The award of contract, if made, will be to the lowest responsive BIDDER determined solely by the AGENCY.
The AGENCY also reserves the right to add/delete the quantities to the existing bid items, or delete the entire bid item if they are found not required by the Agency during the course of the construction, or add new bid items or scope of work by Contract Change Order at any time during the project up to the last contract working day.
All bids, including all pricing, shall be effective/valid for a minimum period of 120 calendar days after the date of bid closing. In the event a final contract has not been awarded within this period, the City reserves the right to negotiate extensions to this period.
The BIDDER agrees to hold all unit prices in this Alternate Bid Schedule constant throughout the duration of the project up to the last contract working day.
