A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MARIA, TO ADOPT AN ADDENDUM TO THE FINAL SECOND
SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT PREPARED FOR
THE SANTA MARIA REGIONAL LANDFILL CELL 1 EXTENSION
PROJECT PHASE II
WHEREAS, the provisions of the California Environmental Quality Act (CEQA) of 1970, Public Resources Code Sections 21000 et. seq., as amended, require the evaluation of environmental impacts in connection with discretionary projects; and
WHEREAS, on December 7, 1993, the City Council adopted Resolution 93 -178 certifying a Final Environmental Impact Report for the Santa Maria Regional Landfill Facility Permit Update Project to address the amendments to the Solid Waste Facility Permit to expand the existing landfill area with fills up to 360 feet in height; and
WHEREAS, on September 5, 1995, the City Council adopted Resolution 95 -178 certifying the Final Supplemental E nvironmental Impact Report to develop a transfer station on the landfill property and transport the solid waste to up to 60 miles; and
WHEREAS, on May 1, 2001, the City Council adopted Resolution 2001 -65 adopting the Addendum to the Final Supplemental Environmental Impact Report to address cover material for the landfill and use of inactive areas for recreational purposes; and
WHEREAS, on July 20, 2004, the City Council adopted Resolution 2004-144 certifying the Second Final Supplemental Environmental Impact Report that addressed moving facilities to accommodate waste disposal in the lined landfill future area, increasing the height of the previous active landfill area to 362.5 feet, and implementation of a sports complex on the inactive portion of the landfill; and
WHEREAS, on July 3, 2018, the City Council adopted Resolution 2018 -75 adopting the Addendum to the Second Final Supplemental Environmental Impact Report to increase the height of the landfill to 410 feet; and
WHEREAS, on April 20, 2021, the City of Santa Maria adopted Resolution 2021- 32 adopting the Addendum to the Second Final Supplemental Environmental Impact Report to update the Santa Maria Regional Landfill facility permit to ex tend the 36-acre Cell 1 area by 9.5 acres; and
WHEREAS, in 2023, the City of Santa Maria initiated an Addendum to the Second Final Supplemental Environmental Impact Report to update the Santa Maria Regional Landfill facility permit to extend the 45.5-acre Cell 1 area by 15.6 acres; and
WHEREAS, an Addendum to the Se cond Final Supplemental Environmental Impact Report for the Santa Maria Regional Landfill Facility permit update project was prepared in accordance with CEQA Guidelines Section 15164; and 2 WHEREAS, the proposed project would not result in any new significa nt impacts that were not evaluated in the previously certified Second Final Supplemental Environmental Impact Report; and
WHEREAS, the previously certified Second Final Supplemental Environmental Impact Report is adequate for the purposes of compliance w ith CEQA because no substantial changes are proposed in the project which will require major revisions to the previously certified Second Final Supplemental Environmental Impact Report ; no substantial changes will occur with respect to the circumstances under which the project is undertaken that would require major revisions to the previously certified Second Supplemental Environmental Impact Report ; and no new information of substantial importance has been identified which was not known at the time that the previous Second Supplemental Environmental Impact Report was certified; and
WHEREAS, the City Council of the City of Santa Maria held a regularly scheduled public hearing on December 5th, 2023, for the purpose of considering a doption of the Addendum to the previously certified Second Final Supplemental Environmental Impact Report; and
WHEREAS, notices of said public hearing were made at the time and in the manner required by law; and
WHEREAS, at the completion of the public hearing, the City Council duly considered all evidence presented at said hearing; and
WHEREAS, the City Council of the City of Santa Maria reviewed and considered the Addendum to the previously certified Second Supplemental Environmental Impact Report for the Sa nta Maria Regional Landfill Facility permit update project, included as Attachment A to the Council Agenda Report dated December 5th, 2023, incorporated herein by reference; and
WHEREAS, the Addendum to the Second Supplemental Environmental Impact Report reflects the City Council’s independent judgment.
NOW THEREFORE, IT IS HEREBY RESOLVED, by the City Council of the City of Santa Maria, California, as follows:
SECTION 1. The above recitals are true and correct and incorporated herein by reference.
SECTION 2. The City Council adopts the Addendum to the Second Final Supplemental Impact Report (Attachment A of the Council Agenda Report dated December 5th, 2023, incorporated herein by reference) for the Santa Maria Regional Landfill Facility permit update project.
3 SECTION 3. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
SECTION 4. The records of these proceedings are located in the Community Development Department of the City of Santa Maria, 110 South Pine Street, Santa Maria, California 93458.
