RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MARIA, CALIFORNIA, APPROVING THE ADDITION OF A COMMERCIAL BUILDING INSPECTION FEE AT 100 PERCENT COST RECOVERY
WHEREAS, the City of Santa Maria’s last comprehensive Citywide User Fee Study was completed in 2021; and
WHEREAS, the City contracted with Revenue and Cost Specialist to complete an Annual User Fee Update and User Fee Schedule 2024 based on the 2020 Comprehensive Fee Study, using updated salary and position data and Fiscal Year 2023- 24 budget; and
WHEREAS, at the June 4, 2024, City Council Meeting a public hearing was held, and at the June 18, 2024 City Council Meeting the City Council adopted Resolution 2024- 84 setting forth the fees in the Annual User Fee Update and User Fee Schedule 2024; and
WHEREAS, the proposed Commercial Building Inspection Fee for the Fire Department’s commercial occupancy inspection program will be set at a level that ensures the amount collected is the same as the City’s expense to provide the service, thereby eliminating subsidies from other sources; and
WHEREAS, in accordance with Section 2-24.105 of the Santa Maria Municipal Code, cost and revenue data regarding the proposed new Commercial Building Inspection fee was made publicly available in the City Clerk’s Office at least 10 days prior to the November 19, 2024, public hearing date; and
WHEREAS, after deliberation, the City recommends that the City Council adopt the Commercial Building Inspection fee as proposed (Attachment A of the Council Agenda Report and incorporated herein by reference); and
WHEREAS, the City will continue to update user fees annually using the Consumer Price Index, in accordance with Section 2-24.202 of the Santa Maria Municipal Code;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
1. The City Council hereby adopts the Commercial Building Inspection fee as shown in Attachment A of the Council Agenda Report related to this matter, and incorporated herein by reference, and dire cts the City Manager, or designee, to coordinate with the Department of Finance to implement the fee effective January 1, 2025; and
2. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
