COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Brett Fulgoni, Director of Public Works

DATE: June 3, 2025

SUBJECT: Adoption of a Resolution Accepting the Right-of-Way Dedication from BE819CA, LLC

Description:

The City Council will consider accepting a right-of-way dedication from BE819CA, LLC, for public street and transportation infrastructure purposes associated with development of the parcel located at 2140 North Preisker Lane.

Environmental Notice: The activity is not a “Proje ct” as defined under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines. Therefore, pursuant to Section 15060(c)(3), no environmental review is required.

RECOMMENDATION:

Adopt a Resolution accepting the dedication of public right-of-way from BE819CA, LLC.

BACKGROUND:

As part of the development approval for PD2023 -0005 (Chick-fil-A project), the property owner, BE819CA, LLC, agreed to dedicate right -of-way along the project frontage to accommodate future improvements to th e US 101/SR 135 interchange. The dedication was reviewed and approved by the Public Works Department and the City Surveyor. The legal description and exhibit for the dedication are included in the recording packet.

DISCUSSION:

The dedicated area aligns w ith the future interchange configuration and supports the City’s long -term infrastructure planning. In lieu of providing a temporary construction easement, the developer will construct a retaining wall at the time of building permit issuance to accommodate the future interchange project. The right-of-way dedication will facilitate these improvements without requiring additional property acquisition.

The dedication documents, the Grant of Easement (Attachment B), including Exhibit A (easement sketch), and Exhibit B (legal description), have been reviewed and deemed acceptable for recordation. Acceptance by the City Council will authorize recordation and finalize the dedication process

2 Alternative(s)
The City Council may decline to accept the dedication; however, doing so would conflict with previously approved development conditions and could impede the future interchange project.

Fiscal Considerations
No costs will be incurred by the City for acquisition. The right -of-way is being dedicated by the property owner in accordance with project conditions of approval.

Impact to the Community
The dedication supports long -term infrastructure improvements and ensures that future interchange and roadway enhancements can be completed without delay, enhancing traffic operations and safety in the area.

Other Agency Review
Caltrans has reviewed the frontage design as part of the developer’s coordination for improvements within the SR 135 right-of-way.
