CITY OF SANTA CLARITA
AGENDA REPORT
PUBLIC HEARINGS
CITY MANAGER APPROVAL:
DATE: January 28, 2025
SUBJECT: ATIVO SENIOR LIVING OF SANTA CLARITA TAX EQUITY AND
FISCAL RESPONSIBILITY ACT (TEFRA) HEARING
DEPARTMENT: Administrative Services
PRESENTER: Amy Seyerle
RECOMMENDED ACTION
City Council conduct a public hearing and adopt a Tax Equity and Financial Responsibility Act resolution approving the issuance of tax-exempt obligations by the California Public Finance Authority in an aggregate principal amount not to exceed $130 million and by Arizona Industrial Development Authority in an aggregate principal amount not to exceed $170 million to finance or reimburse the acquisition and construction costs by ISF Ativo Holdings LLC of a 140-bed rental senior living community.
BACKGROUND
The California Public Finance Authority (CalPFA) is a joint exercise of powers authority created under the California Joint Powers Authority Act for the purpose of issuing tax-exempt and taxable conduit bonds for public and private entities throughout California. The California Public Finance Authority is empowered to promote economic, cultural, and community development opportunities that create temporary and permanent jobs, affordable housing, community infrastructure, and improve the overall quality of life in local communities. They issue bonds on behalf of their members, which includes the City of Santa Clarita (City), and to nonprofit and private entities within the members' geographical jurisdictions where public benefit projects are proposed to be located.
Section 147(f) of the Internal Revenue Code of 1986 requires that, in order for the interest on such tax-exempt conduit bonds to be excluded from gross income to investors for federal income tax purposes, the applicable elected representatives of the host governmental unit must approve the issuance of such bonds. This hearing and approval process is referred to as a "TEFRA" hearing, after the Tax Equity and Fiscal Responsibility Act of 1983, the regulations for which were promulgated under the Tax Code changes of 1986.
1 Packet Pg. 7
The City received a request to conduct a TEFRA public hearing under and in accordance with Section 147(f) of the Internal Revenue Code, in order for (a) CalPFA to issue tax-exempt revenue bonds (California Bonds) in an aggregate principal amount not to exceed $130 million and (b) the Arizona Industrial Development Authority (AZIDA) to issue tax-exempt bonds (Arizona Bonds, and together with California Bonds, the Bonds) in an aggregate principal amount of $170 million, of which all of the California Bonds and $20 million of the Arizona Bonds will be issued on behalf of ISF Ativo Holdings LLC (Borrower) the sole member of which is Integrated Senior Foundation, a 501(c)(3) organization.
The Arizona Industrial Development Authority is a nonprofit corporation and political subdivision of the State of Arizona. The Arizona Industrial Development Authority is a conduit issuer of municipal revenue bonds with the ability to assist private and public borrowers across the country. The AZIDA was created pursuant to A.R.S. §35-701 – 733 and is empowered to issue its bonds to provide funds for the financing or refinancing of the costs of the acquisition, construction, improvement, equipping or operating of a “project,” as defined in the AZIDA statute, such as the senior living project referenced below.
The proceeds from the sale of the Bonds will be loaned to the Borrower and used to finance or reimburse the costs of acquisition, construction, expansion, remodeling, renovation, improvement, furnishing, and/or equipping of a 140-bed independent living, assisted living and memory care community for residents who are age 65 or older at 16330 Village Way, Santa Clarita, to be known as Ativo Senior Living of Santa Clarita (Facility). This new construction project is part of the Sand Canyon Plaza Mixed Use Project (Master Case 14-077), which was approved by the City Council on September 12, 2017, with a revision by the City Council on December 12, 2023.
The primary financing for the Facility will be through the issuance of bonds by CalPFA. The financing of the Facility is happening concurrently with the financing of two other facilities in Arizona. As such, bonds will be issued through AZIDA for the two Arizona facilities. There is a possibility, due to financial considerations, that a small portion of subordinate bonds issued through AZIDA will be used for the Facility. If that is the case, the TEFRA documents also reference the AZIDA issuance.
The Bonds would be tax-exempt private activity bonds for purposes of the Internal Revenue Code and, as such, require the approval of the elected body of the governmental entity having jurisdiction over the area where the Facility to be financed is located. The approval and adoption of the resolution authorizing the issuance of the Bonds will not require the City to be financially obligated, liable, or provide any financing for the Facility. The City's credit and bond ratings are not at risk by adopting this resolution and no City revenues are at risk by this bond issuance.
In order for CalPFA and/or AZIDA to issue such Bonds, the City must (1) conduct a public hearing allowing members of the public to comment on the proposed Facility and the Bonds, and (2) approve the CalPFA’s and AZIDA's issuance of Bonds on behalf of the Borrower for the proposed financing. Although the CalPFA and AZIDA, as applicable, not the City, will be the issuer of the tax-exempt revenue bonds for the Facility, the financing cannot proceed without the City, as the governmental entity having jurisdiction over the site, approving the Bonds.
For this item, the Borrower selected CalPFA and AZIDA as the financing agencies. As a result 1 Packet Pg. 8
of the Borrower selecting CalPFA, the City will receive a positive fiscal impact from CalPFA's Community Benefit Program. This program provides for 15 percent of the annual administrative fee paid by the Borrower to be allocated to the City, which is an amount of up to $2,925 anticipated in year one, reducing to zero as the bonds are paid down. The annual amount received by the City is contingent upon the principal amount after issuance.
Participation by the City will not impact the City's appropriations limits or constitute any type of indebtedness by the City. Once the City holds the required public hearing and adopts the required resolution following the public hearing, no other participation of the City in the actions of the CalPFA or in the financing will be required.
Approval pursuant to this resolution does not constitute any other approval by any commission or agency of the City with respect to any other City regulatory or other requirements, such as building permits, in connection with the Facility.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
The City is to receive on an annual basis, over the anticipated 35-year life of the California Bonds, 15 percent of the administrative fee that ISF Ativo Holdings LLC pays to CalPFA annually. Since the administrative fee is 1.5 basis points or .015 percent of the outstanding bond principal, the City is estimated to receive an amount of up to $2,925 in year one, reducing annually as the bonds are paid down. The funds will be deposited to General Fund Miscellaneous Revenues (100-462101).

DEPARTMENT: Community Development
PRESENTER: David Peterson
RECOMMENDED ACTION
City Council:
1. Conduct a public hearing to consider Appeal No. 24-005, an appeal of a Planning Commission decision on October 1, 2024, approving a recreational vehicle metal garage, subject to conditions;
2. After receiving testimonial and written evidence from the public hearing, adopt a resolution denying Appeal 24-005 and upholding the Planning Commission’s October 1, 2024, decision; and
3. Take other action as determined by the City Council.
BACKGROUND
REQUEST
On October 1, 2024, the Planning Commission considered an appeal challenging the Hearing Officer’s approval of a project for a second accessory structure in the rear yard of an existing single-family home. The Planning Commission voted 5-0 to deny the appeal and affirm the Hearing Officer’s approval of the project with new conditions of approval that the applicant must provide landscaping to screen the project along the southern (side) property line. After the conditions of approval were finalized (at the Planning Commission’s direction and approval), Mr. Eugene D. Nelson (appellant), appealed the Planning Commission decision to the City Council.
2 Packet Pg. 15
PROJECT DESCRIPTION
The approved project consists of an 810 square-foot, prefabricated metal garage to be used as RV parking for the existing residence. Dimensionally, it is 17-feet, 6-inches tall, 45-feet long, and 18-feet wide. The height of the proposed structure does not exceed the height of the 19-foot-tall existing primary structure. The location of the garage would be 15 feet from the western (rear) property line and five feet from the southern (side) property line, consistent with the requirements of the Santa Clarita Municipal Code (SCMC). The walls and roof of the structure would be painted to be consistent with the primary residence. An aerial map depicting the location of the site, a site plan indicating the location of the proposed garage, and the elevations of the garage are attached for reference.

ORIGINAL SUBMITTAL AND APPEAL
Submittal
On January 16, 2024, the applicant, Stephen J. Bradley, filed a request for an Administrative Permit (AP) and a Minor Use Permit (MUP) for a second accessory structure in the rear yard.
The proposed accessory structure is a new prefabricated RV metal garage. The current rear yard also includes a detached car garage that was permitted in 2000. The application was deemed complete on February 14, 2024.
2 Packet Pg. 16
On March 6, 2024, a public notice was circulated to surrounding property owners providing a 15-day comment period, in accordance with the requirements of the SCMC. During the noticing period, City of Santa Clarita (City) staff received letters, generated by neighbors, objecting to the request. Of the letters received, only one requested an Administrative Hearing. The letter requesting the hearing cited concerns about consistency with the PCSSD, an oak tree adjacent to the property, and the structure’s architecture.
Administrative Hearing
On May 6, 2024, an Administrative Hearing was held before a Hearing Officer and was attended by approximately seven members of the public. The Hearing Officer received the staff presentation, opened the public hearing, and received comments from the applicant, and four of the public attendees who spoke in opposition to the project. Key concerns raised by the public speakers were regarding the material of the structure, that the structure does not align with the purpose of the PCSSD, a lack of screening from the adjacent property, and inconsistencies in how the City reviews similar projects. After conducting the hearing, the Hearing Officer approved the project with an additional condition of approval, that requires landscaping in the rear yard to screen the proposed structure from the neighbor to the west of the project site.
Planning Commission Appeal
On May 20, 2024, the City received an appeal statement and payment of the applicable fee (Appeal 24-002), appealing the Hearing Officer’s approval of the project to the Planning Commission. The appeal justification statement identified the following concerns and matched those made to the Hearing Officer by the appellant:
1. A concern that the proposed structure is not consistent with the PCSSD because it does not enhance the surrounding neighborhood;
2. A concern regarding an oak tree adjacent to the subject’s property;
3. A concern that the accessory structure’s proposed architecture is not consistent with code requirements; and
4. A concern that the structure is a modular building for nonresidential use and requires additional regulations.
Section 17.07.040 of the SCMC (Initiation of Appeals) requires that a request for appeal must specifically state whether:
1. A determination or interpretation is not in accord with the purposes of this code (SCMC); or
2. It is claimed that there was an error or abuse of discretion; or
3. The record includes inaccurate information; or
4. A decision is not supported by the record.
The appellant asserts that the approval determination or interpretation is not in accord with the purposes of the SCMC. The appellant has not provided further specific documentation to support the basis of the appeal.
2 Packet Pg. 17
Planning Commission Action
On October 1, 2024, the Planning Commission conducted a public hearing to consider the appeal. The Planning Commission received staff’s presentation; opened the public hearing, and received comments from the applicant and members of the public. After closing the public hearing, the Planning Commission voted 5-0 to adopt Resolution No. 24-15, which denied Appeal 24-002 and upheld the Hearing Officer’s approval of the proposed project. A copy of the Planning Commission’s staff report is available in the City Clerk’s reading file.
In addition to affirming the project approval, the Planning Commission added two new conditions of approval to the project. The Planning Commission’s intent for the new conditions were to address the visibility of the structure and the noise concerns from the appellant’s property. The conditions of approval added by the Planning Commission are as follows:
“PC1. Before the Building Official issues a building permit, the permittee must provide a final landscape screening plan to the Director (the “Screening Plan”) that includes existing landscaping located on the adjacent property. The Screening Plan must ensure that the permittee’s accessory structure is uniformly screened from view of the adjacent property to the extent practicable, to the Director’s satisfaction. The Screening Plan must be designed with the plant palette suitable for Santa Clarita (Sunset Western Garden Book Zone 18, minimum winter night temperatures typically 20º to 30º F; maximum summer high temperatures typically 105º F to 110º F) and generally complement the plants included in the landscape screen of the adjacent property. The plants proposed in the screening plan must be acceptable to the City’s Urban Forestry Division as well as the Los Angeles County Fire Department.
PC2. Before the Building Official issues a final certificate of occupancy, the permittee must install landscaping in the Screening Plan (if any) and provide a surety to the Director, in a form approved by the City Attorney, to secure maintenance of the Screening Plan for two years. The surety amount will be calculated based upon the value of the existing adjacent landscape screening as determined by the Director.”
Note that the language for these new conditions was finalized based upon specific Planning Commission direction, but was drafted following the meeting. The final form of these conditions was released on October 15, 2024.
Appeal to City Council
After the Planning Commission hearing and decision, the City received one appeal letter and an email in support of the appeal on October 16, 2024. A hearing was scheduled before the City Council to consider the appeal request made by Eugene D. Nelson (Appeal 24-005). The decision of the City Council is a final decision; any subsequent appeal must be made to the Superior Court.
Before the appeal was filed, both the applicant and appellant received a draft copy of the new conditions of approval added by the Planning Commission. The applicant and the appellant both 2 Packet Pg. 18
expressed their concerns of the new conditions. The applicant has concerns of being responsible for landscaping on the neighboring property.
A copy of the appeal letter is attached to this report for the City Council’s review. In summary, the appeal letter states the appellant’s concerns that:
• The project does not comply with the SCMC or General Plan; • The two conditions of approval added by the Planning Commission are contradictory to the Planning Commission’s direction to staff; and
• There is an abuse of power in the discretionary process.
RESPONSE TO APPEAL
Consistency with the SCMC
The project site is an existing residential site with a primary home and an accessory garage.
Based on the zoning, the proposed MUP is required to allow for a second accessory residential structure. The proposed residential accessory structure meets the requirements of rear and side setbacks, distance between main and accessory structures, and the height for accessory structures of the UR1 zone.
Santa Clarita Municipal Code § 17.57.040(D) – the code section relied upon by the appeal – is for nonresidential uses or structures in a residential zone. Relying upon this code section, therefore, is misplaced in this case. The SCMC requirements for residential structures and the project proposal are summarized in Table 2, below:
Table 2 – Existing and Proposed Project Requirements
UDC Requirements
SCMC
Section
Description Requirement Applicants Plans
17.33.010 Side yard setback, each side (in feet) 5/5 5
17.33.010 Rear yard setback (in feet) 15 15
17.33.010 Maximum height of accessory structures not exceeding the height of the main structure without a CUP (in
feet)
35 17.5
To address concerns regarding the oak tree adjacent to the subject property, the City’s oak-tree specialist conducted a site visit on March 26, 2024, and determined there would be no impact on the oak tree given the project would not create any further ground disturbance under the oak tree.
The proposed accessory structure would be built on the driveway that exists on the project site.
Accordingly, an Oak Tree Permit is not required.
To be consistent with the primary structure on-site, the proposed accessory structure uses a pitched roof, does not exceed the height of the primary structure, and would be finished with a smooth panel painted to match the colors of the primary structure.
2 Packet Pg. 19
ENVIRONMENTAL STATUS
The City reviewed the environmental impacts of the proposed project pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq.; “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). Per CEQA Guideline §15303, activity that results in new construction or conversion of small structures is exempt. The proposed structure qualifies as a Class 3 exemption because the proposal includes the construction of an accessory structure.
PUBLIC NOTICING
On January 7, 2025, as required by SCMC Sections 17.06.110 and 17.24.120 (D), public notices regarding the proposed project were mailed to all property owners and residents within 1,000 feet of the project site, and all parties requesting notification regarding the project. In addition, a notice was published in The Signal newspaper. On January 14, 2025, a notice of public hearing sign was posted on the project site.
The original requests for an administrative hearing, along with other correspondence received before the administrative hearing are attached. As of the writing of this staff report, two comments have been received before the City Council hearing. All requests and comments are attached for reference.
CONCLUSION
The proposed use is consistent with the PCSSD, the SCMC, would not endanger the public, and is physically suited for the subject site. Therefore, staff has drafted the necessary findings for approval of a MUP as set forth in SCMC Section 17.24.120, subject to the attached Conditions of Approval in Exhibit A of the draft resolution.

THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. FINDINGS OF FACT FOR MASTER CASE 24-008. The City Council makes the following findings of fact:
A. An application for Master Case 24-008 (Minor Use Permit 24-003 and Administrative Permit 24-003) was filed by Stephen Bradley (applicant), with the City of Santa Clarita (City) on January 16, 2024. The property for which this application was filed is located at 24715 Aden Avenue, Assessor’s Parcel Number 2834-033-015 (subject site).
B. The application was deemed complete on February 14, 2024.
C. The applicant proposes to construct a second accessory structure on a single-family site at 24715 Aden Avenue. The site currently has a detached garage that was permitted in 2000.
The project would construct an 810 square-foot detached prefabricated recreational vehicle garage that is 17-feet, 6-inches tall, 45-feet long, and 18-feet wide.
D. The zoning and General Plan designation for the subject site is Urban Residential 1 (UR1). The site is further located in the Placerita Canyon Special Standards District (PCSSD).
E. The surrounding land uses include existing single-family residences north, east, south and west.
F. On March 17, 2024, Eugene D. Nelson (appellant), filed a letter requesting an administrative hearing for Master Case 24-008.
G. On May 6, 2024, a duly noticed administrative hearing was held before the City of Santa Clarita Hearing Officer at 1:00 p.m. at The Centre, Oak Room, 20880 Centre Pointe Parkway, Santa Clarita, CA 91350.
H. At the administrative hearing, the Hearing Officer considered the staff report, the staff presentation, the applicant presentation, and public testimony, and approved Master Case 24-008, determining that it was consistent with the City’s objective standards for an accessory structure project. At the hearing, a condition of approval was added that the applicant must provide landscaping to screen the accessory structure along the rear

property line.
I. On May 20, 2024, the appellant filed an appeal (Appeal 24-002), and payment of the appeal fee, appealing the Hearing Officer’s approval to the Planning Commission.
J. On October 1, 2024, a duly noticed public hearing regarding the appeal was held before the City of Santa Clarita Planning Commission at 6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita.
K. At this public hearing, the Planning Commission considered the staff report, the staff presentation, the applicant presentation, and public testimony. At this hearing, two conditions of approval were added that the applicant must provide landscaping to screen the accessory structure on their neighbors’ property along the applicant’s side property line.
L. On October 16, 2024, the appellant filed an appeal (Appeal 24-005), and payment of the appeal fee, appealing the Planning Commission’s approval to the City Council.
M. On January 28, 2024, a duly noticed public hearing regarding the appeal was held before the City Council at 6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita.
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS. The City reviewed the environmental impacts of this Project under the California Environmental Quality Act (Public Resources Code § 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. § 15000, et seq., the “CEQA Guidelines”). Based upon the foregoing facts and findings, the City Council finds as follows:
A. The project is exempt from additional review under the CEQA Guidelines §15303 as a Class 3 New Construction or Conversion of Small Structures categorical exemption. A Class 3 exemption consists of projects characterized as the construction and location of limited numbers of new, small facilities, or structures;
B. The documents and other materials that constitute the record of proceedings upon which the decision of the City Council is based is the Master Case 24-008 project file, located within the Community Development Department and in the custody of the Director of Community Development;
C. Based upon the findings set forth above, the City Council finds the Notice of Exemption for this Project was prepared in compliance with CEQA; and
D. This resolution and its findings are made based upon the evidence presented to the City Council at its October 1, 2024, hearing, including, without limitation, the Staff Report submitted by the Community Development Director.
SECTION 3. GENERAL FINDINGS FOR MASTER CASE 24-008. Based on the foregoing facts and findings for Master Case 24-008, the City Council determines as follows:
2.a
Packet Pg. 23
Attachment: Resolution (Second Accessory Structure Appeal)
A. That the proposal is consistent with the General Plan.
The proposed land use is consistent with the General Plan’s Land Use Element and the zoning designation of Urban Residential 1 (UR1). The UR1 General Plan designation is meant for single-family homes and associated uses. With the approval of an Administrative Permit and Minor Use Permit, the accessory structure would be permitted on the project site.
B. The proposal is allowed within the applicable underlying zone and complies with all other applicable provisions of the SCMC.
The proposed second accessory structure is permitted with an MUP pursuant to Santa Clarita Municipal Code (SCMC) §17.57.040. If approved, as part of the MUP the applicant would be required to comply with the Conditions of Approval (Exhibit A) which would ensure that the proposal would comply with all provisions of the SCMC. As proposed, the accessory structure complies with all setbacks, height, and design standards for an accessory structure in the UR1 and PCSSD.
C. The proposal will not endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, safety, or general welfare, or be materially detrimental or injurious to the improvements, persons, property, or uses in the vicinity and zone in which the property is located.
The proposed second accessory structure would not include any hazardous materials and would not require the handling of, or use of, any hazardous materials. The applicant is required to comply with all applicable law for a residential accessory structure. There are no anticipated impacts to persons, property, or uses in the vicinity and zone. Further, similar structures are located throughout the PCSSD.
D. The proposal is physically suitable for the site. The factors related to the proposal’s physical suitability for the site shall include, but are not limited to, the following:
1) The design, location, shape, size, and operating characteristics are suitable for the proposed use;
The subject property includes an existing 2,950 square-foot single-family home and an existing 979 square-foot accessory detached garage. The proposed project includes adding a second accessory structure. The design, location, shape, size, and operating characteristics of the project site are suitable for the proposed use. The project complies with the SCMC’s requirements for residential setbacks, height, roof pitch, and consistency of colors with the primary home. Adequate space exists to access the existing and proposed garage, and all applicable law is met.
2) The highways or streets that provide access to the site are of sufficient width and are improved as necessary to carry the kind and quantity of traffic such proposal would
2.a
Packet Pg. 24
Attachment: Resolution (Second Accessory Structure Appeal)
generate;
The project would not require any street improvements and would not cause any traffic-related impacts to the site or its vicinity. Because the daily operation of the subject property would not change, there would be no impact to the adjacent Placeritos Boulevard.
3) Public protection services (e.g., Fire protection, Sheriff protection, etc.) are readily available; and
The proposed use would be within an existing residential property, which is located within a developed area within the service area of public protection services, including those provided by the Consolidated Fire Protection District of Los Angeles County (LACFD) and Los Angeles County Sheriff’s Department (LASD). The proposal is also required to comply with all applicable requirements of the LACFD and LASD.
4) The provision of utilities (e.g., potable water, schools, solid waste collection and disposal, storm drainage, wastewater collection, treatment, and disposal, etc.) is adequate to serve the site.
The proposed use would be located within an existing residential area, which is located within a developed area with available and adequate utilities to serve the site.
SECTION 4. GENERAL FINDINGS FOR A MINOR USE PERMIT. Based on the foregoing facts and findings for Master Case 24-008, the City Council determines as follows:
A. Neither present nor anticipated future traffic volumes generated by the use of the site reasonably require strict or literal interpretation and enforcement of the specified regulation:
The proposed use is a typical residential use, to store a personal vehicle, in the UR1 zone and would not result in an increase in expected traffic volumes. The project would result in no significant impact to traffic.
B. The granting of the permit will not result in the parking or loading of vehicles in public and private streets in such a manner as to interfere with the free flow of traffic on the streets:
All parking or loading of vehicles associated with the accessory structure would occur on the subject property and not on private or public streets. Accordingly, the request would not interfere with the free flow of traffic on the surrounding streets.
C. The parking demand would be less than the requirements identified in SCMC Section
17.51.060(M):
2.a
Packet Pg. 25
Attachment: Resolution (Second Accessory Structure Appeal)
There would be no changes for parking demand as the proposed structure would be used for storage of a recreational vehicle (RV) that exists on the property.
D. That sufficient parking would be provided to serve the use intended and potential future uses of the subject property.
Sufficient parking is already provided to serve the existing property and the proposed accessory structure is not expected to increase parking demand as it will serve as a garage for an RV.
SECTION 5. APPROVALS. The City Council takes the following actions:
Appeal 24-005 is denied. The Planning Commission’s approval of a request by Stephen J.
Bradley to construct a second accessory structure (Master Case 24-008) is upheld in its entirety. Resolution No. 24-015, adopted October 1, 2024, is incorporated by reference in its entirety as if fully set forth including, without limitation, the conditions of approval adopted by the Planning Commission. There are no amendments to those conditions of approval.
SECTION 6: RELIANCE ON RECORD. Each and every one of the findings and determinations in this resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole.
SECTION 7: SUMMARIES OF INFORMATION. All summaries of information in the findings, which precede this section, are based on the substantial evidence in the record. The absence of any particular fact from any such summary is not an indication that a particular finding is not based in part on that fact.
SECTION 8: NOTICE. The City Clerk is directed to provide a copy of this resolution to the City Council and any other person requesting a copy.
SECTION 9: EFFECTIVE DATE. This Resolution becomes effective immediately upon adoption and memorializes the City Council’s final decision made on January 28, 2025.

GENERAL CONDITIONS
GC1. The approval of this project will expire if the approved use is not commenced within two years from the date of this approval, unless it is extended in accordance with the terms and provisions of the City of Santa Clarita’s (City) Unified Development Code (UDC).
GC2. To the extent the use approved with this project is a different use than previously approved for the property, the prior approval is terminated along with any associated vested rights to such use, unless such prior approved use is still in operation, or is still within the initial pre-commencement approval period. Once commenced, any discontinuation of the use approved with this project for a continuous period of two years or more terminates the approval of this use along with any associated vested rights to such use. The use may not be re-established or resumed after the two-year period.
Discontinuation includes cessation of a use regardless of intent to resume.
GC3. The permittee may file for an extension of the conditionally-approved project before the date of expiration. If such an extension is requested, it must be filed not later than 60 days before the date of expiration.
GC4. Unless otherwise apparent from the context, the term “permittee” includes the permittee and any other persons, corporation, or other entity making use of this grant. The permittee must defend, indemnify, and hold harmless the City of Santa Clarita, its agents, officers, and employees from any claim, action, or proceeding against the City or its agents, officers, or employees to attack, set aside, void, or annul the approval of this project by the City, including any related environmental approvals. In the event the City becomes aware of any such claim, action, or proceeding, the City will promptly notify the permittee. If the City fails to notify the permittee or if the City fails to cooperate fully in the defense, the permittee is not thereafter responsible to defend, indemnify, or hold harmless the City. Nothing contained in this condition prohibits the City from participating in the defense of any claim, action, or proceeding, if both of the following occur: 1) the City bears its own attorneys’ fees and costs; and 2) the City defends the action in good faith. The permittee is not required to pay or perform any settlement unless the settlement is approved by the permittee.
GC5. The permittee and property owner must comply with all inspections requirements as deemed necessary by the Director.
GC6. The project site must be developed and/or used in the manner requested and must be in substantial conformity with the submitted plans date-stamped October 1, 2024, unless revisions and/or additional conditions are specifically required herein.

All rights and obligations of this approval, including the responsibility to comply with the Conditions of Approval, are binding upon Permittee’s successors in interest. The Conditions of Approval may be modified, terminated, or abandoned in accordance with applicable law including, without limitation, the Santa Clarita Municipal Code (SCMC).
GC8. Any proposed deviations from the Exhibits, Project Description, or Conditions of Approval must be submitted to the Director for review and approval. Any unapproved deviations from the project approval will constitute a violation of the permit approval.
GC9. When exhibits and/or written Conditions of Approval are in conflict, the written Conditions of Approval prevail.
GC10. The effectiveness of this project will be suspended for the time period that any Condition of Approval is appealed whether administratively or as part of a legal action filed in a court of competent jurisdiction. If any Condition of Approval is invalidated by a court of law, the project must be reviewed by the City and substitute conditions may be imposed.
GC11. The permittee is responsible for ascertaining and paying all City fees as required by the SCMC. This condition serves as notice, pursuant to Government Code § 66020(d) that the City is imposing development impact fees (DIFs) upon the project in accordance with the Mitigation Fee Act (Government Code § 66000, et seq.) and the SCMC. The permittee is informed that it may protest DIFs in accordance with Government Code § 66020.
GC12. The permittee must sign these Conditions of Approval, as set forth below, to acknowledge acceptance, within 30 days from the date of approval by the Hearing Officer.
GC13. The City will only issue permits for the development when the construction documents (e.g., building plans) substantially comply with the approved plans. Substantial conformity is determined by the Director.
GC14. This decision is not effective until permittee acknowledges acceptance of all project conditions and any appeal period has lapsed, or a waiver of right to appeal is filed or if there is an appeal, until a final decision has been made on the appeal. By use of the entitlements granted by a development application, the permittee acknowledges agreement with the Conditions of Approval.

For demolition projects, a deposit of 10% of the estimated total project cost or $15,000, whichever is less, is required. The full deposit will be returned to the permittee upon proving that 65% of the inert and remaining C&D waste was recycled or reused.
ES3. Per the California Green Building Standards Code, 100 percent of trees, stumps, rocks and associated vegetation and soils resulting primarily from land clearing must be reused or recycled. For a phased project, such material may be stockpiled on site until the storage site is developed.
ES4. All projects within the City not self-hauling their waste materials must use one of the City’s franchised haulers for temporary and roll-off bin collection services. Please visit GreenSantaClarita.com for a list of approved haulers.

STAFF COMMENTS
City Manager Ken Striplin commented that he has communicated the community's concerns to Southern California Edison (Edison) on multiple occasions and reminded the members of the audience that California Public Utilities Commission (CPUC) governs Edison; therefore, Edison is not subject to the City's jurisdiction. He further encouraged the public to voice their concerns directly to Edison and the CPUC.
Mayor Miranda requested that Mr. Striplin provide an update on the state of wildfire danger in the City, and Mr. Striplin responded that there were no immediate concerns regarding wildfires in Santa Clarita, and the City is fully prepared to address potential wildfire danger.
COMMITTEE REPORTS/COUNCILMEMBER COMMENTS
Mayor Pro Tem Weste commented that she wanted to ensure Edison is aware of the frustration and challenges residents have been facing due to the power outages and stated she is ready to partner with Edison to achieve the completion of a power circuit urgently needed by residents.
Mayor Pro Tem Weste also shared that she and Mayor Miranda have requested an immediate meeting with Edison.
Councilwoman McLean provided several resources available to the community to assist victims of the recent California wildfires.
Councilmember Gibbs thanked staff for the well-managed Frozen on Ice event at the Cube, the Holiday Lights Tour, and the community offerings by the Food Pantry. Councilmember Gibbs then requested City Manager Ken Striplin to look into the comments made regarding traffic circulation.

BURRTEC WASTE INDUSTRIES, INC. REQUEST TO USE AN ALTERNATIVE
DISPOSAL FACILITY
This item considers the authorization of Burrtec Waste Industries, Inc. to enter into an agreement with an alternative disposal facility.
RECOMMENDED ACTION:
City Council, in accordance with the Solid Waste Franchise Agreement with Burrtec Waste Industries dated November 12, 2024, authorize the City Manager to execute such documents that may be required to confirm the City’s consent for Burrtec to utilize landfills other than the Chiquita Canyon Landfill for solid waste disposal.
Environmental Services Manager Darin Seegmiller provided the staff report.
Addressing the Council was Bruce Fortine.
Councilwoman McLean commented that none of this needed to happen, citing past meetings she attended with the Waste Management Task Force of Los Angeles County where solutions based on emerging waste control technologies were proposed to eliminate the need for landfills, but no action was ever taken. Councilwoman McLean proposed to move the item for a vote to accept the recommended action.
Councilmember Gibbs inquired about the documents that would be required to be executed, and Mr. Seegmiller responded that the recommended action was written in such a manner to permit Burrtec to enter into agreements as needed and that approval of the recommended action authorizes Burrtec to enter into those necessary agreements.

City Council discuss the Mayor Selection Process and provide direction to staff.
City Manager Ken Striplin deferred the presentation of the item to Councilwoman McLean and discussion among the members of the City Council.
Councilwoman McLean stated that her desire in bringing this item forward is to depoliticize the mayor selection process by going back to an automatic mayor rotation, the way the founding fathers wanted to do.
Councilwoman McLean made a motion to go back to the original rotation of mayor and mayor pro tem.
Council discussed the change in the mayor selection and the make-up of Council and history of the votes affecting the change in 1999; the merits of the current selection process; and that the mayor position is an honorary one, holding no more power or authority than the other four members of the Council.
Mayor Miranda commented, as a gesture of good faith, he would support Councilwoman McLean as the next Mayor Pro Tem.
Councilwoman McLean's motion died without a second.

4. Authorize the City Manager or designee to execute all contracts and associated documents, subject to City Attorney approval.
BACKGROUND
On a daily basis, City of Santa Clarita (City) staff issue permits to local businesses and residents for a wide-variety of land and building use-related activities throughout the City. The land- management system, also referred to as the permitting system, utilized to manage these permits 7 Packet Pg. 81
is a hosted software solution known as Accela, Inc. (Accela). In 2015, the City Council approved a five-year contract valued at $2.1 million with Accela to facilitate the issuance of permits for all parcels, buildings, land-use, and other development/building activity in the City. The contract included one-time costs associated with implementation and data migration, project contingency, and three years of annual support, hosting, and maintenance. Subsequently in March 2020, the City Council approved a five-year contract valued at $1,064,495 for annual licensing and support, which is set to expire March 2025.
This item seeks City Council’s authorization to enter into a new contract with Accela for a three- year term, with two optional one-year renewals which, if exercised, shall bring the contract total to an amount not to exceed $1,524,723, inclusive of the total five percent contingency. The total cost includes user licensing and hosting fees, support and maintenance, and upgrades and feature enhancements throughout the term of the agreement. Continuing with Accela for the City's land management system ensures uninterrupted service continuity, avoids costly data migration and retraining, and eliminates potential disruptions to critical operations. The recommendation to remain with Accela is the most practical and cost-effective decision for a new contract at this time.
Since the system went live in November 2017, the City has issued more than 44,000 permits with construction valued at over $2.9 million and resulted in more than 240,000 inspections. Major features of Accela include:
• Ability for citizens to create, apply, and pay for permits online without the need to visit City Hall in person;
• Automated workflows provide streamlined experience for citizens, contractors, and daily internal users when performing plan checks, assessing and collecting fees, and issuing permits and certificates of occupancy;
• Integrated electronic document review tied to parcel information; • Web-based system allowing for remote management from any location/device with internet connectivity;
• Inspector mobile application for signing off inspections onsite; and • Ability to integrate Community Preservation cases to keep track of any issues that need to be addressed prior to any new permitting.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
Upon approval of the recommended actions, the annual cost to support this contract will be amended with additional ongoing budget appropriations in expenditure account 1002200-516101 (General Fund – Technology Services) as follows: $24,456 in Fiscal Year 2024-25; $10,139 in Fiscal Year 2025-26; $13,359 in Fiscal Year 2026-27; and $9,351 in Fiscal Year 2027-28.
Contingent upon the execution of the renewal options, appropriate $4,676 in Fiscal Year 2027- 28, and $14,728 in Fiscal Year 2028-29.
7 Packet Pg. 82
Upon approval of the recommended action, the budget will be adjusted accordingly. Funds for future fiscal years are contingent upon appropriation of monies by the City Council during the annual budget process.

CITY MANAGER APPROVAL:

SUBJECT: RESOLUTION FOR SUMMARY VACATION OF LANDSCAPE
MAINTENANCE EASEMENT ON MONARCH RIDGE DRIVE
DEPARTMENT: Administrative Services
PRESENTER: Andrew Adams
RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of the landscape maintenance easement at 19608 Monarch Ridge Drive, as described in the attached Legal Description Exhibits.
2. Direct City Clerk to record the certified original resolution in the County of Los Angeles Registrar-Recorder's office.
BACKGROUND
A landscape maintenance easement located at 19608 Monarch Ridge Drive (Tract Map No. 48108) was dedicated to the City of Santa Clarita’s (City) Landscape Maintenance District (LMD) and recorded on September 9, 1996. The dedication of this maintenance easement provides access for the City to maintain landscape improvements located within LMD Zone 5 (Sunset Hills).
The owner of the subject property has applied with the Planning Division for an Oak Tree Permit under Master Case (MC24-090) to construct a garden wall, steps, and new landscaping in the backyard of the property. The applicant currently owns the land in fee, but it is currently encumbered by the existence of the above-referenced LMD maintenance easement. The easement proposed for summary vacation encompasses approximately 2,075 square feet of excess area primarily inclusive of slope segments, mature vegetation, and landscaped areas that do not interfere with LMD operations or require ongoing maintenance.
The existing easement exclusively serves the landscape maintenance district and supports no additional public purpose. Staff has determined that the easement is no longer needed by the 8 Packet Pg. 84
LMD for its operations. A legal description has been prepared by the property owner identifying the area proposed for vacation. If the City Council approves the vacation of the easement, the property owner will be required to submit all necessary documents for the easement vacation, including any revised site plans; obtain appropriate permits; and assume responsibility for the maintenance of all private landscape improvements within the vacated area as outlined in the Conditions of Approval under MC24-090.
Per Section 8333 of the California Streets and Highways Code, the legislative body of a local agency may summarily vacate a public service easement if the easement has been determined to be excess by the easement holder and there are no other public facilities located within the easement. Based on these conditions, staff has determined the subject easement to be excess and eligible for vacation.
In accordance with the City's adopted fee schedule for landscape maintenance easement vacations, the cost for this service is $1,125, which would increase Special Districts Fund (Fund 357) revenue account 357-462101 by that amount.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
The approval of this action would result in an increase of $1,125 to the Special Districts Fund (Fund 357) revenue account 357-462101.

CITY MANAGER APPROVAL:
DATE: January 28, 2025
SUBJECT: ESTABLISH NO STOPPING ZONES ON THE NORTH SIDE OF
OAKHURST DRIVE, SOUTH OF DOCKWEILER DRIVE
DEPARTMENT: Public Works
PRESENTER: Joel Bareng
RECOMMENDED ACTION
City Council:
1. Adopt a resolution to establish a 115-foot and a 255-foot No Stopping Any Time zones on the north side of Oakhurst Drive, south of Dockweiler Drive.
2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.
BACKGROUND
The City of Santa Clarita (City) received a request by residents to investigate the impacts of parked vehicles on traffic circulation at the curvature of Oakhurst Drive between Dockweiler Drive and Oakleaf Canyon Drive. Oakhurst Drive is a residential street with houses fronting the south side of the street only. Currently, there is an existing 30-foot No Stopping Any Time zone on the north side of the street for community mailboxes approximately 645 feet south of Dockweiler Drive.
Staff conducted a field review and determined parked vehicles on the north side of the road make it challenging for two-way traffic to navigate this curved section of the roadway because traveling vehicles could cross into the oncoming traffic lane to avoid parked vehicles. It was determined that expanding No Stopping Any Time zones will improve traffic safety and circulation. The proposed segments listed below and shown in the attached location map:
• North side of Oakhurst Drive from 530 feet south of Dockweiler Drive to 645 feet south connecting to the existing 30-foot No Stopping Any Time zone (645 feet south to 675 feet south of Dockweiler Drive)
9 Packet Pg. 90
• North side of Oakhurst Drive from 720 feet south of Dockweiler Drive to 975 feet south.
In addition, a double yellow center line will be installed in this section to clearly identify roadway lanes. Staff contacted the homeowner’s association management company for this community by phone and in writing and received a favorable response for creating the No Stopping Any Time zones.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
The resources required to implement the recommended action are contained within the City of Santa Clarita's adopted Fiscal Year 2024-25 budget; funds are available in expenditure account 2304504-514108 (Street Maintenance/Traffic Signs and Markings).

CITY MANAGER APPROVAL:
DATE: January 28, 2025
SUBJECT: 2025 CITYWIDE ENGINEERING AND TRAFFIC SURVEY -
PROFESSIONAL SERVICES CONTRACT
DEPARTMENT: Public Works
PRESENTER: Joel Bareng
RECOMMENDED ACTION
City Council:
1. Award a contract to AGA Engineers, Inc., for the 2025 Citywide Engineering and Traffic Survey, in an amount not to exceed $98,065.
2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval.
BACKGROUND
California Vehicle Code (CVC) Section 22357 requires posted speed limits along public roadways be established and justified by an Engineering and Traffic Survey (Survey). Per CVC Section 40802, in order for posted speed limits to be enforceable by radar or laser, the Survey needs to be updated every five years to ensure speeds reflect current conditions. The Survey can be extended to seven years if local law enforcement meets certain criterion relating to the training and calibration of radar/laser devices. Los Angeles County Sheriff’s Department (Sheriff’s Department) meets this criterion; therefore the City’s Survey is valid for seven years.
The last Citywide Survey was completed in October 2018 and adopted in February 2019.
Conducting the Citywide Survey is vital to the continued use of radar or laser enforcement by the Sheriff’s Department. Without a valid Survey, Los Angeles County Superior Court will not uphold a speeding violation issued by the Sheriff’s Department in which radar or laser enforcement is utilized. In addition, if radar or laser is not used, the Sheriff’s Department must rely on less effective alternatives, such as pacing speeding offenders.
The scope of work for this project includes an accident rate analysis, field review, speed surveys, and a final Engineering and Traffic Survey report.
10 Packet Pg. 95
The City conducted a Request for Proposal (RFP) to solicit proposals from qualified consulting firms to provide professional services for the 2025 Citywide Engineering and Traffic Survey.
The RFP was published and circulated via the City’s e-procurement system, BidNet, on October 1, 2024. The City transmitted the solicitation to 1,249 vendors on BidNet, of which 37 vendors downloaded the RFP. A total of five companies provided proposals for consideration.
These proposals were reviewed and evaluated based on each company’s ability to meet the specific needs of the City. An evaluation panel comprised of staff from the Public Works Department scored the responses using the following categories of weighted criteria:
• Thoroughness of proposal, approach to providing sound services, and ability to provide services to meet objectives and standards (30 points)
• Project Team/Qualifications of Staff and Firm experience on similar projects (30 points) • Approach and Scope of Work (30 points)
• References (10 points)
The evaluation panel scored the responses based on a 100-point scale, with the results outlined below:
Rank Company Location Score
1 AGA Engineers, Inc. Fullerton, CA 95
2 Willdan Engineering Industry, CA 92
3 Linscott, Law & Greenspan, Engineers Pasadena, CA 90 4 LIN Consulting, Inc. Diamond Bar, CA 88
5 EPD Solutions, Inc. Irvine, CA 75
In reviewing proposals, the evaluation panel awarded the highest score to AGA Engineers, Inc (AGA). The evaluation panel determined that AGA’s proposal offered the best overall value to meet the project needs.
AGA demonstrated an in-depth understanding of the project needs and provided a detailed scope of work and approach to the project. Based on its experience on completing similar projects, and the completeness of its proposal for this project, staff recommends awarding the professional services contract to AGA. The proposal is available in the City Clerk’s Reading File.
California Government Code Section 4526 prescribes the selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required and does not authorize the selection of professional architect and engineering services based on cost. City staff was able to reach an agreement with AGA at a fair and reasonable price.

SUBJECT: 2025 COMMUNITY SERVICES AND ARTS GRANTS
DEPARTMENT: Recreation and Community Services
PRESENTER: Noely Allevato
RECOMMENDED ACTION
City Council:
1. Approve the 2025 Community Services and Arts Grants Committee’s program funding recommendations in an amount not to exceed $100,000 for Community Services Grants and $100,000 for Arts Grants, for a total not to exceed $200,000.

BACKGROUND
The City of Santa Clarita (City) has provided funds for nonprofit organizations through the Community Services and Arts Grants program for approximately 35 years. Each year, a Grants Committee (Committee) is assembled to determine funding categories, review and rate applications, and make funding recommendations for community service and arts projects throughout Santa Clarita.
This year’s Committee included Mayor Bill Miranda; Mayor Pro Tem Laurene Weste; former Parks, Recreation, and Community Services Commission Chair Jonathan Waymire; Arts Commission Chair Patti Rasmussen; and three City staff members from across the City Manager’s Office, Recreation and Community Services, and Public Works departments. The Committee, with the exception of Arts Commission Chair Patti Rasmussen, is responsible for reviewing and rating the community services applications.
All applications under the arts categories were reviewed and rated by a separate Peer Review Rating Panel, which included the following members:
