RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MARIA, CALIFORNIA, APPROVING THE DEFERRAL OF TRAFFIC
GROWTH MITIGATION IMPACT FEES TO BE PAID OVER A FIVE-
YEAR PERIOD FOR THE JUST BOBA DEVELOPMENT, LOCATED
AT 1954 SOUTH BROADWAY.
WHEREAS, Judith Mendoza operates Just BOBA and leases property located at 1954 South Broadway, Suite J (APN 128-084-010) in the City of Santa Maria, California with a Building Permit (B23-0552) that requires payment of Growth Mitigation Impact fees prior to final occupancy of the development consistent with Section 8-15 of the Municipal Code; and
WHEREAS, Section 8 -15.06(g) of the Santa Maria Municipal Code allows qualifying commercial developments the ability to pay Growth Mitigation Impact Fees over a period of five years with City Council approval.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. The Agreement with Judith Mendoza for the deferral of Growth Mitigation Impact fees for a period of five-years is approved; and
2. The Faithful Performance Bond provided as security to ensure payment of Growth Mitigation Impact Fees for a period of five-years is accepted; and
3. All other applicable provisions and requirements of the Municipal Code pertaining to Growth Mitigation Impact Fees have been complied with; and
4. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
