COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Brett Fulgoni, Director of Public Works

DATE: January 21, 2025

SUBJECT: Adoption of a Resolution Approving a Proposed Quitclaim of Portions of East Jones Street, South McClelland Street, and South Miller Street

Description:

The City Council will consider approving the quitclaim of a portion of East Jones Street and acceptance of quitclaims for portions of South McClelland Street and South Miller Street in an effort to support the future development of APN 125-142-002.

Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

RECOMMENDATION:

Adopt a Resolution approving the acceptance of quitclaims for portions of South Miller Street and South McClelland Street and granting a quitclaim for a portion of East Jones Street to G.A. Hancock Properties Inc and acceptance of a 20 -foot-wide Public Utility Easement, Multi-Purpose Trail and Landscape Easement.

BACKGROUND:

Property owner, G. A. Hancock Properties Inc. (G.A. Hancock), identified the following inconsistencies with a review of their property bo undary; portions located along South McClelland Street and South Miller Street were located within the existing roadways. In addition, it was also found that the formal dedication of East Jones Street was never formally accepted by the City as right -of-way. Although shown on current APN maps as right-of-way, a thorough record search of the chain of title found no formal acceptance.

G.A. Hancock seeks to clarify the boundary of APN 125 -142-002 with two actions; a quitclaim of the portions of property in street right -of-way to the City and request a quitclaim of the City to G. A. Hancock for East Jones Street, see Attachments A, B, and C.

DISCUSSION:

Upon review of the request, City staff supports the quitclaim of the portions of property along South McClelland Street and South Miller Street with no issue. These areas are currently maintained by the City as right-of-way.

2 Staff is supportive of a quitclaim of a portion of East Jones Street to G. A. Hancock.

However, following the quitclaim of the thi rty-foot-wide East Jones Street, the City will require a 20-foot-wide easement for the following; Public Utility Easement, Multi-Purpose Trail, and Landscape Easement. The subject easement will accommodate the land necessary for the City’s Rule -20 program (underground of PG&E facilities) and provide the necessary width for any potential improvements of a multi -purpose trail and accompanying landscaping in the easement area. The property owner is supportive of the grant of easement. The timing of the development of APN 125-142-002 is unknown.

Alternative(s)
City Council may choose to not accept the quitclaim along McClelland and Miller and grant the quitclaim of a portion of East Jones Street to G. A. Hancock. This alternative is not recommended as the denial will prohibit the formal development of APN 125-142-002 and the installation of the necessary PG&E infrastructure for the Rule 20-A program.

Fiscal Considerations
The acceptance of the quitclaims from G. A. Hancock for South McClelland Street and South Miller Street will result in no additional cost to the City, as the City is currently maintaining those areas. The quitclaim of a portion of East Jones Street from the City to G.A. Hancock will also result in no additional cost, as the subject area is cu rrently an abandoned railroad right-of-way.

Impact to the Community
There is no immediate impact to the community, however, the quitclaim of the subject areas enhances the potential for development in the downtown civic center area. In addition, it also reduces the number of overhead power and utility lines and provides for an improved modern appeal.
