RECOMMENDATION:

Adopt a Resolution approving the DDS Partnership Parcel Map, Tract 6039.

BACKGROUND:

The tentative Parcel Map for Tract 6039 subdivision was approved by the Planning Commission on October 16, 2024. The 5.81-acre lot is located at the northwest corner of Main Street and Concord Street.

This is a subdivision of one lot into two lots for commercial retail uses.

DISCUSSION:

The DDS Partnership Parcel Map, Tract 6039, has been reviewed and approved by the City Engineer and the Community Development Director. With input from the Community Development, Recreation & Parks, and Public Works Departments the establishment of a sewer easement, public utility easement, and public pedestrian access easements were required as a condition of approval.

The City Clerk’s Office is in receipt of the parcel map. No sureties are required for the subdivision, as no public improvements are req uired. City Council action is required for the approval of public easements.

The Public Works Department has collected the appropriate required fees from the subdivider.

2 Alternative(s)
If the parcel map is unacceptable, the City Council shall make its re commended corrections, instruct the City Attorney and/or City Engineer to draft a new agreement and/or revise the final or parcel map, and defer approval until an acceptable agreement and/or final or parcel map has been resubmitted.

The City Council shall deny approval of a final or parcel map upon making a finding that it does not comply with the requirements of Section 11 -3.03(f) of this title or for failure to substantially meet and perform requirements or conditions which were applicable to the subdivision at the time of approval of the official tentative map. Any disapproval due to nonconformance with an official tentative map shall include a finding that identifies the unmet or unperformed requirements or conditions.

If the failure of the map to meet a requirement or condition is determined by the City Council to result from a technical or inadvertent error that does not materially affect its validity, the map may still be approved.

Fiscal Considerations
The City has been reimbursed for all plan chec king and administration fees associated with this Parcel Map review.

Impact to the Community
Impacts from this project were addressed and mitigated through environmental and planning processes. This Parcel Map follows the General Plan for the orderly development of this area of the City.
