RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF SANTA MARIA, CALIFORNIA, APPROVING AN

AMENDMENT TO SANTA BARBARA COUNTY ASSOCIATION

OF GOVERNMENTS JOINT POWERS AGREEMENT

WHEREAS, California Senate Bill 1462 was approved establishing the California Broadband Council to promote broadband deployment in unserved and underserved areas as defined by the California Public Utilities Commission. In August 2020, Governor Newsom signed Executive Order N-73-20 which required the development of a Broadband Action Plan for California. Furthermore, in July 2021 , California Senate Bill 156 authorized Joint Powers Authorities to issue revenue bonds for broadband infrastructure implementation under the Broadband Loan Loss Reserve Fund; and

WHEREAS, The Broadband Alliance for Santa Barbara County was formed.

Contributions were made from American Rescue Plan Act funding to develop a countywide Broadband Strategic Plan (BSP). Work on the BSP began in late 2021 and in December 2022, the Santa Barbara County Association of Governments (SBCAG) Board approved the BSP as a framework plan for which to initiate broadband implementation in the County. Prior to the adoption of the BSP, SBCAG received approvals from membe r agencies.; and

WHEREAS, The SBCAG board approved an option that would have its coun sel amend SBCAG’s Joint Powers Authority (JPA) agreement to include broadband activities.

Members of SBCAG supported this as the simplest approach, did not require the development of a new JPA , and maintained local control for broadband implementation and permitting. That process has now been completed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:

1. The City Council hereby authorizes the Mayor, or designee, to execute the amendment to the Second Amended and Restated Joint Powers Agreement for SBCAG; and

2. The Chief Deputy City Clerk is hereby authorized to make m inor changes herein to address clerical errors, so long as substantial conformance to the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
