RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA,
CALIFORNIA, AUTHORIZING A NEW TIERED DISPOSAL RATE STRUCTURE
FOR PERMITTED ROLL-OFF AND SOLID WASTE HAULERS FOR THE
SANTA MARIA REGIONAL LANDFILL, COMMENCING JANUARY 1, 2024
WHEREAS, the Utilities Department provides integrated waste management services on behalf of the City of Santa Maria (“City”) , which includes muni cipal solid waste, recyclables, and organic waste collection services for residential and commercial customers, operating the Santa Maria Regional Landfill (“SMRL”), and planning for the design, permitting, construction, and operations of the future Integr ated Waste Management Facility at Los Flores; and
WHEREAS, on April 4, 2017, the City Council adopted Resolution No. 2017-40 to develop a tiered disposal rate structure for municipal solid waste delivered to the SMRL by franchise roll-off haulers (now referred to as “permitted haulers”); and
WHEREAS, as authorized by Resolution No. 2017-40, the Director of Utilities was authorized and directed to establish standards for permitted haulers and evaluate haulers’ eligibility under the tiered disposal rate structure; and
WHEREAS, the tiered disposal rate structure successfully secured new waste volume to the SMRL that increased revenues to the Solid Waste Disposal Fund; and
WHEREAS, on November 3, 2020, the City Council adopted Resolution No. 2020- 108 to revise the tiered disposal rate structure for municipal solid waste delivered to SMRL by permitted haulers; and
WHEREAS, the City’s Solid Waste Disposal Fund financial model has demonstrated that costs exceed revenues due to escalating expenses related to operations, maintenance, equipment replacement, and environmental monitoring and reporting, as well as planned capital expenditures related to the construction of a landfill liner extension project to expand disposal capacity at the SMRL in June 2024, the construction of the initial phases of the future Integrated Waste Management Facility at Los Flores during fiscal year 2026-27, and final closure activities of the SMRL beginning in fiscal year 2031-32; and
WHEREAS, in order for the City of Santa Maria to continue to provide a cost - effective alternative for waste disposal by permitted haulers and new solid waste haulers and continue to generate additional revenue for the Solid Waste Disposal Fund, the tiered disposal rate structure will be adjusted to provide a disposal fee discount from the current posted general refuse gate rate at SMRL based on tonnages delivered; and
2 WHEREAS, current permitted haulers as well as future permitted haulers and other eligible solid waste haulers delivering new waste volumes to the SMRL will be eligible for the new tiered disposal rate structure.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. Authorize the new tiered disposal rate structure for permitted roll-off haulers and solid waste haulers , commencing January 1, 2024 (Exhibit “A”).
2. Authorize the City Manager or designee to determine the eligibility of permitted roll-off haulers and solid waste haulers for participation under the tiered disposal rate program.
3. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
