTMENT: Community Development
PRESENTER: Tracy Sullivan

RECOMMENDED ACTION

City Council:

1. Approve the renewal of the Animal Care and Control Services contract with the Los Angeles County, Department of Animal Care and Control, for an additional five-year term, ending June 30, 2029.

2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND
The City of Santa Clarita (City) has contracted with the County of Los Angeles (County) for animal control services since its inception. These services include providing shelter to stray and abandoned animals, responding to field-related requests, and issuing pet licenses. These services are administered by the County Department of Animal Care and Control (DACC), seven days a week, through operations based at the Castaic Animal Care Center.

In 2023, the City commissioned a comprehensive assessment of DACC services to evaluate the effectiveness of the existing contract and explore opportunities for improvement. The final report, presented to the City Council on May 9, 2023, concluded that DACC adheres to industry best practices and adequately meets the current needs of the community. As a result, it was recommended to continue contracting with DACC for animal care and control services. The report also identified several areas for potential enhancement, which are currently being implemented. These enhancements include, but are not limited to, providing additional spay and neuter clinics, organizing off-site adoption events, expanding media exposure, and establishing a 7 Packet Pg. 64

2.0 ADMINISTRATION OF PERSONNEL

2.1 The County will control all aspects of the services provided by the County including, but not limited to, standards of performance, discipline of officers and staff, and all employment-related matters.

2.2 In the event of a dispute between the Parties regarding the duties and services to be provided, or the minimum level or manner of performance of such services, the City will be consulted and an agreement between the Parties attempted. 3.0 DEPLOYMENT OF PERSONNEL

3.1 The Department, in cooperation with the City, will determine how to provide the services required by the Agreement.

3.2 The City agrees to complete an Attachment B, Service Level Request (SLR) form, specifying the level of service to be provided, which will be signed and authorized by the City and the Department representative and attached to the Agreement. In the event of a dispute between the Parties about the desired or approved content of the SLR will be handled in accordance with Paragraph 2.2 of this Agreement.

3.3 The Department will issue annual notifications of any change to the billing rate as stated in Paragraph 8.2 of this Agreement. Unless the City changes other provisions within the most recently executed SLR, it is not necessary to execute a revised SLR to reflect a billing rate change.

3.4 The City may at any time request a change in the level of service by completing a revised SLR, and submitting the form to the Department. The revised level of service to be provided and the current fiscal year billing rate will be signed and authorized by the City and the Department representative and attached to the Agreement as an amendment. Changes requested at times other than the beginning of the fiscal year will be implemented as soon as practical, as determined by the Department. The City is only required to submit a new SLR if it wishes to revise its current services or update information listed on its existing SLR. The Department reserves the right to approve or disapprove requests on the SLR in accordance with Section 3.1 of this Agreement.

Regarding updates to contact information, the City is not obligated to submit a new SLR. A simple email confirmation from the City will suffice, and the Department's Contracts and Grants Division will update the City's existing SLR and share the revised copy with the City.

3.5 The City will make its best effort to inform the Department of any modifications to its ordinance concerning animal care and control services.

This approach will enable the Department to verify that the services outlined in the City's SLR align with the municipal ordinance, thereby reducing the potential for any discrepancies.

3.6 The City is not limited to the services indicated but may also request any other services in the field of public safety, animal welfare , or related fields within the legal power of the Director of the Department to provide. The County reserves the right to determine, in its sole discretion, whether the Department can provide requested services not otherwise specified in this Agreement.

AGENDA REPORT

CONSENT CALENDAR
CITY MANAGER APPROVAL:

DATE: May 14, 2024
SUBJECT: BRIDGE PREVENTATIVE MAINTENANCE PROGRAM -

PROFESSIONAL SERVICES CONTRACT
DEPARTMENT: Public Works
PRESENTER: Shannon Pickett

RECOMMENDED ACTION

City Council:

1. Award the professional services contract to Tetra Tech, Inc., for the Bridge Preventative Maintenance Program, in the amount of $145,130 and authorize a contingency in the amount of $14,513, for a total contract amount not to exceed $159,643.

2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.

BACKGROUND

The Bridge Preventative Maintenance Program (BPMP) will provide guidance to maintain and preserve vehicular bridges throughout the City of Santa Clarita (City). This program will help to prioritize which bridges should be addressed based on serviceability ranking and types of repairs required to maximize the life expectancy and minimize construction costs of each structure, mitigating costly rehabilitation, reconstruction, or replacement of the City’s bridges (see attached Structure Inventory List).

In addition, a BPMP assists the City in applying for and utilizing federal grants for bridge rehabilitation projects. This program supports the Sustaining Public Infrastructure theme of the City’s five-year strategic plan, Santa Clarita 2025.

A Request for Proposal (RFP) for the development of the BPMP was prepared and posted on BidNet on March 18, 2024. The RFP asked firms to identify their relevant experience with similar projects, specify their qualifications for this project, and propose staffing. On April 18, 2024, two firms submitted proposals.
8 Packet Pg. 77

Page 2 ends

Staff reviewed the proposals and based on their evaluations, scored the firms on a 100-point scale as follows:

Rank Company Location Score

1. Tetra Tech, Inc. Buelton, CA 94

2. ARC Engineering Consultants, Inc. Burbank, CA 82

The scoring system was based on the following criteria: responsiveness to the RFP, qualifications and experience, proposed methodology, ability to meet the scope of work, project approach, and references. Additionally, the consulting firms were asked to provide a detailed schedule and scope of work required for them to prepare the report and construction cost.

Tetra Tech, Inc., demonstrated an in-depth understanding of the project needs and provided a detailed scope of work and approach to the project. Staff recommends awarding the professional services contract to Tetra Tech, Inc., based on their experience with similar projects, and the completeness of their proposal for this project. The proposal is available in the City Clerk’s Reading File.

The requested contingency will cover the cost of unforeseen program modifications requested by the City and other permitting agencies during the development of the BPMP. This includes potential adjustments such as additional bridge evaluations, survey reports, and change order requests made by the consulting firm to complete a comprehensive evaluation of each bridge.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds are available in expenditure account M0127233-516101 (TDA Article 8 Fund) to support the recommended contract and associated project costs.

BACKGROUND

The annual overlay and slurry seal projects are an integral part of the City of Santa Clarita’s (City) Overlay and Slurry Seal Program. Each year, streets are evaluated and identified for the need for pavement preservation and rehabilitation treatments. The 2023-24 Overlay and Slurry Seal Program is divided into five projects, Overlay A, Overlay B, Overlay C, Overlay D, and Slurry Seal to resurface streets, seal cracks, and coat the surface of streets in various areas of the City. These treatments will provide a smoother ride for vehicles and reconstruct or extend the life of the roadway, depending on the type of treatment applied. The Overlay A project was awarded by City Council at the April 9, 2024, meeting. The Overlay B and Slurry Seal projects, if approved and awarded, are expected to begin construction in various areas of the City (see attached Project Street Lists) in June 2024.

The Overlay C and Overlay D projects are projected for award at a future City Council meeting.

Construction for this year’s projects will be completed concurrently to maximize the work being done during the summer season, and is anticipated to be completed by the end of November 2024. These projects support the Sustaining Public Infrastructure theme of the City of Santa Clarita’s (City) five-year strategic plan, Santa Clarita 2025.

On April 9, 2024, the City Council found the 2023-24 Overlay and Slurry Seal Program, Project M0153, categorically exempt from review under the California Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Article 19, Section 15301.

Section 15301, exempts from CEQA review projects that consist of the operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Examples include, but are not limited to, existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities. This project meets the criteria for this exemption because the 2023-24 Overlay and Slurry Seal Program will be performing repairs and maintenance to existing streets and trails.

Solicitation Process for the 2023-24 Overlay and Slurry Seal Program - Overlay B Project

An invitation to bid was prepared and published twice in The Signal newspaper, on March 7 and 14, 2024, and was posted on BidNet. A total of three bids were submitted to the City and opened by Purchasing on April 10, 2024. Each of the bids included a base bid and three alternates.

Purchasing conducted a selection process in accordance with California Public Contract Code section 20103.8 (d) which states that “the lowest bid shall be determined in a manner that prevents any information that would identify any of the bidders or proposed subcontractors or suppliers from being revealed to the public entity before the ranking of all bidders from lowest to highest has been determined.” This process was followed to ensure fairness when opening, reviewing, and determining the lowest responsive and responsible bidder.

After review of the bids by the project manager, the basis for award was determined to be the total of the base bid and two bid alternates combined.

The results of the total bids including the bid alternates are shown below:

Company Location Total Bid
Toro Enterprises, Inc. Oxnard, CA $7,714,413
All American Asphalt Corona, CA $8,458,283
C.A. Rasmussen, Inc. Valencia, CA $10,483,796

Staff recommends awarding the construction contract to Toro Enterprises, Inc., the lowest responsive and responsible bidder, in the amount of $7,714,413, which includes $4,436,360 for the base bid and $3,278,053 for the bid alternates, and authorizing a contingency in the amount of $1,542,883, for a total not to exceed $9,257,296. This contractor possesses a valid state contractor’s license and is in good standing with the Contractors State License Board. Staff reviewed the bid response for accuracy and conformance to the contract documents and found it to be complete. The bid proposal adheres to the project’s plans and specifications and is available in the City Clerk’s Reading File.

While the City maintains a Support of Local Businesses policy that can be utilized by the City Council when warranted, the City is governed by the California Public Contract Code with regard to public works project procurement. In this type of procurement, the California Public Contract Code does not permit a city to utilize a Support of Local Businesses policy and instead requires the contract be awarded to the lowest responsive and responsible bidder.

Solicitation Process for the 2023-24 Overlay and Slurry Seal Program - Slurry Seal Project

An invitation to bid was prepared and published twice in The Signal newspaper, on March 21 and 28, 2024, and was posted on BidNet. A total of three bids were submitted to the City and opened by Purchasing on April 16, 2024. The results of the bids are shown below:

Company Location Total Bid
American Asphalt South, Inc. Riverside, CA $852,524 Pavement Coatings Co. Jurupa Valley, CA $931,973 Roy Allan Slurry Seal, Inc. Santa Fe Springs, CA $1,155,493

Staff recommends awarding the construction contract to American Asphalt South, Inc., the lowest responsive and responsible bidder, in the amount of $852,524, and authorizing a contingency in the amount of $170,505, for a total not to exceed $1,023,029.

Solicitation Process for Project Inspection, Materials Testing, and Construction Support Services for the 2023-24 Overlay and Slurry Seal Program

The City Council awarded a project inspection, materials testing, and construction support services contract to Twining, Inc., on June 8, 2021. Twining, Inc., was selected through a Request for Proposal (RFP) process, which provided up to three annual renewal options, subject 9 Packet Pg. 83

to City Council approval.

Staff recommends using the third renewal option to award the contract for project inspection, materials testing, and construction support services to Twining, Inc., in the amount of $1,026,140 for the 2023-24 Overlay and Slurry Seal Program and a contingency in the amount of $102,614, for a total amount not to exceed $1,128,754. The proposal is available in the City Clerk’s Reading File.

The requested contingencies for the 2023-24 Overlay and Slurry Seal Program contracts will cover costs associated with unforeseen site conditions, such as potential utility conflicts and abandoned utilities not shown in record drawings that are often discovered during construction, as well as change order requests made by the contractor. Additional streets from the City's pre- designed inventory and streets that may need treatment due to this year’s rain will be added to the project if funds are available after construction of the original scope of work.

ALTERNATIVE ACTION
Other action as determined by the City Council.

FISCAL IMPACT

Adequate funds are available in expenditure accounts M0153233-516101 (TDA Art 8 - Street & Road Fund), M0153264-516101 (Measure R LR Fund), M0153266-516101 (Measure M LR Fund), and M0153267-516101 (SB1 Fund) to support the recommended contracts and associated project costs.
