SCOPE OF SERVICES
Consultant hereby agrees to provide to the City of Santa Maria, as the scope of services under this Agreement, the services described on City’s Request for Proposal for Pedestrian and Bicycle Safety Professional Services dated January 22, 2024 (Exhibit “D”) which outlines the scope of services and work under this contract, and the approved Consultant’s Proposal dated January 30, 2024. (Exhibit “E”).

The City seeks to enter into an agreement with a consultant to help complete the ter ms of the awarded OTS Grant Identified as Attachment C in Section 4 of the Request for Proposals. The consultant would purchase 125 helmets for distribution. The helmets are included in the not-to-exceed amount for this contract.

The agreement would have the option to extend the program for two additional years on a yearly basis with a reduced budget from Measure A dollars to support pedestrian/bicycle education events and trainings.

During the course of this Agreement, the City will identify tasks and ask the Consultant to prepare a task proposal which, at a minimum, will include: scope of work, “not-to-exceed” cost, and schedule. Additional tasks will be assigned as new exhibits to this contract, with each new task being sequentially as Exhibit A1, A2, A3, etc.

No Task may be assigned under this contract unless that project has been separately budgeted for and approved by the City Council. The City is under no obligation to expend any funds under this Contract unless it determines it is in the City’s best interest to do so.

The City is under no obligation to utilize the prequalification list for any particular project and may instead seek services for that project pursuant to the City’s purchasing guidelines. When work is performed pursuant to the prequalification list established by this RFP and this Agreement, work will be performed on a rotating basis among the pre- qualified consultants, based on consultants’ availability.

A Notice to Proceed will be issued by the City for each task under this Agreement. In case of any conflicting terms it is the express intent of the parties hereto that the order of precedence and controlling language shall be as follows:
1) t
his Agreement;
2) the City’s Request for Proposal (Exhibit “D”);
3) the Consultant’s proposal (Exhibit “E”).

S
elected firms will be expected to perform the following tasks either within their own forces or by the use of sub-consultants identified in consultant’s proposal.

Tasks may include, but are not limited to the following:
• Teaching students how to ride a bicycle for the first time. • T eaching students riding skills to enhance safe behaviors such as stopping and stop signs, yielding, signaling.
_____________________________________________________________________________________

Page 6 ends

• Creating program sustainability by training teachers to teach the program including coordinating volunteers and managing logistics.
• Providing low-cost helmets for all students.
• Providing low-cost bicycles for students in need.

Best practice strategies will be conducted to reduce the number of persons killed and injured in crashes involving pedestrians and bicyclists. The funded strategies may include classroom education, bicycle rodeos, community events, presentations, and works hops.

These countermeasures should be conducted in communities with high numbers of pedestrian and/or bicycle related crashes including underserved communities, older adults, and school-aged children. Coordinated efforts such as Safe Routes to School initi atives, Safe System Approach, and working with community based organizations are highly encouraged to prevent fatalities and injuries of vulnerable non-motorized road users.

The consultant selected will help the City of Santa Maria meet all goals and objectives identified in the FY 23/24 OTS Grant awarded to the Public Works Department. The grant and budget are attached to this RFP for reference. The tasks and responsibilities of the selected consultant will be reduced to reflect the above bullet points following the first year of this contract.

State of California Office of Traffic SafetyGRANT AGREEMENT Schedule A GRANT NUMBERPS24042 1. PROBLEM STATEMENT Santa Maria has many high-volume 4-lane streets designed with moving cars as the priority. There are few facilities for bicyclists, and safe opportunities for pedestrians to cross busy streets are often many blocks equire multiple crossing guards due to high volumes of fast-moving traffic. Many community members are unaware of recent improvements to pedestrian and bicycle infrastructure and continue to use unsafe or outdated infrastructure on their routes to destinations. Many lack equitable access to safety education or life-saving equipment like helmets. This leads to unsafe conditions such as cyclists on sidewalks, riders executing turns incorrectly, riding the wrong way in bike lanes or riding at night without lights or high-visibility clothing. Local cyclists may be discouraged from riding, decreasing driver awareness of cyclists and reducing incentives for the community to invest in safer bike infrastructure, and students participating in bicycle education at Santa Maria schools may be discouraged from riding to school by intimidating routes. According to the OTS Crash Rankings, Santa Barbara County ranked 2nd highest statewide for bicyclist-involved crashes in 2020, and Santa Maria is no exception with a ranking of 13 out of 61 smaller B-size cities statewide. Crash rates through 2021 were also relatively high for a city with a population of around 110,000. There were 18 bicyclists injured in crashes in 2021 alone. Older riders are also three times more likely for a crash to result in fatality or severe injury. Two recent incidents in Santa Maria involved young students struck on their bicycles while riding to school near busy intersections. In both incidents, the young riders were found at fault after making mistakes like not yielding for a stop sign or being on the wrong side of the road. According to the Santa Maria Times, Officer McGehee, of the Santa Maria Police Department, Elementary up to junior-college-aged students and adults using their bicycles as a form of transportation are most impacted by these issues, as they have little choice but to continue to take their chances along roads that are built for the convenience of celementary school students, where minority enrollment in Santa Maria is close to 100%, while 86% are identified as economically disadvantaged. Those who cannot afford to use a car or do not have access to commuter safety education or equipment currently face reduced access to community services and resources, resulting in a higher likelihood of being involved in a serious crash with a vehicle since students without knowledge of cycling rules and best-practices are more likely to ride unsafely. 2. Based on this policy: 1.The recipient shall disclose any conflict of interest identified as soon as reasonably possible, making an immediate and full disclosure in writing to NHTSA.
