CONSENT CALENDAR
CITY MANAGER APPROVAL:
DATE: November 12, 2024
SUBJECT: RIVERVIEW PROJECT - MASTER CASE 21-205
DEPARTMENT: Community Development
PRESENTER: Justin Sauder
RECOMMENDED ACTION
City Council adopt a resolution adopting the Mitigated Negative Declaration (MND) prepared for the project and approving Master Case 21-205, including Architectural Design Review 21- 025, Conditional Use Permit 21-014, Development Review 21-019, Hillside Development Review 22-001, Minor Use Permit 21-027, Oak Tree Permit 21-003, and Tract Map 83605, subject to the conditions of approval.
BACKGROUND
REQUEST
The applicant, Integral Communities, is proposing a development consisting of a residential component with 318 residential units, 22 of which will be designated as affordable in the low- income category, and a non-residential component with an approximately 127,000 square-foot light manufacturing building on the subject property. The project also includes a proposal to subdivide the subject property into five parcels with a Tentative Map that would allow for the creation of condominium lots for the residential units.
At their regular meeting of October 22, 2024, the City Council conducted a public hearing for a conformance review of the project. At that meeting, the City Council directed staff to bring the item back to their regularly scheduled meeting on November 12, 2024, with a resolution for approval.
The City Council’s motion included three additional conditions of approval. These conditions require the applicant to 1) contribute to the design of a new trail leading from the project site; 2) contribute to the completion of a museum located at Hart Park; and 3) contribute to the Affordable Housing Fund.
A resolution, along with draft conditions of approval are attached to the agenda packet. An in- depth project description and analysis may be found in the staff reports for the July and September Planning Commission meetings, as well as the agenda packet for the October 22, 2024, City Council meeting (available in the City Clerk’s reading file).
ENVIRONMENTAL
Initial Study Mitigated Negative Declaration
The project is subject to the California Environmental Quality Act (CEQA). An Initial Study/Mitigated Negative Declaration (IS/MND) was prepared for the project by SWCA Environmental Consultants (SWCA) and circulated for a public review period from June 25, 2024, to July 16, 2024. The draft IS/MND identified the seven areas as having impacts that, with mitigation, would be less than significant. Attached is the Draft Final MND with responses to comments that were received. All impacts identified and studied by the MND were determined to be less than significant or less than significant with mitigations.
CONCLUSION
Based on City Council discussion at the October 22, 2024, meeting, staff has drafted the necessary findings for approval, along with the draft conditions of approval in Exhibit A of the draft resolution.
