Prepared by: Director of Public Works
AWARD OF BID FOR THE PEDESTRIAN SAFETY AND ACCESSIBILITY IMPROVEMENT PROJECT, BID NO. 2023/02
RECOMMENDATION:
That the City Council adopt a Resolution awarding a bid to V. Lopez Jr & Sons for the construction of the Pedestrian Safety and Accessibility Project, Bid No. 2023/02.
BACKGROUND:
This project consists of improving the safety and accessibility of the existing pedestrian facilities network by focusing on areas where improvements are needed most and all work necessary to render the facilities complete and operational. In the City of Santa Maria's Active Transportation Plan (ATP), many community members voiced that walking is their most used method of transportation. Furthermore, most survey respondents explained that they live within the low -to -moderate income areas, captured within the Census Block Group data as required for the Community Development Block Grant (CDBG) funded portion of this project. Gaps in continuous, safe, and accessible sidewalks are the primary reason walking is avoided by those who expressed concerns about walking as a means of transport.
In addition to CDBG funds, other funding sources are being utilized for improvements to concrete facilities in other areas of the City that qualify for use under the Alternative Transportation Enhancements program of Measure A. Such improvements include upgrades to sidewalks, curbs, ramps, driveways, and curb and gutter on streets that would receive an asphalt overlay with a future project.
This project includes, but is not necessarily limited to, all work zones shown on the City of Santa Maria Drawings Figure 1 (Attachment C) and location the listing in the Concrete Survey (Attachment D).
DISCUSSION:
The Project was extensively advertised for bids. The City received four bids which were opened by the City Clerk's Office on January 24. 2023. A summary of the bids submitted are as follows:
Bidder
Grand Total Bid
V. Lopez Jr & Sons
$1,272,500
JJ Fisher Construction, Inc.
$1,274,400
JF Will Company, Inc..
$1 666,030
Granite Construction
$1,906,041
Environmental Determination
The City of Santa Maria Planning Office determined the project is exempt from CEQA Guidelines (Article 19, Section 15301, Class 1) because the scope of work being conducted is routine concrete maintenance, which qualifies for the "existing facilities" exemption under CEQA.
Alternatives
The recommended action is to award the bid of $1,272,500. There were no additive alternative bid items included in this project.
The alternative to the recommended action would be to reject all bids. The low bid is approximately 1.5 percent above the Engineer's estimate. The low bid received is responsive to the City's Request for Bids, and the low bidder is well regarded having completed Public Works projects for the City in the past.
Fiscal Considerations
Sufficient funds for this project have been budgeted from the accounts titled "Various Street Improvements", "Alternative Transportation Enhancements", and "Public FDA/ADA and Pedestrian Safety." The funding sources are from the U.S. Department of Housing and Urban Development CDBG and the Santa Barbara County Association of Governments (SBCAG) Measure A Program for Alternative Transportation Enhancements.

Impact to the Community
About 48 percent of ATP survey respondents reported walking directly from home to another destination 4 or more days per week. School and shopping were the most reported destinations, followed by recreation. When the City undertook the development of the ATP, the City Public Works team, in collaboration with a variety of community stakeholders (school districts, YMCA, Boys & Girls Club, nonprofit CAUSE, etc.) had a primary goal to engage the public and discuss alternative mobility needs within the City. Most of the 2 individuals surveyed live within the neighborhoods of low -to -moderate -income households in Santa Maria. They expressed numerous concerns about the safety and deficiencies in the existing pedestrian network, issues relating to gaps in the existing sidewalk (55 percent), missing ADA curb ramps, and uplifted and damaged sidewalk creating hazards (34 percent), among other comments related to the City's pedestrian user network. Among the 20 respondents who reported they use an assistive mobility device, 5 use a wheelchair or mobility scooter, 4 use a walker or crutches, 1 use a service dog, 1 use a sighted guide, and 9 said they use some other assistive device. Other individuals have messaged the Public Works team directly with their needs for ADA curb ramp installations and concerns about uplifted sidewalks creating hazards for themselves or a disabled family member.
This project will mobilize the legwork produced by the newly furnished ATP and target low - to -moderate income areas to improve their pedestrian network experience. This project will make the streets safer and less stressful for students walking to schoolindividuals commuting by foot, as well as help with accessibility to those otherwise unable to use their sidewalk facilities due to deficiencies and hazards in the existing network.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA, CALIFORNIA, AWARDING A BID TO V. LOPEZ JR & SONS FOR THE
CONSTRUCTION OF THE PEDESTRIAN SAFETY AND ACCESSIBILITY PROJECT, BID NO. 2023/02
WHEREAS, the City of Santa Maria formally advertised the Pedestrian Safety and Accessibility Project, Bid No. 2023/02 ("Project"); and WHEREAS, the Notice Inviting Bids was published and posted in compliance with applicable sections of the Public Contract Code; and
WHEREAS, the bids were publicly opened at 2:00 p.m. on January 24, 2023, in City Hall; and
WHEREAS, V. Lopez Jr & Sons was determined to be the lowest responsive, responsible bidder who included all required documentation, bid bonds, and signatures; and WHEREAS, the City of Santa Maria Planning Office determined the project is exempt from CEQA Guidelines (Article 19, Section 15301, Class 1) because the scope of work being conducted is routine concrete maintenance, which qualifies for the "existing facilities" exemption under CEQA.
WHEREAS, sufficient funds for this budgeted project in FY 22/23 are located in the accounts titled "Various Street Improvements", "Alternative Transportation Enhancements", and "Public FDA/ADA and Pedestrian Safety."
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. The Mayor is hereby authorized and directed to execute, for and on behalf of the City of Santa Maria, an Agreement with V. Lopez Jr & Sons for the Pedestrian Safety and Accessibility Improvement Project, Bid No. 2023/02; and
2. The award of the bid is conditional upon execution of the Agreement by the successful bidder in the form and terms set forth therein by the City; and
3. The City Manager, or designee, is hereby authorized and directed to designate funds from the following identified accounts: "Various Improvements," "Alternative Transportation Enhancements," and "Public FDA/ADA and Pedestrian Safety" for the approved project in the amount of $1,272,500; and
4. The City Manager, or designee, is hereby authorized to approve Contract Change Orders so long as expenditures do not exceed funding approved for the project; and
5. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Santa Maria held this 215t day of February 2023.
