RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MARIA, CALIFORNIA, ACCEPTING AN EASEMENT FOR WATER
PURPOSES ON WEST STREET, ALONG THE SOUTHERLY PORTION
OF APN 118-020-004 AND ALONG THE SOUTHERLY PORTION OF
APN 118-020-006.
WHEREAS, the City Council has the authority to accept offers of easement dedications for the establishment of public improvements; and
WHEREAS, easements for the establishment of City Standard public improvements are necessary for utilities to serve the general public; and
WHEREAS, the property owners of APN 118 -020-004 (Exhibit A) and APN 118- 020-006 (Exhibit B) have approved the grant of easements for water purposes to the City and the applicant seeking acceptance of the easements has paid all applicable fees to process the recordation; and
WHEREAS, the City Surveyor has reviewed the legal description and exhibit of the easements and found them to be technically correct; and
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. That the easements for water purposes , as shown in Exhibits A and B, are approved, and accepted by the City of Santa Maria.
2. That from and after the date this Resolution is recorded with the Santa Barbara County Clerk-Recorder, the easements for water purposes as shown in Exhibit A and Exhibit B shall constitute a public utility easement; and
3. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
