RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MARIA, CALIFORNIA, SUMMARILY VACATING A PORTION OF
EXISTING RIGHT-OF-WAY DEDICATION OVER LOTS 1 AND 2 OF
BETTERAVIA PLAZA FINAL MAP, TRACT 6008
WHEREAS, the Streets and Highways Code §8333(c) permits summary vacation because the easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement; and
WHEREAS, the property owner of Lot 1 and 2 of Betteravia Plaza, Tract 6008, has prepared a legal description and exhibit of area to be summarily vacated and has paid all applicable fees to process the abandonment; and
WHEREAS, the City Surveyor has reviewed the legal description and exhibit of the area to be summarily vacated and found both to be technically correct; and
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. That the portion of the existi ng right-of-way, as shown in Exhibit B-1, is summarily vacated pursuant to Streets and Highways Code, Part 3, Chapter 4, §8333(c).
2. That from and after the date this Resolution is recorded with the Santa Barbara County Clerk -Recorder, the right-of-way as shown in Exhibits A -1 and described in Exhibit B-1 shall no longer be or constitute a public utility easement; and
3. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
