FOR THE COUNCIL MEETING OF APRIL 4, 2023

COUNCIL AGENDA REPORT
TO: City Council
FROM: City Manager
Prepared by: Director of Finance
SUBJECT: USER FEE UPDATE
RECOMMENDATION:

That the City Council adopt a Resolution approving the addition and update of User Fees identified in the Annual User Fee Update and Proposed User Fee Schedule.

BACKGROUND:
"User fee" activities are defined as services the City provides to individuals who receive some material benefit from these services. The user fee philosophy holds that the cost of providing these services should be borne by the group receiving the benefit, not the community as a whole. User fee services are differentiated from general public benefit services, such as police and fire which are largely tax -supported. For the most part, City fees should be set at full cost recovery to avoid subsidizing activities of specific groupsfindividuals. However, to promote activities and actions, fees may be set at less than full cost recovery. An example of subsidizing a service to benefit the community is the establishment of swimming fees at less than full cost recovery to promote exercise and good health.

In October 2019, after a competitive Request for Proposal process, the City contracted Revenue and Cost Specialists (RCS) to conduct a year -long comprehensive study of services provided by the City and to develop user fees that represent "full cost" recovery as allowed by law. On May 4, 2021, based on the 2020 Comprehensive Fee Study, the City Council adopted a master fee resolution increasing fees, effective July 1, 2021, to 50 percent of the increase of the Cost of Study proposed fees. In addition, the City Council adopted a User Fee Cost Recovery Level Policy with a goal for full cost recovery of user fees by July 2026.

Most recently the City, with consultation from RCS, has completed an Annual User Fee Update Report (Report) for City Council consideration based on the 2020 Comprehensive Fee Study, using updated salary and position data and the Fiscal Year 2021-22 budget.

DISCUSSION:

The City contracted with RCS to update user fees annually. In the calendar year 2022, and every even year forward, RCS will conduct a review of the City's user fees, updating the City's Cost Allocation Plan (CAP), salary, position data, and adopted budget. RCS met with City staff to discuss the addition, removal, and/or adjustment of user fees.

This round of recommended fee updates by RCS is more complex than a typical across- the-board increase in fees. The suggested user fees from this Report are grouped into six categories.

1. New Fees — Existing User Fee Does Not Exist for the Service Provided.

2. Increase to Phase -In and Full Cost Recovery Options — Based on Updated Budget and CAP.

3. Increase to Full Cost Recovery Immediately to Fully Recover Outside Costs, or Fee is Percent of Another Fee.

4. Increase to Full Cost Recovery Immediately.

5. Unchanged — Current Fee is already at Full Cost Recovery or Limited by State Laws.

6. Unchanged — Updated Solid Waste Fees were recently adopted.

City staff met with the Developer Stakeholders in November 2021. City staff gave the opportunity for local planning experts to share thoughts, concerns, and ideas regarding planning user fees. On February 13, 2023, City staff met a second time with the Developer Stakeholders to discuss new planning user fees and to provide an update to the Public Improvement Inspection fee that had a significant change to percentages applied to the value of the project. Stakeholders provided comments and concerns regarding the new fees. Staff reviewed those fees again and agreed that modification to the Amend General Plan/Zoning, Zoning Change, and Specific Plan Amendment fees was warranted and these have been updated in the Report.

The Report generally recommends recovering the full cost of providing each fee -related service and calculates the potential revenues if the City Council approves fees at full (100 percent) cost -recovery levels. However, with the exception of Library Room Rental fees, Library fees did not change because the current fees are at full cost recovery. In addition, no changes to Recreation and Parks program or facility rental fees are recommended at this time. It should also be noted that staff is recommending no increases to building plan check and inspection (permit) fees, as overall, current fees are at full cost recovery. Their current fees are included in the Proposed User Fee Schedule (Attachment B) so that the City Council may simply adopt a master fee resolution. Lastly, fees for some services, such as services for special public events, cannot be determined until the service is provided and for that reason are not itemized on the proposed fee schedule. Rather, it is noted that fees that are not itemized on the fee schedule will be charged at a fully allocated rate for the position providing the service.

Staff recommends the adoption of the user fees, effective July 1, 2023, based on the Full Cost Recovery Fee as shown in the Report, Attachment B, and summarized in the table below, which shows the potential revenue growth of $2,714,400. The table also shows the current tax subsidies of $3,298,053. Most of these services are performed by General Fund staff; therefore, the collection of these fees reimburses the City's General Fund.

Services provided under the Utilities Services category are perforated by Utilities staff, and fees collected will be recorded in the appropriate Water, Wastewater, or Solid Waste funds.

RCS calculated the full cost of services, presented in the Report as a full cost recovery fee, and a phase -in cost recovery fee, which is generally a 50 percent increase from the current fee to the full cost recommendation. The phase -in cost recovery fees are provided as a suggested alternative should the City Council not agree with the staff recommendation of full cost recovery. It should also be noted, for those fees in categories three through six, the phase -in fees and full cost recovery fees are the same to allow the City Council to choose a column when setting the fees. Regardless of what percent cost recovery the City Council choose in the phase -in, these group of fees (categories three through six) are recommended to be set at 100 percent cost recovery.

The chart below illustrates potential additional revenue based on the phase -in cost recovery fees and full cost recovery fees.

The City is recommending a simple Consumer Price Index update for 2024-25 fiscal year, followed by a user fee study update in 2024 to calculate full cost recovery fees for consideration and incorporation into the 2025-26 fiscal year.

Alternatives
The City Council can choose to adjust fees to less than the full cost recovery or implementing new fees over more than one year. If the City Council chooses not to 3 increase the new fees at this time, the City will continue to subsidize personal -choice services with City tax dollars of about $3,269,346.

Fiscal Considerations
The overall fiscal impact is $1.6 million to $2.7 million in additional revenue, depending on which group of fee increase, phase -in or full cost recovery, the City Council adopts.

Impact to the Community
Charging appropriate fees lessens subsidies and increases overall resources to provide general services to the public.

ATTACHMENT A

Project Introduction
RCS was selected by the City of Santa Maria to update its user fees annually. This year, and every even year forward, RCS will conduct a review of the City's user fees, updating the City's Cost Allocation Plan (CAP), salary and position data, and adopted budget. RCS will also meet with City staff to discuss the addition, removal and/or adjustment of user fees. On odd numbered years, RCS will perform a simple CPI Update of user fees.

On May 4, 2021, the Santa Maria City Council adopted a master fee resolution increasing fees, effective July 1, 2021, to 50 percent of the increase of the Cost of Service Study proposed fees. In addition, the City Council set the goal to attain full (100%) cost recovery of fees by 2026.

This round of fee update by RCS is more complex than a typical across-the-board increase of fees. The suggested user fees from this Study could be grouped in six categories below. 1) New Fees - Existing User Fee Does Not Exist for the Service Provided 2) Increase to Phase -In and Full Cost Recovery Options - Based on Updated Budget and CAP 3) Increase to Full Cost Recovery Immediately to Fully Recover Outside Costs, or Fee is Percent of Another Fee
4) Increase to Full Cost Recovery Immediately - Due to Utility Fund Legal Requirements 5) Unchanged - Current Fee is Already at Full Cost Recovery or Limited by State Laws 6) Unchanged - Updated Solid Waste Fees were Recently Adopted For this Study, RCS calculated the full cost of services using the FY 2021-22 budget, employee costs, and an updated Cost Allocation Plan. We presented this in the study as the suggested full cost recovery fee.

RCS also included in our study a suggested phase -in cost recovery fee, which is generally a 50% increase from the current fee to the full cost recommendation.

The overall fiscal impact is $1.6 Million or $2.7 Million in additional revenue, depending on which group of fee increase the City adopts.

Annual User Fee Update for the City of Santa Maria, March 2023

2) Increase to Phase -In and Full Cost Recovery Options - Based on Updated Budget and CAP This second group represents 143 fees out of the total 247 evaluated by RCS. These fees are recommended to increase from the current fee to achieve full cost recovery immediately after adoption, or phasing -in through multiple updates. The calculated full cost of services includes updated salaries, operational budgets and Cost Allocation Plan.

Back in May 2021, the City Council adopted updated user fees which were increased to 50 percent of the increase of Cost of Service Study proposed fees. In the chart below, the Phase -In Cost Recovery column is an additional 50% increase between the current fee and full (100%) cost recovery. With the City's goal to achieve 100% cost recovery by 2026, the City Council may immediately adopt fees at the suggested 100% cost recovery, RCS's phase -in cost recovery, or any other percentage desired.

3) Increase to Full Cost Recovery Immediately to Fully Recover Outside Costs or Fee is Percent of Another Fee
While the second group of fees above provide the City with flexibility to adopt fees at any percentage toward the goal of 100% cost recovery, RCS recommends this group of fees change to 100% cost recovery immediately rather than incrementally. Some of these fees are to reimburse for outside costs, such as advertising and engineering services, and there is little to no benefit for the City to subsidize these costs.

Other fees in this group are calculated based on another fee. Since many of the current fees are subsidized, further subsidizing the fees below would leave to a greater loss of cost recovery.

Therefore, the column of the suggested Phase -In Cost Recovery fees below is the same as the Full Cost Recovery column. This allows the City Council to simply select either column to adopt. Regardless of what percent cost recovery the City choose in a phase -in, this group of fee should be set at 100% cost recovery.

4) Increase to Full Cost Recovery Immediately - Due to Utility Fund Legal Requirements Water and Wastewater fees are rates are dictated by State laws, which does not allow the subsidy to one user, while overcharging another. Therefore, water and wastewater fees for services should be adopted at 100% cost recovery, allowing for no subsidy to anyone. The suggested Phase -In Cost Recovery Fee column below presents the fees similar to the Full Cost Recovery Fee column. This allows the City Council to simply select either column to adopt.

Annual User Fee Update for the City of Santa Maria, March 2023

6) Unchanged - Updated Solid Waste Fees were Recently Adopted Some of the City's solid waste fees and rates were adjusted during the comprehensive fee study in January 2020. The City Council adopted additional fee and rate adjustments in October 2021, increasing the fees again within a short timeframe. Another round of fee adjustment may confuse or frustrate users, therefore we recommend no changes to solid waste fees. RCS calculated updated solid waste fees, and they can be approved at a later time.

The Suggested Phase -In Cost Recovery column below presents the fees at 100%, exactly like the Suggested Full Cost Recovery column. This allows the City Council to simply select either column to adopt.
