A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MARIA, CALIFORNIA,
APPROVING A PRIVATE STORMWATER MANAGEMENT
SYSTEM OPERATION AND MAINTENANCE AND RIGHT OF ENTRY
AGREEMENT WITH SM SKYLINE ESTATES LLC (DEVELOPER)
AND SKYVIEW ESTATES HOA (OWNER)
WHEREAS, Tract 6018, formerly known as Northman Residential and now known as Skyview Estates, has nearly completed construction and the developer, C oastal Community Builder (CCB), is seeking occupancy clearances and finalization of all on-site improvements; and
WHEREAS, the developer and owner wish to enter into a Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement with the City to provide financial surety for potential basin modifications, ensuring continued basin functionality and mitigat ing impacts to adjacent properties and the downstream storm drain system; and
WHEREAS, City staff has reviewed the proposed Agreement and determined that it adequately allows the developer to proceed with project completion while providing time to observe the performance of the modified basin, to the satisfaction of the City Engineer.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
SECTION 1. Authorize the City Manager to execute the Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement with SM Skyline LLC (Developer) and Skyview Estates HOA (Owner); and
SECTION 2. The Chief Deputy City Clerk is hereby authorized to make m inor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
