RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MARIA, CALIFORNIA, ACCEPTING AN EASEMENT FOR PUBLIC
UTILITY PURPOSES ALONG THE NORTHERLY PROPERTY LINE OF
LOT 1 LLA PER INSTRUMENT NUMBER 2015-0058928
WHEREAS, Betteravia Plaza, Tract 6008 Final Map was adopted and approved by City Council on October 15, 2019, and a dedication of public utility easement and right- of-way was recorded; and
WHEREAS, following private negotiation and mutual agreement between the developer of Betteravia Plaza, Tract 6008 Lots 1 and 2, and Community Health Centers of the Central Coast Inc. (CHC), Dan Blough Drive right -of-way dedication and abandonment is proposed to better align Dan Blough Drive across Western Avenue; and
WHEREAS, CHC, proposes to dedicate a public utility easement along the northerly property line of APN 117-330-100 for access to the public water line located on APN 117-330-100; and
WHEREAS, the property owner of Lot 1 and 2 of Betteravia Plaza, Tract 6008, has prepared a legal description and exhibit of area to grant an easement to the City and paid all applicable fees to process the recordation of the easement; and
WHEREAS, the City Surveyor has reviewed the legal description and exhibit of the area to be summarily vacated and found both to be technically correct; and
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. That the public utility easement, as shown in Exhibits A and B, is approved and accepted by the City of Santa Maria.
2. That from and after the date this Resolution is recorded with the Santa Barbara County Clerk-Recorder, the public utility easement as shown in Exhibit A and described in Exhibit B shall constitute a public utility easement; and
3. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall con sult with the City Manager and City Attorney concerning any changes deemed necessary.
