SUBJECT: CERTIFICATION OF THE NOVEMBER 8, 2022, GENERAL MUNICIPAL
ELECTION AND REORGANIZATION OF THE CITY COUNCIL
RECOMMENDATION:
That the City Council:
1) Adopt a Resolution reciting the fact of the General Municipal Election held on November 8, 2022, in conjunction with the Statewide General Election and accepting the County Clerk -Recorder's certificate of the results of the official canvass; and
2) Follow standard procedures to reorganize the City Council.
BACKGROUND:
In order to reduce costs and ensure increased voter turnout, the City of Santa Maria consolidates its General Municipal Elections with the Statewide General Election conducted by the County of Santa Barbara. A Consolidated General Municipal Election was held on November 8, 2022, in accordance with State law to elect two members of the City Council for four-year terms, one each in the District 3 and District 4.
The County Clerk -Recorder had 30 days following the election to complete the ballot count and certify the election results. The City Council must then accept the County Clerk - Recorder's certification of the election.
DISCUSSION:
The County Clerk -Recorder completed the canvass of the election in 30 days. The County Clerk -Recorder certified the results of the election on December 7, 2022, and provided the City Clerk's office with a copy on that date.
The Certified Election Results confirm that in:
1. City Council District 3 — Gloria Soto received 1,730 votes, the majority of the votes cast, and is re-elected as a Member of the City Council for District 3 for the full term of four years; and
2. City Council District 4 — Maribel Aguilera-Hernandez received 3,175 votes, the majority of the votes cast, and is elected as Member of the City Council for District 4 for the full term of four years.
Once the City Council has accepted the County Clerk -Recorder's canvass of the election, the following standard procedure for reorganizing the City Council will take place:
1. Comments will be made by outgoing Councilmember Waterfield.
2. Councilmember Waterfield will step down from the dais.
3. Chief Deputy City Clerk White will then swear in re-elected District 3 Councilmember Gloria Soto and newly elected District 4 Councilmember Maribel Aguilera-Hernandez, and present each with a Certificate of Election.
4. The newly elected officers will take their seats and be given an opportunity to speak.
5. A 10 -to -15 -minute recess will be declared so that the new officers may be congratulated, and refreshments will be served.
6. The meeting will be reconvened, and continue with the regular agenda items.
This procedure is consistent with past practices and, procedures. The formal seating of the newly elected officers allows the public an opportunity to meet and identify the new members.
Fiscal Impact:
While the actual cost of the election will not be known for at least another 60 days, it is anticipated that consolidating with the Statewide General Election for two ballot types (District 3 and District 4 voters will cost the City approximately $36,000, versus approximately $150,000 for a stand-alone election. Funding for the General Municipal Election was included in the 2022-23 budget.
Impact to the Community
Voting for elected officials is one of the core rights and privileges afforded individuals by the Constitution. Although it is required by State law, formally swearing -in newly elected officials during the City Council meeting provides an opportunity for the public to become acquainted with the officials who will be governing the City for the next four years.

2 RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA,
CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, IN CONJUNCTION WITH THE STATEWIDE GENERAL
ELECTION AND ACCEPTING THE COUNTY CLERK -RECORDER'S CERTIFICATE OF
THE RESULTS OF THE OFFICIAL CANVASS
WHEREAS, a General Municipal Election was held and conducted in the City of Santa Maria, California, on Tuesday, November 8, 2022, in conjunction with the Statewide General Election; and
WHEREAS, a notice of the election was given in the time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted; that votes were cast, received, and canvassed; and the returns made and declared in the time, form, and manner as required by the provisions of Santa Maria Municipal Code §2-25.02 and the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the Santa Barbara County Elections Department canvassed the returns of the election; a Statement of Results of Election has been prepared by the Chief Deputy City Clerk (Exhibit A) and the County Elections Department has certified the results to the City Council (Exhibit B).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MARIA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts, excluding vote - by -mail ballots and provisional ballots was 340 (District 3) and 656 (District 4), respectively.
That the total number of vote -by -mail ballots and provisional ballots cast in the City was 3,331 (District 3) and 5,884 (District 4), respectively, making the total of 10,211 ballots cast for both Districts in the City of Santa Maria.
SECTION 2. That the names of the persons voted for at the election for a Member of the City Council for District 3 as follows:

SECTION 3. That the names of the persons voted for at the election for a Member of the City Council for District 4 as follows:

Maribel Aguilera-Hernandez

SECTION 3. The number of votes given in the City to each of the persons named ; above for the respective offices for which the persons were candidates, and the number of votes given at each precinct are attached (Exhibits B and C, respectively).
SECTION 4. The City Council does declare and determine that Gloria Soto was re- elected as Member of the City Council for District 3 for the full term of four years.
SECTION 5. The City Council does declare and determine that Maribel Aguilera- Hernandez was elected as Member of the City Council for District 4 for the full term of four years.
SECTION 6. The Chief Deputy City Clerk shall enter on the records of the City Council of the City, a statement of the results of the election showing: 1) the whole number of ballots cast in the City; 2) the names of the persons voted for; 3) for what office each person was voted for; and 4) the number of votes given at each precinct to each person (Exhibit A).
SECTION 7. That the Chief Deputy City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the Chief Deputy City Clerk and authenticated; that the Chief Deputy City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it, and file it in the office of the City Clerk. Each and all persons so elected shall then be inducted into the respective office to which they have been elected.
SECTION 8. That the Chief Deputy City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
SECTION 9. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary. 2 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Santa Maria held on this 20th day of December 2022.
