FOR THE COUNCIL MEETING OF OCTOBER 17, 2023

COUNCIL AGENDA REPORT

TO: City Council

FROM: Interim City Manager
Prepared by: Director of Public Works Brett Fulgoni

SUBJECT: Acceptance of Public Waterline Easements along West Street

Description:

The City Council will consider accepting public waterline easement dedications along West Street for the installation of an 8 -inch waterline for the multi -family residential property located at 310 West Street. Mr. Gautam purchased this property in 2016, and it requires tenant improvements, therefore acceptance of the easements for water purposes will allow the continued development of Mr. Gautam’s property.

Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

RECOMMENDATION:

Adopt a Resolution accepting an easement for water purposes on West Street, along the southerly portion of APN 118 -020-004 and along the southerly portion of APN 118 -020- 006.

BACKGROUND:

West Street is a private street located just south of West Carmen Lane and adjacent to South Thornburg Street. An existing two-inch water main presently serves the residential homes on West Street. The waterline was installed prior to the annexation of West Street to the City of Santa Maria and is presently sub -standard. Property owner, Mr. Rupak Gautam, seeks to install a waterline to serve his property in accordance with City Standards and requests the consideration of the City Council for the acceptance of easements for water purposes.

DISCUSSION:

In 2016, Mr. Gautam purchased a partially completed multi -family residential pr operty located at 310 West Street. The residential property requires tenant improvements in addition to City Standard Utilities to service the property. Public Works/Engineering City Standards require that an 8 -inch waterline shall serve all multi -family and commercial properties. To accommodate the construction of the waterline, easements from adjacent property owners and the acceptance of the easements by the City Council are required.

2 After a lengthy period of negotiations with adjacent property owner s, the grant of easements for the installation of the waterline was recently acquired.

Acceptance of the easements for water purposes will allow the continued development of Mr. Gautam’s property at 310 West Street.

Alternative(s)
City Council may elect to not accept the proposed easements for water purposes. The impact would result in Mr. Gautam's inability to develop his property.

Fiscal Considerations
There are no significant fiscal considerations anticipated with the proposed actio n. Mr.

Gautam has paid the required fees for staff time to review and record these documents.

Impact to the Community
The proposed grant of easement for water purposes shall allow the construction of City Standard waterline public improvements in an area where sub-standard improvements exist. This will result in improved water flows and future placement of fire protection improvements for the benefit of the residents along a portion of West Street.
