COUNCIL AGENDA REPORT
TO: Mayor and City Council
FROM: Brett Fulgoni, Director of Public Works
DATE: July 1, 2025
SUBJECT: Adoption of Resolution Approving a Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement with SM Skyline Estates, LLC (Developer) and Skyview Estates HOA(Owner)
Description:
The City Council will consider approving a Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement with SM Skyline Estates LLC (Developer) and Skyview Estates HOA(Owner).
Environmental Notice: The activity is not a “Project” as defined unde r Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.
RECOMMENDATION:
1. Adopt Resolution Approving a Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement with SM Skyline Estates LLC (Developer) and Skyview Estates HOA (Owner); and
2. Authorize City Manager to execute agreement.
BACKGROUND:
Skyview Estates (Tract 6018, formerly known as Northman Residential) includes a stormwater retention basin that requires continued observation and may need additional infiltration modifications. The basin previously experienced infiltration issues that impacted adjacent properties before modifications were made to improve performance.
DISCUSSION:
The Skyview Estates basin was modified in 2024 to enhance infiltration rates and reduce impacts to neighboring properties. However, there have been no rainfall events sufficient to verify the basin’s performance, and testing with potable water would be both wasteful and costly. To address this, Skyview Estates will provide a bond to fund further underground infiltration improvements if the basin’s performance fail s to meet the requirements set by the City Engineer.
2 Alternative(s)
The City Council may choose not to enter into the Private Stormwater Management System Operation and Maintenance and Right of Entry Agreement and may direct staff to pursue alternative surety and performance measure requirements.
Fiscal Considerations
This Agreement will have no fiscal impact on the city.
Impact to the Community
The Agreement provides additional protection for adjacent and downstream properties by ensuring the stormwater basin functions as intended and mitigates potential flooding or runoff concerns.
