SUBJECT: Request for Bond Release for Planned Development Permit Number PD2021-0011
Description:
The City Council will consider authorizing the bond release for Planned Development Permit Number PD2021-0011.
Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.
RECOMMENDATION:
By motion, authorize the release of Performance Bond – Public Improvements [#36K000365] in the full amount of $20,240 posted in the form of a Surety to guarantee the construction and installation of public improvements; and order the Labor and Material Bond in the amount of $10,120 and the Guarantee and Defective Material Bond in the amount of $2,024, be retained for six month and one year, respectively, from the date of the release of the Faithful Performance Bond for public improvements.
BACKGROUND:
Planned Development Permit Number 2021 -0011 for the project located at 1313 East Main Street was approved on November 16, 2022. Public Improvements we re included as part of the Conditions of Approval. Sureties were required to guarantee the completion of the Public Improvements.
DISCUSSION:
At the request of the developer, inquiries were sent to various departments on February 5, 2025, requesting aut horization to release the Faithful Performance Bond – Public Improvements [#36K000365] in the original amount of $20,240. Full releases were granted by each department.
