legislative counsel’s digest
SB 937, as amended, Wiener. Development projects: permits and other entitlements: fees and charges.
The Planning and Zoning Law requires each county and each city to adopt a comprehensi ve, long-term general plan for its ph ysical development, and the de velopment of specified land outside its boundaries, that includes, among other mandatory elements, a housing element. Existing law, the Permit Streamlining Act, among other things, requires a public agenc y that is the lead agenc y for a de velopment project to appro ve or disappro ve that project within specified time periods. Existing la w e xtended by 18 months the period for the expiration, ef fectuation, or utilization of a housing entitlement, as defined, that was issued before, and w as in effect on, March 4, 2020, and that would expire before December 31, 2021, except as specified.
Existing law provides that if the state or a local agenc y extended the otherwise applicable time for the expiration, effectuation, or utilization of a housing entitlement for not less than 18 months, as specified, that housing entitlement w ould not be e xtended an additional 18 months pursuant to these provisions.
97 This bill w ould extend by 24 months the period for the e xpiration, effectuation, or utilization of a housing entitlement, entitlement for a priority residential development project, as those terms ar e defined, that w as issued before January 1, 2024, and that will e xpire before December 31, 2025, e xcept as specified. The bill w ould toll this 24-month extension during any time that the housing entitlement is the subject of a legal challenge. By adding to the duties of local officials with respect to housing entitlements, this bill w ould impose a state-mandated local program. The bill w ould include findings that changes proposed by this bill address a matter of state wide concern rather than a municipal affair and, therefore, apply to all cities, including charter cities.
The Mitigation Fee Act regulates fees for development projects, fees for specific purposes, including water and sewer connection fees, and fees for solar ener gy systems, among others. The act, among other things, requires local agencies to comply with various conditions when imposing fees, extractions, or charges as a condition of appro val of a proposed development or development project.
The act prohibits a local agenc y that imposes fees or char ges on a residential development for the construction of public impro vements or facilities from requiring the payment of those fees or char ges until the date of the final inspection or the date the certificate of occupancy is issued, whiche ver occurs first. The first, except for utility service fees, which the local a gency is authorized to collect at the time an application for utility service is received.
This bill would limit the utility service fees exception described above to utility service fees related to connections, and cap those fees at the costs incurr ed by the utility pr ovider r esulting from the connection activities.
The act authorizes a local agency to require the payment sooner than the date of the final inspection or the date the certificate of occupancy is issued, whic hever occur s fir st, if specified conditions are met, including if the fees or char ges are to reimb urse the local agenc y for expenditures pre viously made. The act e xempts units reserv ed for occupancy by lo wer income households included in a residential development proposed by a nonprofit housing developer, as specified, from the authorization to require an earlier payment, b ut authorizes a city or county to require for those e xempt units the posting of a performance bond or a letter of credit from a federally insured, recognized depository institution to guarantee payment of an y fees or 97 — 2 — SB 937
charges. The act, if a fee or charge is not fully paid prior to issuance of a building permit for construction, authorizes the local agency to require the property owner to e xecute a contract to pay the fee or char ge, as specified.
This bill would instead prohibit a local agenc y from requiring the payment of those fees or char ges until the date the certificate of occupancy is issued, and would prohibit the local agency from charging interest or other fees on an y amount deferred. The bill would remove the authorization for a local agenc y to require the payment sooner if the fees or charges are to reimburse the local agency for expenditures previously made. The bill w ould re vise the e xemption from earlier payment for units reserved for occupancy by lower income households by a nonprofit housing developer to be those by an affordable housing developer, as specified, and w ould repeal the authorization for a city or county to require the posting of a performance bond or a letter of credit for those e xempt units. The bill would repeal the authorization of the local agency to require the property owner to execute a contract to pay the fee or charge, and would instead authorize the local agency to withhold the certificate of occupancy until the fees and charges are paid. would, for priority residential development projects, as defined, prohibit a local agency form requiring payment of fees or c harges on the residential development for the construction of public improvements or facilities until the date the certificate of occupancy is issued, as specified. The bill would authorize the local a gency to r equire the payment of those fees or charges at an earlier time if certain conditions are met, except as specified.
If any fee or charge described above is not fully paid prior to issuance of a b uilding permit, the act authorizes the local a gency issuing the building permit to require the property owner to execute a contract to pay the fee or charge as a condition of issuance of the building permit, as specified.
This bill would authorize the go verning body of a local a gency to authorize an officer or employee of the local a gency to approve and execute contracts described above, and would require the local agency to post a model form of contract on its internet website prior to requiring execution of a contract under the provisions described above.
The California Constitution requires the state to reimb urse local agencies and school districts for certain costs mandated by the state.
Statutory provisions establish procedures for making that reimbursement. 97 SB 937 — 3 —
This bill would provide that no reimbursement is required by this act for a specified reason.
Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.
