A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MARIA, CALIFORNIA,
ACCEPTING THE DEDICATION OF PUBLIC
RIGHT-OF-WAY FROM BE819CA, LLC
WHEREAS, BE819CA, LLC is the owner of the property located at 2140 N orth Preisker Lane; and
WHEREAS, the City of Santa Maria has required the dedication of public right -of- way along the project frontage as a condition of approval for PD2023-0005; and
WHEREAS, the dedication of this right-of-way supports future construction of the US 101/SR 135 interchange and associated public improvements; and
WHEREAS, BE819CA, LLC has agreed to dedicate this right-of-way at no cost to the City, and the dedication documents have been reviewed and approved by the City Surveyor and City Attorney.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Santa Maria, California, that the dedication of public right-of-way from BE819CA, LLC, as described in the Grant of Easement and attached exhibits, is hereby accepted, and the recordation of said documents is approved, as follows:
SECTION 1. The Mayor, or designee, is hereby authorized and directed to execute on behalf of the City of Santa Maria, the Grant of Easement and related documents, and
SECTION 2. The Chief Deputy City Clerk is hereby authorized to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
