RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA, CALIFORNIA, AWARDING A BID TO THE RAMINHA CONSTRUCTION, INC. IN THE AMOUNT OF $14,975,600 FOR THE CONSTRUCTION OF THE CELL 1 PHASE II LINER EXTENSION PROJECT, BID NO. 2024-03
WHEREAS, the City of Santa Maria formally advertised the Cell 1 Phase II Liner Extension Project, Bid No. 2024-03 (“Project”); and
WHEREAS, the Notice Inviting Bids was published and posted in compliance with applicable sections of the Public Contract Code; and
WHEREAS, the bids were publicly opened electronically at 2:00 p.m. on May 21, 2024, via Planet Bids; and
WHEREAS, Raminha Construction , Inc. , was determined to be the lowest responsive, responsible bidder who included all required documentation, bid bonds, and signatures; and
WHEREAS, an Environmental Impact Report was prepared for the project, and
WHEREAS, existing design funding for this project was appropriated for the 2023- 2024 Fiscal Year in the account titled “Cell 1 Phase II Liner Extension Project” but an additional appropriation for next fiscal year is necessary for construction costs in order to complete the project.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. The Mayor is hereby authorized and directed to execute, for and on behalf of the City of Santa Maria, a n Agreement with the Raminha Construction, Inc., for the Cell 1 Phase II Liner Extension Project, Bid No. 2024-03; and
2. The award of the bid is conditional upon execution of the Agreement by the successful bidder in the form and terms set forth therein by the City; and
3. The City Manager, or designee, is hereby authorized and directed to designate funds from the following identified account: “Cell 1 Phase II Liner Extension Project” for the approved project, totaling $17,500,000; and
4. The project budget of $17,500,000 includes an approved $600,000 in base budget for Fiscal Year 2023-24 and a new appropriation request
2 of $16,900,000 for Fiscal Year 2024-25. This award of the bid contract is contingent upon the City Council awarding funding for this project in the 2024-2025 Fiscal Year budget request approval. The contract does not become effective until the project is f unded by the City Council.
This award of contract shall be null, and void and the Agreement terminated on its own terms should the project not be funded in full by August 10, 2024.
5. The City Manager, or designee, is hereby authorized to approve Contract Change Orders so long as expenditures do not exceed the total funding approved for the project; and
6. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
