Project Introduction
RCS was selected by the City of Santa Maria to update its user fees annually. This year, and every even year forward, RCS will conduct a re view of the City’s user fees, updating the City’s Cost Allocation Plan (CAP), salary and position da ta, and adopted budget. RCS will also meet with City staff to discuss the addition, removal and/ or adjustment of user fees.
On odd numbered years, RCS will perform a simple CPI Update of user fees.
Starting in March 2025, RCS bega n discussions with the City ab out user fee updates. It was decided that this year will focu s on three fees, and the remain ing user fees do not require any additional analysis by RCS. The three fees for this year are discussed below:
1) Copy Fee(s) – Clarification on the calculation and processing of various copying fees-
2) Credit Card Processing Fee – Recalculate actual credit ca rd processing fee to ensure full cost recovery.
3) Bid Protest Fee – Calculate proposed bidder protest fee for construction bids
Overall, the City of Santa Maria’s fees are ca pturing the full cost of services provided and below is a more detailed discussion.

In addition, Santa Maria must comply with th e State’s Public Records Act and it’s copying fees. The City wanted clarification on how its copy fees differ from the State, or should it be the same.
The Public Records Act under California state law permits the Secretary of State to charge a fee for providing printed copies of its records, and in many circumstances, electronic copies of records can be provided at no cost. The following fees apply for public record requests:
a) The fee for preparing a copy of any law, resolution, record, or other document on file in the Secretary of State’s Office is one dollar ($1.00) for the first page and fifty cents ($0.50) for each page thereafter. (Government Code section 12178.1(a)).
b) The fee for preparing copies of campaign statements, contribution and expenditure reports, or statements of disclosure of financial interest is ten cents ($0.10) per page. (Government Code section 81008(a)).
c) Any request requiring electronic compilatio ns, indexes, extracts, or summaries of information, including computer information, contained in the public records of the Secretary of State shall be provided, if resources and systems are available, at a charge sufficient to recover all costs associ ated with the request. (Government Code section 7922.575(b)(2)).
d) Fees for copying, reproduction, and other se rvices provided by the California State Archives shall be consistent with the cost s of providing such services. (Government Code section 12174(e)).
The City should apply the $0.10 per page limi t only for FPPC-related documents. For all other documents, the City is allowed to recove r the actual cost of reproduction, which the courts have held includes the staff time sp ent at the copy machine making the copy. The City is not allowed to charge for the time spen t to find the document or put it back. This allows for costs in excess of $0.25, but it makes sense to leave the fees as is, especially since most documents are delivered electronically and not actually copied these days. The cost of memory devices (thumb drives) purchased by th e City is approximately $5 each. Building plan copies are performed by outside businesse s and the City’s fee is to recover what the City has paid.
S‐235 [Credit Card Processing Fee] of 2.5% – RCS Recommends Maintaining the Current Fee
The City provided RCS with one year of cash iering transaction to analyze. Table 1 below shows that the City processes over 147,000 el ectronic transactions, totaling over $30 million in the 2024 calendar year. The types of transactions include payment for utility bills, business license, transit passes, building permits, and library fi nes. The charge from the bank or processing company to the City was based on a simple percentage or fixed amount up to an allowable tr ansaction amount. RCS analysis shows the average credit card transaction fee was between 1.2% and 29.7%, and the average processing fee was 2.8%.
The City of Santa Maria’s current credit card processing fee is 2.5%, and RCS recommends keeping the same fee.

Bid Protest Fee – RCS Recommends Full Cost Recovery for Bid Protest Services
The City requested that RCS calculate the full cost of providing two bid protest services.
Staff provided possible bid protest procedures , which outlines the process and identify staff involved in the services.
a) Bid Protest – This fee is for any bidding pa rty protesting the City’s decision on an RFP. The bidding parties may protest inde pendently or collectively. Each protest received requires payment of a separate protest fee.
b) Appeal of City Manager’s Bid Protest Deci sion – After the City Manager’s Office review and decision of the bid protest, any bidding part y may appeal the decision.

Based on discussions with City staff, RCS calculated the follo wing fees based on the most current fully burdened hourly rates.

It is recommended that the City Council adopt these fees at 100% cost recovery, consistent with all other user fees within the City.
The following tables present the fees in the categories described above, so that readers can easily compare the current fees to suggested fees. Following th ese four categories, the final table presents the fiscal impact of each user fee.
1) Increase by CPI – To Continue Full Cost Recovery
This first group represents 220 fees out of th e total 247 evaluated by RCS. These fees are recommended to increase based on the 12-mo nth percent change to the Consumer Price Index (CPI) for All Urban Consumers, Los An geles-Long Beach-Anaheim, CA area. The CPI change for 2024 is 3.3%, therefore RCS increased this group fees by a multiplication factor of 1.033. Fees less than $10 shows the same amount due to rounding.
