12 compressed gas cylinders, the majority are carbon dioxide which are not flammable. Welding gases are used to reduce heat during the weld process and are not flammable. Carbon Dioxide is commonly used in many applications, as an example it's an ingredient in soft drinks and soft drink dispensing machines.
e. Flammable materials are stored in very small quantities in safety containers per OSHA standards. Virtually all in such small quantities that they are not required reportable to EHS. A list of these materials was provided to the planning staff during the investigation phase, and is a nonissue.
f. To clarify, other than propane and welding tanks, reportable levels of hazardous materials are not stored at the property. Per company's permit with Santa Barbara County Health/Hazmat (CUPA) the company is required to have a documented plan if a raw material spills on the ground. The plan must include allocated space for storage of the cleaned up spilled material.
Our facility map identifies this location. Hazardous waste is defined as any usable material that once spilled is no longer usable. Examples are: motor oil, paint, glue, propane, vehicle fluids, etc.
An example of a possible company spill that would convert the materials to hazardous waste would be consumer grade latex paint. If spilled on the ground, after cleanup it would be stored in the designated space until being properly disposed.
6. Visual Impact Low: One storage yard is visible from Boone Street. The Boone street view onto the storage yard is a narrow 25 foot wide view looking through public parking, between the building and the block wall, a full 95 yards from Boone. The plan to screen this yard is with a tan painted sea container.
The storage yard that is visible from third floor windows of the four tenants at Hancock Terrace apartments consist of faux branches comprised of green pine and eucalyptus types. which of any proposed outdoor storage use this would be the highest aesthetically pleasing in the city — in fact, these are required by the city to make towers aesthetically acceptable. The residence of Hancock Terrance were aware prior to lease signing of the industrial property adjoining the property because it existing prior to the apartments construction and is highly visible while driving past or using Internet mapping tools. The operation of the business in no way impedes the tenants ability to use and enjoy what they have leased. This is evident in that no complaints have been filed by the property owner or tenants.

WHEREAS, the Planning Commission of the City of Santa Maria held a duly noticed public hearing on December 15, 2021, for the purpose of receiving evidence and considering U2021-0004. The Planning Commission expressed concerns regarding aesthetic impacts resulting from the facility's unscreened outdoor storage areas as viewed from the upper floors of the adjacent Hancock Terrace Apartments. The Planning Commission continued the item to a future hearing date with direction for staff to provide information regarding the types of other businesses and uses on the property and their conformity with the Downtown Specific Plan; and
WHEREAS, the Planning Commission of the City of Santa Maria held a duly noticed public hearing on February 16, 2022, for the purpose of receiving additional evidence and considering U2021-0004. The Planning Commission heard and considered all evidence including the presentation by the applicant, evidence in the staff report, and all written and oral testimony, and voted by motion (4-1-0-0 vote) that staff return on April 6, 2022, with a Resolution and findings to deny U2021-0004; and WHEREAS, the Planning Commission of the City of Santa Maria held a duly noticed public hearing on April 6, 2022, for the purpose of receiving evidence and considering U2021-0004, where the Planning Commission by Resolution No. 2809 denied said permit on a 4-0-0-1 vote; and
WHEREAS, CPS filed an appeal of the Planning Commission denial of the CPS's application U2021-0004 on April 20, 2022; and
WHEREAS, the City Council of the City of Santa Maria held a regularly scheduled public hearing on August 2, 2022, for the purpose of considering the appeal of the Planning Commission denial of U2021-0004; and
WHEREAS, notices of said public hearing were made at the time and in the manner required by law; and
WHEREAS, at the public hearing, the City Council heard and considered all evidence, including evidence presented orally, in writing, and in the staff report; and WHEREAS, the California Environmental Quality Act (CEQA) does not apply to projects that a public agency rejects or disapproves in accordance with Section 15270 of the CEQA Guidelines, and no further environmental review is required; and WHEREAS, the City Council does not find error in the Planning Commission's findings for denial of the Conditional Use Permit. The City Council finds as follows:
1) The project does not meet the vision, intent, and requirements of the General Plan. The City of Santa Maria General Plan Land Use Element states that land use conflicts arise when development causes undesirable environmental consequences that affect the surrounding neighborhood such as: noise, dust, traffic congestion and related parking conflicts, lighting, visual or aesthetic impacts, odor, and drainage problems. The Land Use Element identifies industrial operations immediately adjacent to residential neighborhoods as an example of a significant land use conflict. The proposed industrial project is located immediately adjacent to residential neighborhoods and is identified per the Land Use Element as a significant land use conflict. As discussed in #3 and #4 below, the project's industrial operations will result in adverse effects to residents living near the project site due to noise, dust, fumes, aesthetic/visual impacts, and potential traffic issues resulting from the project's operations.
Therefore, the project is not consistent with the requirements of the General Plan Land Use Element.
2) The proposed use will have adverse effects upon abutting property. The CPS project is an existing industrial land use that is not consistent with the surrounding residential character of the area which is comprised of single- family residences and apartments. The project site is located immediately adjacent to the Hancock Terrace Apartments and directly across the street from a single-family residential subdivision on Boone Street. Residents living in this area may be adversely affected by the project's industrial operations that have the potential to create noise, dust, and fumes resulting from frequent welding activities that require the use of flammable compressed gases, and from the adhesives, paints, and plasters used in the assembly of the faux cellular towers. These operations, and the storage of hazardous and flammable materials within the existing fabrication shop, occur within 2 approximately 150 feet of the Hancock Terrace Apartments. In addition, frequent truck trips delivering and picking up industrial materials to and from the site may expose adjacent residents to noise, exhaust fumes, and traffic congestion on Boone Street, which already experiences congestion due to the high usage of this roadway by residents living in the adjacent apartments and surrounding residences.
3) The establishment, maintenance, and/or conducting of the use for which the planned development review is sought will, under the circumstances of the particular case, be detrimental to the health, safety, morals, or welfare of persons residing or working in the neighborhood of such use and will, under the circumstances of the particular case, be detrimental to the public welfare, injurious to property or improvements in the neighborhood, and shall be inconsistent with the character of the neighborhood and contrary to its orderly development.
The project site is located immediately adjacent to the Hancock Terrace Apartments, and directly across the street from a single-family residential subdivision on Boone Street. The CPS project is an existing industrial land use that is not consistent with the surrounding residential character of the area.
Residents living in this area may be adversely affected by the project's industrial operations, such as noise, dust, and fumes resulting from welding that requires the use of flammable compressed gases, and from the adhesives, paints, and plasters used in the assembly of the faux cellular towers. These operations, and the storage of hazardous and flammable materials within the existing fabrication shop, occur within approximately 150 feet of the Hancock Terrace Apartments. Residents living near the project site are also frequently exposed to large trucks delivering and picking up materials from the property, including 15- to 45 -foot -long metal cellular tower concealment sections and faux tree sections. While delivering or picking up materials at the site, trucks may idle for periods of time creating exhaust fumes and noise that could be detected by residents living adjacent to the site. Traffic congestion may also occur from trucks obstructing vehicular traffic on Boone Street, which already experiences congestion due to the high usage of the roadway by residents living in the Hancock Terrace Apartments and surrounding residences.
The 15- to 45 -foot -long cellular concealment sections, faux tree sections, and other industrial materials used in the business operations, including seatrains, are stored onsite in outdoor storage areas throughout the property. The storage areas are visible from Boone Street and surrounding residential properties. The Hancock Terrace Apartments includes multiple three-story buildings that face east onto the project site. The project location, including storage areas, are highly visible from the upper stories of the apartments. The project includes screening measures to address public views from Boone Street and adjacent rights -of -ways. However, the outdoor storage areas in the rear of the site would not be screened from view from the upper floors of the adjacent apartments.
3 Therefore, under the circumstances of this particular case, conducting the proposed use at this location will be detrimental to the health, safety, and welfare of people residing at this location and in the neighborhood and will be detrimental to the public welfare. The inability to screen the project operations from the upper floors of the apartments would result in a project that creates a negative aesthetic and is inconsistent with and contrary to the orderly development of the existing residential neighborhood. In -addition, the resulting adverse effects to adjacent residents from noise, traffic congestion, and aesthetic impacts is inconsistent with the residential character of the neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Maria, California, that:
SECTION 1. The above recitals are true and correct and incorporated herein by this reference.
SECTION 2. The City Council denies the appeal and affirms the Planning Commission denial of Conditional Use Permit U2021-0004; and SECTION 3. The City Council adopts the findings contained in Planning Commission Resolution 2809, incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Santa Maria held this 2nd day of August 2022.
